Breeding Contract --- On The Farm Contract

This On-Farm Stallion Breeding Contract for the breeding season of 2003, made and entered into on this _____day of _____________________, between Lori A. Eisenhardt, hereinafter designated as Stallion Owner and Breeder, and _____________________________, hereinafter designated as Mare Owner. Mare Owner agrees to breed the Mare____________________________, Reg. # ____________, to the Stallion MR PAINTED WORLD APHA # 149800, for the Stud Fee of $500, for a live colored APHA foal subject to the following conditions:
The mare owner agrees to pay a Stallion Stud Fee of $500, which includes a non-refundable $150 Booking Fee. The Mare Owner will return this signed contract, The Booking Fee and a current copy of the Mare?s Registration Papers. The balance of the Stallion Service Fee will be paid upon the Mare?s being serviced, or the mares? departure from TLE Acres.
Mare Owner agrees to pay for the care and feeding of the Mare while in the custody of Lori A. Eisenhardt, and TLE Acres. The Mare Owner also agrees to pay any and all expenses incurred by Mare, such as, but not limited to: breeding expenses, farrier work, veterinarian charges, worming, vaccinations, and other associated charges.
The Breeding Season for this contract is February 1 - July 1, 2003.
TLE Acres requires a current negative coggins test on all mares coming to the farm for breeding. The Mare Owner also agrees that each mare offered for breeding shall be in sound breeding condition and be free from infection or disease. All open mares are required to have a current clean uterine culture. Any mare certified by the attending veterinarian not to be, in his opinion, in sound breeding condition shall not be bred.
TLE Acres takes extreme pride in its dedication to the well-being, safety, and comfort of our customer?s Mares. Mares/foals, and mares which are foaled or to be foaled here. Mare Owner agrees that TLE Acres, its owners, employees, veterinarians, guests, and the Stallion Owner shall not be liable for, but not limited to, any injury, death, theft, or accident to the Mare, Mare/foal, which would include loss or damage to personal items.
TLE Acres agrees to diligently try and settle the above named Mare. If, however, the Mare does not settle, TLE Acres and the Stallion Owner shall be held harmless. The mare must be vet checked ?safe in foal? by a licensed veterinarian by 30 days after the last day bred, and TLE Acres must be advised of the Mare?s pregnancy status within 10 days of her exam or, all guarantees become null and void.
The Stallion Owner Guarantees a live foal from this breeding. If the Mare does not conceive, aborts, produces a foal that is stillborn or, a foal unable to stand and nurse, the Mare is entitled to a re-breed in the 2004 Breeding Season. This rebreed guarantee does not include death from injury to the foal. In addition, Booster Rhinopnuemonitis (rhino) vaccinations must be administered as indicated by the individual drug manufacturer as the mare progresses through her pregnancy. Failure to do this will void the live foal guarantee.
The Stallion Owner Guarantees a colored (eligible for regular APHA registry). If the resultant foal is born solid, then the Mare Owner is entitled to a re-breed in the 2004 Breeding Season. If the resultant foal is born minimal colored it is the mare owners choice to opt to re-breed for the 2004 Breeding Season, however if the first foal is later advanced to the regular (colored) registry the mare owner will be liable to owe the Stallion Owner a Stallion Service fee for the 2004 Breeding.
It is further agreed that should the above named Stallion die, or become unfit for service prior to covering the mare, the Stud Fee less the Booking Fee and expenses owed will be refunded if it has been paid in full in advance, thereby canceling this entire contract. If the mare dies or becomes unfit to breed before being pronounced safe in foal, the Stallion Owner has the option to accept another mare as a replacement, or a return for the following season.
A Breeder?s Certificate will be issued to Mare Owner after all expenses have been paid in full, and upon notification of the birth of the foal or sale of the Mare. The live colored foal guarantee is non-transferable without prior consent of the Stallion Owner.
Billing: Invoices are due and payable by the 15th of the month to avoid an 18% per annum late fee. Mare Owner?s account must be paid in full prior to taking possession of the Mare, Mare/foal. In the event it becomes necessary to refer debts arising from this contract to any attorney for collection, or a suit instituted hereon, Mare Owner agrees to pay all court costs and attorney?s fees incurred in the suit or collections. Payment past due thirty (30) days will be considered default and breeder is entitled to a possessory lien against Mare Owner?s horse(s).
This contract shall be governed by the laws of the County of Cumberland, State of New Jersey, and shall be binding upon the parties hereto and their personal representatives.
Mare owner?s signature on this contract certifies that he/she has read and fully understands all of the terms and conditions outlined herein, and accepts this contract as a legal and binding instrument on behalf of owner, owner?s heirs, successors, and assigns. This agreement constitutes the entire agreement between parties. No other agreements, whether verbal or implied, are included. This contract may not be transferred or assigned.

Rules For Shipped Semen
The stud fee for Mr Painted World is $500. A booking fee of $150 is due with signed Transported Cooled Semen Stallion Breeding Contract. Mares should be booked early.
A photocopy of the Mare?s Registration papers, signed copy of contract, Shipping Information form and booking fee must be returned to stallion owner.
The balance of the stud fee, $350 is due before any semen will be shipped. Also a $300 refundable deposit is required if the mare owner chooses to use a Hamilton Thorn Equitainer. Please remember out of state checks require 10 days to clear. We have had very good success with the disposable containers, there is no charge for those, however please return it when finished using it.
The mare owner is responsible for $150 collection, plus the shipping fee for each shipment.
Equitainer must be returned within 48 hours, or mare owner will forfeit $300 deposit.
If same day service is required, mare owner will be charged a $50 courier fee to airport and also be responsible for airline charges. Shipments will be insured to cover Equitainer replacement & collection & packaging fees only. If shipment is lost or delayed, Mare Owner assumes all risks of lost time and expense associated with preparation of his/her mare for breeding.
You must request semen shipment by 9:00 am EST. on the day semen is to be shipped. We appreciate a heads up phone call that your mare has come in heat and that you might need semen within a few days. You must call the cell phone of the Stallion Owner, Lori Eisenhardt at 609-364-5929 to order semen. Leave a message if no answer, but make sure you hear back from me to confirm your request.

This Transported Cooled Semen Breeding Contract for the breeding season of 2003, made and entered into on this _____day of __________________, is by and between Lori A. Eisenhardt, hereinafter designated as Stallion Breeder & Owner, and _____________________________, hereinafter designated as Mare Owner. Mare Owner agrees to breed the Mare____________________________, Reg. # ____________, to the Stallion MR PAINTED WORLD APHA # 149800, for the Stud Fee of $500, for a live colored APHA foal subject to the following conditions:
The mare owner agrees to pay a Stallion Stud Fee of $500, which includes a non-refundable $150 Booking Fee. The Mare Owner will return this signed contract, The Booking Fee and a current copy of the Mare?s Registration Papers. The balance of the Stallion Service Fee is due prior to the 1st shipment of semen.
All shipments will be subject to a collection and packaging fee of $150, plus the Fedex shipping fee. If same- day service is requested, an additional $50 courier fee and additional airline fee will be due before semen is shipped. If the Mare Owner requests the use of a Hamilton Thorn Equitainer, a $300 deposit is required. The Equitainer must be shipped back to Breeder within 48 hours from its receipt!. Otherwise a disposable Equitainer will be used, however we would appreciate if it is returned after use.

Mare Owner will need to call Lori Eisenhardt to correlate shipping dates. Mare Owner must request semen by 9:00am EST to receive semen next day. Semen is subject to availability. Semen requests will be filled in the order in which they are received. Every effort will be made to fill all orders. Lori A Eisenhardt will not be held liable if the mare is missed due to a shortage of semen. Lori A Eisenhardt is not responsible for lost, delayed or, damaged semen, and makes no representations or warranties of any kind with respect to any semen furnished hereunder except that it is the Stallion?s for which this contract is made.
