Vioxx Lawsuit

Vioxx is a cox-2 inhibitor, and a drug that was widely marketed - and prescribed - drug between May 1999 and September 2004. The drug was prescribed for the treatment of osteoarthritis, menstrual cramps, and pain management in adults. Once hailed as a wonder drug, vioxx was recently pulled from the US market following indications that it resulted in an increased risk of heart attacks and strokes. It was recalled voluntarily by the drug manufacturer, Merck; however, claims that Merck actually knew about the dangerous side effects of the drug years ago is likely to result in a great many vioxx lawsuits through the US and Canada.

A vioxx lawsuit will enable injured parties that have been adversely affected by this drug to claim compensation for factors such as pain and suffering, loss of income, and medical expenses resulting from ill health caused by vioxx. The recall of vioxx and the evidence presented with regards to the risks associated with this drug have resulted in a number of lawyers now specialising in vioxx lawsuits. These lawyers can use their experience and expertise to maximize your chances of success, giving you a better chance of filing a watertight vioxx lawsuit.

A specialist lawyer can deal more effectively with a vioxx lawsuit because he or she has already established links with relevant sources and already has access to valuable information that you assist with your vioxx lawsuit. Since most vioxx lawyers offer a free consultation to those looking to file a vioxx lawsuit, you can determine the best cause of action as well as assess your chances of success without having to pay out any cash. By discussing a potential vioxx lawsuit with an experienced, specialist vioxx lawyer, you can increase your chances of receiving a hefty payout to cover the suffering and expenses that you may have experienced as a result of taking this drug.

When you go through an experienced lawyer to discuss your vioxx lawsuit, the lawyer can also advise what sort of action would prove most beneficial according to your circumstances. Your lawyer will advise whether you should consider a class action suit over an individual vioxx lawsuit. Once your vioxx lawsuit in underway, your vioxx lawyer can also determine when to go to trial, or if an out of court settlement is offered, whether agreeing to it is the best option.

A vioxx lawsuit would be filed under the umbrella of "products liability", which basically means that the manufacturers marketed and distributed this drug knowing that it could cause serious side-effects and harm. Part of the vioxx lawsuit would be to prove that the manufacturer of the product, in this case Merck, acted irresponsibly by not giving consumers proper warning about the dangers of the product, which in this case is vioxx. Another factor that the vioxx lawsuit will have to prove is that the plaintiff (the person filing the lawsuit) was harmed in some way as a result of taking the drug.

Obviously, the manufacturer of the product is not going to want to pay out compensation. And, with so many vioxx lawsuits in the pipeline, it is very likely that the manufacturer will have an expert legal team to try and cut down as much as possible on compensation payouts. This is another reason why you should go through an experienced lawyer for your vioxx lawsuit, as a well-verse professional will know what to expect and is more likely to be able to put together a watertight case with regards to your vioxx compensation claim.
