CONTRACT

CONTRACT FOR RENTAL OF ‘SHOREHAVEN’ QUILTY CO. CLARE

You will find below the contract between the two parties if we finalise a rental agreement with you. In this document you will find all the details and the conditions for when you rent the property from us.

This document represents the binding contract between the client named in the Client Details section of this document, hereafter named ‘the client’, and SHOREHAVEN (miketina), represented by its Directors, hereafter named ‘the owners’. The owners and the client agree a short term – holiday let of the following property: SHOREHAVEN.

The property is shown with its details on the website of the owners www.freewebs.com/shorehaven and corresponds in its details to the description on the website. The photographs shown on the website are of the property.

1 The rental period is agreed between the client and the owner for the arrival day of ........... to the departure day, the ............

A sum of ...............Euro has been agreed for the following:

Number of Adults  i.e. (over 18 years of age)......=..........

Number of Children.....(1 to 18 years of years).....=.....

Number of babies..........(less than 1 year ).......=....

2 The client may move into the property at 16:00 hours on the arrival day (or as previously arranged) and has to vacate the property before 10.00 am.  on the departure day (unless previously arranged). The owners will provide and make ready a set of keys for the client on the arrival day and the client will leave the keys in the post box outside of the property on the departure day if the owners /agents are not present.

3 The property is rented as seen, with the features described as on the photographs on this site. The client is responsible for any damage to the property or its contents, if caused by the negligence of the client or in cases of misproper or abnormal use. The owner may charge the renter for any damage, which has not been paid for during the stay of the client, or seek to recover costs via other legal means.

4 In order to exclusively confirm a booking, a deposit of 25% of the total agreed rental price is required, at the latest, eight  days after making the booking. This corresponds to ........€ Euros and can be paid via bank transfer. Any transfer costs must be paid for by the client.

5 To cancel a reservation and obtain a full refund of the first payment, (less bank costs) the client must give full written notice at least 60 days before the arrival date. If the cancellation is less than 60 days before the arrival date no refund is available.

6 After the initial deposit payment is made, the remaining % of the payment, or any remaining extra costs, must be paid into the owners bank account at least 10 working days prior to the arrival date or CASH upon arrival.  Any transfer costs must be paid for by the client.  WE DO NOT ACCEPT CREDIT CARD PAYMENT ON ARRIVAL.

7 If the deposit or the total rental costs are not paid within the agreed terms, (specific terms, other than the above, may be agreed between the parties) the reservation is considered void.

8 Refund insurance cover is available to the client with ‘homelidays’ should they wish to take out same.

9 The owners may change the rented property to another one if there is an Act of God or any other emergency reason which prevents the rental of the agreed property. The owner will in this case endeavour to provide the best property of similar quality and closest location possible to the original property. The agreed rental price will not change.

10 There is no charge if the client arrives in the hours of daylight (before 20.00 hours) if the owners have been given ample notice of this delayed time. An extra charge of 20.€- Euros may be placed for arrivals between 20:00 hours and 23:30 hours. An extra charge of 30.- Euros will be placed for arrivals between 23:30 hours and 08.00 hours. This one time door-opening fee has to be paid in cash to the person who will show the house to the client.

11 The rental price can include a linen change, if the rental period is over one week and the client has arranged this at booking.

 A final cleaning session takes place after the departure of the client and is included in the rental price. However, if the house is unusually dirty after the departure of the client, or if there is major cleaning difficulties, a charge will be made to the clients for the extra cost. The client agrees to this charge with the client’s signature on this agreement and/or the payment of the deposit. The owners reserve the right to collect a damage deposit from the clients on arrival to cover any damages or unusual cleaning.

12 Bed linen, towels and all usual household items required for basic living will be provided by the owners. No consumables or beach towels will be provided unless specifically requested and at an extra charge per item. The towels provided with the property may NOT be used outside of the property ie. the beach, or for uses other than personal/household hygiene.

13 The rental price includes costs for electricity, refuse, water and all taxes. Any unusual consumption of electricity will be charged to the client.

THE CLIENT WILL BE CHARGED A FEE FOR OIL HEATING  but this will be arranged with the client before-hand. The oil is metered so the client will only be charged for the oil used at the prevailing cost,which will be conveyed to the client before finalising of contract.

 The client must be responsible to switch off all the lights when leaving the house and to switch off all heaters, kitchen appliances and accessories when not in use.

14 The property does not contain any usable telephone lines. It is strictly forbidden for clients to ask any telephone or communication company to install any communication devices. The same applies to any satellite television services. The house already has television and receivers.

15 An internet dongle for checking emails or checking flight details can be provided. Clients are required to prepay for this facility

16 The property can only be resided in by the agreed group of people who are declared in full to the owner. Any extra person/s must be authorised by the owner and is/are only permitted to stay overnight if there is available bedspace/s.

It is not permitted for anyone to sleep on the sofas or floors. 

Renting an extra bed is not possible.

17 The owners have the right to refuse entry to the house to anyone at any time. The owners have the right to end the rental agreement at any moment, if there is evidence of the client not using the house properly or using it for purposes other than are appropriate for a holiday property rental.

18 Any unlawful acts within the house, either by the client or their guests, will end the rental agreement immediately. No illegal drug consumption or any storage of illegal drugs, substances or firearms/explosives in the house is permitted. The owners is not responsible for any damage sustained to the client or her/his guests due to alcohol/drug consumption. The client is kindly asked not to disturb the neighbours and not to drive vehicles or operate machinery if under the influence of alcohol. Please be aware of the drink/driving laws.

19 The owners are not responsible for any theft or loss of valuables to the client when the client is residing at the property or otherwise. Clients are advised to keep valuables in a safe if possible and/or to keep valuables with them at all times. There is no insurance against theft and loss of personal items other than any insurance cover the client may have included in their credit card, home insurance or travel insurance. Should a theft or robbery occur, clients are asked, to inform the owners immediately by telephone. Safety deposit boxes may be available at local banks.

20 The house is insured against fire, storm, water damage out of solid pipes or fixed installations, and rainwater through the roof. Damage sustained to the house or to belongings of the client must be reported immediately to the owners.

21 The client has the role of the house-keeper during his/her stay. The owners are not responsible for any damage happening to the client due to a deterioration of any part/s of the house during the stay.

22 The owners may collect a damage deposit from clients on arrival and this will be returned after the house and contents have been checked and found to be intact.

 It is possible that the damage deposit (if collected on arrival) or portion thereof will be paid into the client's bank account if checking  cannot be completed prior to the departure of the client.

ANY CHANGE TO THIS CONTRACT WILL RENDER IT NULL AND VOID.
