The first step is to obtain a copy of all 3 credit reports, credit reports can be obtained for free at www.annualcreditreport.com . According to federal law, consumers are able to dispute anything on their credit reports that they choose. The credit bureaus in turn have 30-45 days to respond with the results of their investigation which will be either DELETED, VERIFIED OR UPDATED. These results will be based soley on which technique was used when the said items were disputed.
When items are considered to be VERIFIED to the credit bureaus from the creditor, this typically means that your name, address, and ssn is in their computer system which is not proof. The Fair Credit Reporting Act counters that consumers, upon request, are to be given a contract as proof of account. The next step is to request a copy of the actual contract from either the ORIGINAL CREDITOR, COLLECTION AGENCY, or COURTHOUSE which will make them provide proof of the alleged account.
For the most part, creditors and collection agencies use computers to store information about their customers and don't keep original contracts or documentation. So your personal information may be on their files, but the contract most likely is not. We have found it to be an extremely rare case that a creditor has the original contract, since it does cost them money and time to keep such items on their data base. they have your information but they don't have real proof that your obligated to pay the account.
