On 10/19/04 WFTV Ch 9 reported that a lack of enough waterproof may be the culprit causing our homes to leak during rain.

On 10/19/04 the Orlando Sentinel reported that "Paint jobs may be the culprit in leaks". Please consider before you run out and paint though, that your walls may still be wet inside and painting now could trap moisture in, creating a feeding farm for mold. You may need to remove drywall to help dry them out.

Just because we're in Florida's dry season does not mean the problem has gone away.


Now is not the time to sit back and let tract home builders get away with shoddy construction that is plaguing thousands of homeowners in Florida.

The water intrusion problem was not a direct result of the hurricanes, although they did make it evident for many who otherwise would not have known.

Water intrusion in newly construction homes has been occurring at least since 2003 as indicated by some of WESH 2's special reports last year.

We cannot allow builders to manipulate customers into unknowingly signing away their first amendment rights! Companies like Mercedes Homes and KB Homes are now including 1st amendment waiver clauses in their contracts.

It's time to get involved and get things resolved.

 

What You Should Be Doing

  1. Stop saying "It's not my problem, my new home wasn't affected." This affects anyone who has bought a home in the last four years and anyone that's going to buy a home in the next 20. Builders are hiding behind vague and sketchy building codes while government inspectors are not held accountable for giving approval on construction with obvious construction defects.

  2. Contact your insurance agency if you haven't already. Some agencies are denying claims while others are approving them and pursuing legal action against the builder due to material defect, which is extremely good for our cause. If your claim is denied, seek legal counsel and ...

  3. Get involved in a group effort. Don't sit back and think that someone else will take care of the problem, because they won't. We need your voice -- there is strength in numbers.

  4. Write your elected officials: national representatives, national senators, state representatives and state senators. Tell them that you're disgusted that builders are getting away with cheating their consumers. Tell them that the building codes need to be examined and modified so builders can't build cheap and hide behind legislation.

  5. File complaints with your local Better Business Bureau and the Florida Division of Consumer Services. Write a letter to the editor of your local paper.

  6. Sign the petition for a Florida Homebuyer Protection Act which calls for establishment of an act to protect homebuyers from shoddy new home construction in the state of Florida.

  7. Spread the word! Talk to your friends, neighbors and co-workers. Participate in the blue ribbon campaign. Let people know that there's a problem and tell them your story. Tell them to go to this web site and get involved as well. Put a banner ad on your own site back to this one.

Won't This Hurt Our Resale Value?

But that's just the point! Your resale value has already been impacted or will be impacted because there is water coming into nearly all new homes!

In addition, once new building codes to address this problem go into affect, buyers may be wary about homes built before the code's enactment unless they are repaired in accordance with the new codes.

That said, we understand your concern and hope that you will still participate. The more people that are involved, the more quickly builders will be pressured to remedy the situation and the more quickly our lives can get back to normal.

    • Focuses on the hurricanes
    • States that stucco/block houses allow water intrusion normally
    • States that due to the large amount of hurricane rain/wind the intrusion was
    • Cites stucco cracks as a point of entry
    • Acknowledges that there are currently no building codes adequate to deal with water intrusion
    • States that elastomeric paints are not advisable as a solution
    • Recommends significant code changes for future construction
    • Does not make any mention of houses leaking before or after the hurricanes and why the might be
