TVXQ, this generation's legend created by funds and nurtured by fans

An example of a successful Idol Group

TVXQ was the third male idol dance group that SM debuted after H.O.T. and Shinhwa. SM, who is the forerunner when it comes to the K-pop Idol culture, used any and every one of it's producing methods when it came to created TVXQ. Different from their seniors who could not shake off the image of 'A dance group that emphasizes looks,' TVXQ was an idol group that emphasized the members' vocal abilities from the start. They came with an a capella song with excellent vocalist Xiah Junsu as the main vocal. Dance skills and good looks were standard. Their debut song "HUG"(2004), that had some embarrassing lyrics such as "I want to be your bed for one day," gave teenage girls the image of a sweet and charming boyfriend. (The members who would whisper 'girl' after their debut successfully evolved into a mature group who gave off their sexy masculinity in 'Spell(MIROTIC)')

Each member becomes a subject for Games and Stories

SM's ability to instill a unique character in each member was the most prominent with TVXQ. 'Visual Shock', pretty boy YoungWoong Jaejoong who has looks that seemed to pop out of a comic book, manly leader U-Know Yunho, sweet guy Micky Yoochun with soft features who shows his honest feelings by frequently crying on stage, tall and handsome Choikang Changmin who is the youngest and cute Xiah Junsu who talks and acts like a child. These characters can be seen anywhere from tv shows to performances, to even the smallest of actions. It is almost as if they have made a kind of drama about themselves unlike other groups.

'Xiahmori', known by the vast majority of fans, is the members' intentional bullying of Xiah Junsu. Not only does this bullying emphasize Xiah Junsu's cute factor, it also shows the closeness of the members. To compare, the members of TVXQ are like the members of 'Infinite Challenge', each having their own unique character and part, each member created their own story of their characters early on in their singing career. Their images grew stronger as they matured. Masculine U-Know Yunho's 'oldest brother' image sunk in and stayed. While Yoochun's warm acceptance of Xiah Junsu's childish behavior has given them a 'sweet couple' image. The team's youngest member Choikang Changmin, who had the weakest image at the start, became the cool, indifferent 'Chic Chang,' or the 'Real Leader.'

These images and characters were the deciding factor when it came to the fans' acceptance of TVXQ's existence as one story. There are endless 'activities' to do with TVXQ as the subject. Fan-Fictions that include the idol members loving each other are prevalent in other groups, but they are not as good quality or quantity wise as they are with TVXQ as the main subjects. There is also a game that is called 'TVXQ's Answers for Situations'. It is a game where fans imagine what members would say about a same situation. Through these games, fans are able to become closer to the members, and the relationship between fans become stronger as they share games and laugh about their content. Not only their official fan club site 'Cassiopeia', but also all their tens and hundreds of fan cafes and sites have become a playground for fans.

The world's greatest fanclub that got on the Guiness Book of World Records

The number of people in Cassiopeia is 800,000. The number of people in Daum's fan cafe 'Yuaerubi' is also 800,000. SM stopped signing Cassiopeia members in 2006. Nowadays, TVXQ's fans Cassiopeia are simply called 'Ca-A' or 'Kang'. Cassiopeia, a name that derives from the five star constellation, was included in the Guiness Book of World Records for the largest fan club in the world. TVXQ's fandom, that started off as most fandoms do with the majority of fans being in their teens or 20s, spread out to include people in their 30s and 40s, and international fans. The fan clubs have even divided based on age. 'Xiah Soul' is a fan site for people in their 30s who have a preference for Xiah Junsu, and 'DongnaeBangnae' is a fan page where many international fans participate.

The fandom's personality has changed as well. The generation of fans who not only worship their idols, but also protect and support them, or act as spokespeople for the stars has come. The motherly guardian fandom that watches the stars grow from a young age started off with 'the first Nation's Idol' GOD and has evolved and solidified with TVXQ. The fandom that considers themselves the spokespeople of the stars have served community service hours or donated money under the name of the star. 'Match Made in Heaven' and 'AVC' are some of the Cassiopeia community service groups that move around the nation helping others. Fans do these services to better their star's image but they also become great contributors to society. As many people know, when the Mad Cow Disease crisis occurred in Korea last year, the first people to protest on the streets were the fanclubs of TVXQ.

The Internet's groups for people with the same taste

A fanclub's strongest cohesion comes from liking the same thing. Especially for society's underdogs who are open to the economic aspect of life, teenage girls, it is hard to find the sharing of one's affection without any competitiveness. The only competition amongst fans happens to be their faithfulness of their stars. In fan sites that work on a ranking system, many ask detailed questions about TVXQ for 'level ups'. There are even essay questions such as, 'The effect of a capella on TVXQ.'

The made-up language and ceremonies that only the fans know have also solidified this fandom. Cassiopeia decides on the type of cheer they will use at a TVXQ concert through voting. There are thousands of words and phrases that only the fans understand. The word 'Ilko' refers to an adult who hides the fact that he/she is a TVXQ fan and acts like a regular person. But the biggest influence of the fandom can be found in the music market. Instead of downloading illegally, fans have opened up their wallets for CDs even if TVXQ releases three versions of the same album. At the same time, TVXQ has also become a victim of an excessive fandom. Because of them, the new 'personal life fan (A fan who follows them everywhere)' has emerged who follows the star's movements almost 24 hours every day.

'Fan-Fic', putting sexual imagination to paper

TVXQ is also at the top when it comes to Fan-Fiction, a characteristic of idol fandoms. Fan-fics refer to the romance novels written by fans that depict the idol stars engaging in homosexual relationships. Rather than going against their 소유욕 by having their 'oppas (older brothers)' taken by other girls, the fans have made the members gay in the stories. It can be seen as a branch off of Japan's 'Yaoi' culture. After TVXQ's debut, SM aroused the homosexual imagination aspect by linking the members as couples. Of course this does not mean that the members are actually gay, and they used this romantic imagination, that could be used for heterosexual situations, to relieve the built-up sexual tension that women in their teens and 20s have. Many of the fan-fic writers are up to par skill-wise to professional writers. The majority are free to read through the writer's homepage, but there are some that are sold for profit.

An interesting fact is that there has been a sudden surge of fans in their 30s and 40s. This correlates to the increase of Auntie-Uncle fans that have appeared in society these days. They act as a protective guardian fandom as well as a fandom that has physical desires for people who are extremely younger than those fans are. Like adults who love teen romance such as 'Boys Over Flowers' or "Gossip Girls', they have an air of people who are physically attracted to and wanting idols who are way younger.

The Idealization of 'Me'

As most teens are limited from relationships because of their age, idols become a 'substitute lover' for them. At the same time, fans see idols as a part of themselves, feeling the success of the idols is their own success. Also, since teens live in a highly competitive society and do not have many successes of their own, they see TVXQ's success story with great awe (This is also why fans can be ruthless when it comes to tight competition with other groups.) If the members of TVXQ are not able to overcome this current situation, the devastating impact it will have on their fans is unimaginable.

They even have unwavering Vocal Abilities

The most important point of this TVXQ syndrome is their music. Even though they debuted as an idol group, they showed their vocal maturity and growth through their Japanese activities. Match the powerful dance skills trained through the SMP genre (SM's unique genre of song with powerful dancing), their stage presence, their ability to sing unwaveringly even after a powerful dance, and their good looks, and it's no wonder TVXQ started off the second Hallyu Wave. From dance to pop-ballads, the members have done them all and have used the members' star-qualities to their fullest potential. At live concerts, especially, has their music touched many hearts and that is why they are worthy of being called 'The Gods of the East' by their fans all over the world.

DS: I've been to Japan. TVXQ's popularity is even more extreme than we can imagine. Sad. I'm quite close with Yoonho hyung since we were on the same program; we still contact each other. I'm not sure why, but I hope it ends well.

-[news] TVXQ’s Homepage Flooded With Complaints 090809

After the ‘SM TWON LIVE ‘09′ was postponed indefinitely by SM Entertainment who said the reason was the lawsuit between the agency and TVXQ’s three members, Xiah Junsu, Micky Yoochun and YoungWoong Jaejoong, the fans’ criticisim has been flooding in.

SM released an official statement on the 7th of Augus stating that, “The ‘SM TOWN LIVE ‘09′ that was scheduled to be held on August 16th at the Seoul Jamsil Olympic Stadium has been postponed indefinitely.”

SM also stated that all ticket holders would be receiving a full refund but the fans’ rage did not subside easily. On TVXQ’s Hompage, posts of disappointment came from not only TVXQ fans, but from fans of other singers who were to be performing in the SM TOWN concert.

TVXQ fans stated, “We put a lot of effort and money into making events, and now they’ve become obsolete,” “How are they going to compensate for our efforts to secure tickets?” “We even rented a car to go, how are going to compensate for that?” “We’ve waited one year, and this is what we get?” They showed such strong reactions and protested to SM Entertainment. Some fans said that SM was trying to place the blame on TVXQ by saying that the concert was postponed because of the group and harshly criticized SM for what they did.

The fans of fellow SM Entertainment singers such as SHINee and Super Junior also showed their discontent and sided with and supported the fans of TVXQ

Some fans said they would visit SM to give their complaints while other said they would boycott SM goods. There has also been a suggestion for all the fans to gather and rally against SM on the 16th at the Jamsil Olympic Stadium at the time the concert was supposed to happen.

SM said, “SM TOWN LIVE ‘09 was a concert that was extremely popular with tickets being sold out as soon as they were put on sale, so we are very sorry to be giving out this unfortunate news,” and “We promise to bring a better SM TOWN LIVE concert in the future to those fans and families who wish to come to these concerts.”

-[trans] Jaejoong's letter for his members

“Words” – A letter Jaejoong wrote for the members. “You are my tattoo” is a letter Jaejoong wrote for the members during their fourth album.. Jae, you make one feel heart pain, I feel like crying again..

Note: This is not a new one but during the Mirotic Period. It has been rather low profile and was only released recently.

Jaejoong say:

To: Yoochun
Yoochun, you don’t say much usually but writing this down using these kind of words make me a little embarrassed. I know you have been very tired recently, worried and forcing a smile out – I feel sorry. We are always together and the other members are unable to see your sadness but the hard words have to be said out. If you’re tired, tell me, I will help you. I will also listen to all your troubles because I am always by your side. You can tell me anything and everything – the soul of my life. Yoochun, I love you.

To: Junsu
My cute Junsu. Because of you, we are DBSK; Junsu, the sound of DBSK. Kim Junsu, hyung really thinks you’re important, do you know? I have never forced you to do anything and you have always treatedd me seriously. Sorry, but I love you, my cute little brother, Junsu. Thank you, and sorry, as comapred to many others, hyung really understand your past, and wants to help you and that is why please continue working hard! I love you, Junsu!

To: Changmin
Our small and cute cat, we haven’t been making you do the cooking recently, sorry. Because of you, we have almost become closer, frustrating. However, we totally understand it is due to your fatigue and your lost energy when you occasionally tease us and command us to do stuff. We are all almost crazy.. haha.. always with a good heart and full of innocence, Changmin. You must continue working hard next time. We are always protecting you, if you’re tired, you must say it and we will help you. Forever the youngest, I love you.

To: Yunho
Jung yunho, Yunho, Yunho, our leader, Yunho. Are you tired recently? My, Yun, Ho, the reason he became the leader is because he has to tolerate all the hardships. Whenever I see your fatigue body, I think that way. I want to help shoulder some burden but am always unable to.. I know when we received the award, the other members were crying but you were holding it in and only hid in the toilet and cry when we reached home. Therefore, thank you for your letter but what was the content in the letter? “Sleep earlier, if you don’t sleep I will kill you..” Yunho, there would not be me if not for you. My other half, Yunho, I love you.

-[news] Nicole Kara Does Not Want TVXQ To Disband

Nicole, member of group KARA, who are currently busy promoting their second full length album , expressed how she felt about the news regarding Dong Bang Shin Ki (TVXQ).

While in the waiting room for KBS 2’s Music Bank where KARA had a special stage with Brown Eyed Girls, Nicole was asked by reporters about her thoughts on the on-going trouble in SM Entertainment regarding the case filed by the 3 members of TVXQ against the management.

Nicole expressed outright that she did not want the group to disband.

She says “I’m really sad about the rumors regarding the disbanding of TVXQ. As a fan that really likes TVXQ, I hope that this problem can be solved amicably. I don’t think it will be the same if any one member quits the group. I think they shine the brightest when the 5 of them take the stage as a group, as TVXQ. I hope they don’t disband and that they continue to be together just like how they are right now.”

-[news] SM Town Live '09, On Hold For Now

I seriously don't know what to think about this... another media play movement from SM??
Why are they blaming this on our boys? T__T
The performance which was to be held this coming 16th in Seoul Jamsil Olympic Stadium has been postponed for a later date due to TVXQ's three members' lawsuit against SM Entertainment.

SME stated, "We decided that it would be impossible to run the concert as planned when there is a lawsuit against us for an exclusive contract filed by the three members of TVXQ. Therefore, we have decided unfortunately to postpone the concert to a later date."

They also stated, "In this concert, it is especially important to show the fans the SM Family's unity through many joint performances. We do not feel we can give the fans the best performance we could in this sort of situation so we decided to postpone it."

SME also said, "We are extremely sorry to be giving this news, because this concert received a lot of love with the tickets being sold out as soon as they went on sale. This concert was designed with seats for families and handicapped people, and it was a place where friends could come together to share unforgettable memories. We are extremely saddened to be giving this news. We promise to bring a better performance in the future."

-[news] Unidentified Associates Causing Misunderstandings, "Don't believe rumors about conflicts between the members."

TVXQ expresses their rage over 'slandering people'

Sejong, the law firm representing YoungWoong Jaejoong, Xiah Junsu and Micky Yoochun, stated on the 6th that, "The people who are associated with the people in this case are causing a lot of misunderstandings. Throuhg these people, many rumors and slanders are coming out through the media and is distorting the case. A lot of unidentified associates are giving their opinions to the media regarding the case, but they all have a sliver of doubt in them." Sejong also stated, "An associate is only an associate, they are not TVXQ. There are no conflicts between the members. The members were extremely annoyed and displeased by these rumors."

It has been found out that the three members, through Sejong, have put a 'gag law' on their friends. They have all changed their phone numbers and have said they will not be releasing any more information for the time being. These decisions seemed to have been made because of the 'slip of the tongue' of their 'associates'.

The final straw to the members putting a 'gag law' on their friends and acquaintances was the rumors that there was conflict between the members. The three have continuously stated that there are no troubles in the members' relationships with each other. The only reason the rumor that there was a rift between the three members and the other two got out was because of these 'associates'. There was a rumor that after the concert in Thailand, the team split into two groups of '3:2' and acted separately. But this rumor was deemed false. Even when TVXQ left for Japan on the 5th for an event on the 6th, they traveled in one van as usual.

The rumor that the three members filed this lawsuit without telling the other two about it is also false. This time, 'associates' of the two who did not participate appeared. The 'associates' claimed that the three were filing this lawsuit for the cosmetic company and the other two were staying silent to stop a disbandment from happening. They even foretold the future an claimed that if the situation got worse, the two members would take the blame for this situation.

These are all claims that have not been confirmed and they may make the situation worse than it is right now. Sejong and SM have both stated that these 'associates' are unidentifiable. One representative said, "This process is a very sensitive process. The situation changes from moment to moment. The three members' decision to put a 'gag law' on their friends was unavoidable."

-[news] DBSK Changed Their Numbers

It was found that TVXQ's YoungWoong Jaejoong, MIcky Yoochun and Xiah Junsu, who are currently in a dispute with their agency SM Entertainment, have all changed their phone numbers.

One person who knows TVXQ said, "I called them to give them some support because I knew they were having a hard time with this situation, but their numbers had changed," and "I think they changed their numbers because right now is a very sensitive period for them."

The dispute between the three members and their agency continues and acquaintances and close friends are all choosing their words very carefully. Xiah Junsu's father, whom Newsen met recently, said, "I feel very frustrated right now but I have nothing to tell you."

It seems that since this issue is very sensitive and complicated, any word or phrase said will probably be twisted and misunderstood.

It is not only the three members who are watching what they say. Their agency SM Entertainment is also holding back on this lawsuit. Both sides can be seen watching the issue closely and carefully preparing for what is to come.

On a side note, TVXQ restarted their activities by perfo그ing on the 6th in the Meiji Jingu Fireworks Summer Event held in Tokyo. TVXQ left for Japan a day before on the 5th. Hundreds of fans flocked to Kimpo airport to get a glimpse of them.

TVXQ are planning to release a new single in September and will be performing in the SM Town Live 09 concert on the 16th this month in Seoul Jamsil Olympic Stadium.

A lot of attention has been on TVXQ ever since they filed the lawsuit as they five members continue to move together as a group.

On the 3rd, the three members of TVXQ who filed the lawsuit, Xiah Junsu, Micky Yoochun and YoungWoong Jaejoong, released their official statement that the exclusive contract they had with their agency was unlawful and they did not wish for a disbandment of the group. During the afternoon of the 3rd, SM Entertainment released a rebuttal stating that TVXQ was emphasizing too much on one aspect and that the agency had paid TVXQ 11 billion Won till now.

-[news] SMTown live in August 16 POSTPONED

Due to lawsuit from TVXQ SM Entertainment (SM)’s SM Concert was postponed.

On August 7th, SM representative said, “SMTOWN LIVE’09 which will be held August 16 at the Seoul Jamsil Olympic Stadium will be temporarily postponed,” he said. For the sake of quality of performance, since there’s still TVXQ dispositition running against SM, the current time is not a good environtment to make decision regarding the concert, thus it need to be temporarily postponed.

“We’re really sorry to tell you the unfortunate news.” SM representative closed his statement.

-[news] Japan's Say on TVXQ's Lawsuit, Japan supports Tohoshinki

- note: this is a fan's observation -

Entertainment news I had watched in Japan:

On "Akko ni Omakase" TV program, they did not take much time to go over the details, but Akko said, "It took time for them to be known here in Japan and also their Japanese had improved really well..." which sounded like she was sorry for the members.

On "Sukkiri" TV, they covered both sides of the story (but at that time, the three members' lawyer's comment had not been released). However, they did not say anything bad which could cause a negative image for TVXQ.

For "Miyaneya," they mentioned the three members' lawyer's comment.
There seemed to be a Japanese lawyer on that TV show who said that the members request would have been fulfilled if it was in Japan, but he said that he is not sure about the case in Korea.

He also talked about the side business (cosmetic business) and said that even in Japan, there are many stars who do side businesses, so it should not be the problem. They sounded like that they were on TVXQ's side more than SM's.

Mr. Miyane also said that "TVXQ's members are hardworking young men who are all really pure individuals. I do not know if I should say that, but the members sure are that kind of people."

On "Sukkiri," Terry Ito and Mifune were there. Mifune said that the members are "real gentlemen." They also mentioned "For fans, TVXQ is TVXQ when there are five of them."

Their comments were in favor of TVXQ which show the result of the effort, hard work and politeness of TVXQ while they worked in Japan.

I wrote this since I thought that there will be many fans in Korea who are worried about how it (the lawsuit) is broadcast in Japan.

-[trans] Jaejoong's Twitter Update is FAKE

The post on Twitter written by YoungWoong Jaejoong, regarding the current situation between SM Entertainment and three members of TVXQ, Xiah Junsu, Micky Yoochun and YoungWoong Jaejoong, was indeed written by YoungWoong Jaejoong himself, not an imposter.

YoungWoong Jaejoong's representative told Money Today Star News on the 4th that, "It was YoungWoong Jaejoong who wrote the post on Twitter," and "YoungWoong Jaejoong himself confirmed that he was the one who had written the post."

Through Twitter, YoungWoong Jaejoong posted something along the lines of, "Many fans are concerned that TVXQ is going through a rough patch," and "But TVXQ will go on as it always has. Please keep watching us. We love your support."

This is the first time Jaejoong has made a statement himself, without passing the message through his representatives. But there was a scandal that the person who wrote the message was not YoungWoong Jaejoong, but a hardcore fan impersonating him.

TVXQ's Xiah Junsu, YoungWoong Jaejoong and Micky Yoochun, who filed for a suspension of their exclusive contract against agency SM Entertainment, released their official statement on the 3rd which stated that, "The members do not wish for TVXQ to disband."

-[news] TVXQ's Agency, SM's President Lee Sooman's New Venture, Lee Sooman takes on the Wine business

Amidst the chaos that has erupted over TVXQ's lawsuit, it has been found that Lee Sooman, president of TVXQ's agency SM Entertainment, will be tackling the wine business.

Bloomburg, that gives reports on the US economy, stated on its website on August 3rd that, "President Lee Sooman, who is also a talented manager who has produced famous Korean singers such as BoA, Girl's Generation, TVXQ and Super Junior, will be investing in a project aimed at developing a wine that will please Asian palates."

President Lee, who is well-known for his love for wine, was found to have signed a contract in June with Crushpad, a company located in San Francisco, USA, to develop a '2009 Bordeaux' wine.

The wine President Lee aims to release will be 3 barrels (75 boxes) of wine, with each bottle selling at $33 (40,000 Won) and the name of the wine will be 'Amos'. Lee Sooman is planning on selling Amos wine to famous celebrities or manufacturers across China, Korea and Japan.

-[news] Wrong Information In News Articles

This was written by a member of DNBN.
This post has been praised by many fans as the best summary of wrong information being used by reporters.

Since this lawsuit is such a 'hot topic', the sheer number of articles that are coming out is massive.
It is difficult for even fans to go through every single article,
so most people will base their opinions on this topic from reading a couple of articles.

There is a lot of wrong information in these articles,
I write this to clear up a couple of errors.

However, since there is a vast amount of articles coming out even as I write,
it is impossible to address every single article or issue.
Therefore, I cannot say that I have addressed all of the issues that need correction.
But I will tell you of a couple that I have found to be important.

Even if I use parts of some reporters' articles,
does not mean that I am intending to criticize them, I'm saying this in advance.
I have no intention of criticizing or attacking the reporters who wrote the articles I am using.

1. TVXQ's solo activities=Disbandment of the Group?
There are a lot of articles regarding the solo activities of the members.
They point out that the two who aren't participating in this lawsuit are going into acting,
and there are so many unclear statements made by "representatives of the side", rather than the actual person.

There have even been articles where they have stated,
"Other than the two other members, the three members who have filed this lawsuit did not have plans for solo activities which adds more speculation to this case."

However, according to the news on Donga.com on July 30th,
the members who have filed this lawsuit also had solo activities planned.

------------------------------------------
YoungWoong Jaejoong and Micky Yoochun will take on the Japanese market as a duet by the name of 'Jejung and Yuchun from TVXQ.' The two revealed their duet song at the Tokyo Dome performance in early July. The song, 'COLORS ~Melody&Harmony~' will be released as a single in September and the two members are planning to attend tv programs to promote the song. This song has been getting a lot of attention as it was chosen as the theme song for 'Hello Kitty''s 35th Anniversary.

Xiah Junsu is still considering his choices such as a solo album. A representative of SM stated, "Xiah Junsu was actually the first to embark on solo activities when he appeared in the 2007 mobile phone commercial 'Anyband'," and "He will choose between the Korean and Japanese stage and is currently decided what he will do. His activities will be revealed soon.
------------------------------------------

According to this article, SM already had solo activities for all five members lined up for the second half of the year.
The Japanese Unit activity 'Jejung and Yuchun from TVXQ' already had a jacket cover and was running quite smoothly.
Also, a SM representative gave testimony that member Xiah Junsu was also planning a solo activity.
We just aren't sure what will happen now, but that doesn't mean there wasn't anything reported about it before.

2. TVXQ's Vacation period Scandal
According to the official statement put out by the three members,
"Kim Junsu, Kim Jaejoon and Park Yoochun have been going back and forth Korea, Japan and China ever since their debut in 2004 and have been getting 3~4 hours of sleep per night, except for one week in a year, to complete their schedules."

SM's new statement refutes this statement by saying,
"Regarding the schedules, we have always compromised performances for their health."

One article said,
"After completing their Tokyo Dome concert on the 5th, the members returned to Korea for approximately a month-long unannounced vacation."

It is incredibly hard to know the exact length of the vacation and the health of the members, but the article that states that TVXQ's break went as long as a month is wrong.
It can be seen that the truth regarding pre-announced vacations is closer to the members' official statement than SM's.

It was reported that the members received a vacation after their Tokyo Dome concert,
but the actual length of the vacation can be seen as 7~10 days, not one month.

If information from July 15th is seen, it can be seen that TVXQ's vacation officially started on the 13th.
SPORT HANKOOKI.com article

However, according to an E-daily article on July 23rd,
"U-Know Yunho, who has been busy going from TVXQ's Japan Tour to the 'MIROTIC' Asia Tour Concert, returned to his home last week to rest, but is currently in Japan."

This means that TVXQ's vacation went from the 13th to the 23rd, at the most. Which would mean that they only had ten days of rest.

There are other articles regarding TVXQ's vacation periods in 2007, 2008, and 2009.
But as the reported vacation periods differ slightly from actual vacation periods as the one above differs,
I won't put them up, but you can easily predict that the vacation periods were about the same as the one above.

3. After TVXQ's debut, SM was in a deficit for 4 years

According to an article reported yesterday,
"TVXQ has received 11 billion Won till now and have also been given luxury foreign cars. On the other hand, SM was in a deficit for four years after TVXQ's debut."
But, TVXQ's received amount of money and SM's deficit do not have a lot in common.

As TVXQ matured and grew, so did SM Entertainment.
Even if you search 'venture' in DNBN, you get these three articles.

SM Entertainment, Karaoke venture started...the agency's stars collaborate
SM Entertainment, Fashion Business venture started
SM Entertainment, Musical Business venture started

If you search this on various portal sites,
you will find that SM has been growing into and investing in many fields.

If you take that into consideration, you'll be able to conclude exactly
where the money the SM artistes are earning in Asia is actually going.
You will also be able to see that tying SM's deficit to TVXQ's salary is quite a stretch.

Also, in accordance to the statement put forth today,

the luxury imported cars were in fact registered under SM's name, not the members'. Sejong's side stated that, "It is true that the members received cars as presents from SM after an awards ceremony. However, they were all cars registered under SM's name, not the members' names. Therefore, they do not and did not belong to TVXQ."

Sports Seoul article

This article points out the numerous flaws in SM's statements so please use it as reference.

#4. The Cosmetic Company

SM has linked the cosmetic company with the lawsuit in both of their official statements.
This isn't something worth talking about, so I'll make it short.

Please check Sejong's official statement.

"SM keeps stating that the cosmetic company the three members invested in is the core of this lawsuit, but the investment the members made has nothing to do with this case. The cosmetic company SM keeps bringing up is a company that is planning on opening a branch in China and one that the three members decided to personally invest in, it has nothing to do with their work as celebrities. Think about it. Why would TVXQ give up everything they've worked for till now for 100 million Won they invested in a cosmetic compnay that is opening a branch in China? It is completely illogical. The core to this case is the unlawful exclusive contract, and SM is trying to divert the attention away from that by bringing up a cosmetic company that has no relevance whatsoever."

If you read this, you'll know that there is nothing scandalous about the cosmetic company.

However, if you stil have doubts, I'll put in a parody of this situation.

If a working man wants to hear himself be called CEO, Manager or Director,
he should just open a fried chicken shop near his house.
Then he will go from being a normal working man to a chicken billionaire.
Just invest 100 million Won in a chicken company and you too can become a chicken billionair opening branches in China.

It's like this kind of situation. I hope you get where I'm going with this.

5. Official Fan Club Cassiopeia

In many of the articles coming out these days, TVXQ's official fan club is mentioned a lot.
There have been claims that the representatives and leaders of Cassiopeia have been getting together.
These claims are all wrong but the articles about them just keep coming.

It seems the reporters know more than the actual fans do, but
There are no leaders or representatives for TVXQ's official fan club Cassiopeia
All the interviews with Cassiopeia's leader are false.
All the claims that the representatives of Cassiopeia got together to assemble a candle protest are false. Every single one of them.

TVXQ fans are coming together on fan site and fan cafes to discuss the situation at hand, but there are no official representatives or leaders in Cassiopeia.

These are just some of the errors I have found in articles.
The amount is small compared to the vast number of misleading articles.
But with these few, I hope that whatever is wrong is set right.

Oh, and last but not least.
This post does not reflect the opinions of all of the fans.
These are my thoughts on what I've read and the information I have seen so far,
this is not an official statement made by Cassiopeia

-[news] Jaejoong in a fake twitter ID SCANDAL

YoungWoong Jaejoong's Twitter has been caught in a fake identity scandal.

When the continuance of TVXQ was questioned after YoungWoong Jaejoong, Xiah Junsu and Micky Yoochun, through the firm Sejong, released their official statement regarding the unlawful contract with SM, and SM released a rebuttal back, YoungWoong Jaejoong wrote on his Twitter page that afternoon stating that, "TVXQ will go on as it always has." But some TVXQ fans are stating that, "YoungWoong Jaejoong's Twitter does not belong to him but it belongs to a fan using a fake identity."

The fans who gave this statement said, "YoungWoong Jaejoong's Twitter is fake. The Korean fans already know this and see this as a problem. It is probably a hardcore fan who is using a fake identity." They also said, "It seems that the person wrote 'TVXQ will go on as it always has,' because they were worried about the continuance of the team."

Another fan added that, "YoungWoong Jaejoong must be going through so much emotional pain right now. How on earth would he be sitting in front of a computer typing this?" and agreed that a person must be using a fake identity. To register on Twitter, one only needs to give one's name and username. One's real name does not need to be used and there have been a lot of controversies about fake celebrity identities. Other fake identities were found to be impersonating Son Dambi and Huh Kyungyoung.

On a side note, TVXQ's fan club Cassiopeia has put forth a petition entitled 'Against TVXQ's disbandment' and till now (August 4th, morning) the petition has gotten over 19,600 signatures.

-[trans] TVXQ's Concert Phenomenon in China

On the 2nd of October, Korea's popular group TVXQ will be having their 3rd Asia Tour Concert 'MIROTIC' in Shanghai at the Hongkou Football Stadium once again. Although there are still two more months and the tickets have been on sale for only a week, most of the tickets have already been sold. Because of the astonishing speed at which the tickets were purchased even in the same venue shortly before, Mayday (a popular Chinese band) will have a hard time catching up with them. Many fans who weren't able to get tickets from the ticketing company are even willing to buy them online for about 3000-5000 yuan (USD438-731), which is about four times the original price.

The organizers also said that no more tickets are being sold at the moment. They also found out that in the past, other fanclubs would buy concert tickets for TVXQ's concerts, but they would not turn up in the end, leaving the front rows empty. The organizers said that they cannot stop this from happening and they are unable to judge who the people doing the "joy-buying" are. However, they remind fans to be rational and to not be used by others.

TVXQ's ticket sales exceeded the organizer's expectation and the China tour has caused the ticket sales to rise – Nanjing concert tickets managed to exceed 10 million within 3 days and the Beijing concert tickets were sold out in a week. However, Shanghai's concert stands out the most as the tickets were sold out in an amazing speed.

Recently, fans are not able to get tickets through official ticketing companies; they managed to find a lot being sold online at very high prices. This has caused many fans to be doubtful of the tickets being sold on the internet. One fan said that even at last year's China concert during May where the venue was smaller than the current one, they were still able to get tickets.

Even one concert ticket is difficult to get. All other outlets selling the concert tickets will definitely be overcrowded. A reporter managed to contact the head of the ticketing office, and the head told the reporter that even before the tickets were made available for selling, some fanclub organizers were already requesting to buy the tickets in bulk. He then went on to explain to the reporter that buying tickets in bulk like this is very common in Korea as Koreans don’t really like to buy them on their own and they prefer to buy in huge bulks.

"TVXQ's most crucial link is the internet. Cassiopeians have created many fanclubs and between each fanclub, all the members share a very close relationship. Once there is news released on the internet, every Cassiopeian in the world will know of it immediately. Even when the concert tickets have not even begun selling, fanclub organizers will contact ticketing organizers to order tickets. Thus, the fanclubs have a very large power over the purchasing of tickets.”

Even if there is a very well-known and popular group, it is not possible for all the concert tickets to be sold out within two days. Does TVXQ really have that many fans? If each fan really had to buy tickets, then wouldn’t there be many fans buying online tickets which are much more expensive? One fan told the reporters, “Yes, because all fans know that we want to be close to them and be near them, therefore they will deliberately increase the price and hence, we are somehow forced into buying them at high prices.”

The number of TVXQ's fans is relatively stable, therefore, there can never be a concert with tickets left over. However, there are some very hardcore fans that are professional dealers and will never allow there to be one empty seat in the concert hall, thus, they will manipulate people into buying that last seat in order for the entire hall to be filled up. “Cassiopeans are all mainly young teenage girls who are rather emotional, thus, it is relatively easy for us to pay in order to be able to support our idols. However, we did not expect that this has led us to being manipulated by others.”

Tickets will definitely be very difficult to get for this Shanghai concert. The organizers expressed surprise and frustration, and they are reminding the fans to be calm and rational. They also persuade fans to always buys tickets through legal ways.

This is the rest of the post

-[trans] TVXQ's Fanclub Speaks up! "Show us the exact amount of TVXQ's income"

-NOTE- 11 billion WON is approximately 9 million US dollars. A quick calculation, the members each made approximately USD 360 000 since their debut according to SM Entertainment.

For comparison, the annual income for top Hollywood stars range from everything between USD 10 million to USD 200 million.-NOTE end-

The problem is not how much was given, but how the income was divided... And can only be solved if SM reveals TVXQ's exact income

Amidst the chaos that has ensued after TVXQ members YoungWoong Jaejoong, Micky Yoochun and Xiah Junsu filed a lawsuit against their agency, the rift between the two sides is getting deeper as SM Entertainment revealed it's rebuttal.

There is a lot of talk about SM's official statement and many are skeptical about SM's statement that the amount given to TVXQ was 'a substantial income division.'

On the 3rd, SM released that, "TVXQ, till now (July 2009), have received 11 billion Won (9.2 billion Won given during the activities+1.77 billion Won given beforehand) and have also been given luxury foreign cars (bonuses that don't have any connection to the contract)." SM also said that, "The other side has focused solely on album sales even though TVXQ receive their fair share through events, CFs and other performances."

However, since the exact amount of TVXQ's income till now has not been revealed by SME, SME's statement has been met with skepticism and doubt.

Fans stated, "Even if SM did give TVXQ 11 billion Won, that is still less than 400 million Won per person each year," and "It is not plausible to say that this is enough when the group's immense popularity or influence is calculated," to show their reluctance to accept SM's statement.

In fact,TVXQ's album sales started off with their debut single 'HUG' selling around 195K copies and after eight singles and four albums, they have sold a total of 2,68 million copies in Korea alone.

In Japan, they have released 27 singles and four albums and sold a total of 2.34 million copies. According to the Japanese Record Committee, eight albums, 'Summer Dream', 'T', 'Beautiful You/Thousand Year Love Song', 'Why Did I come to like you? (Doushite)', 'Spell-MIROTIC-', 'Survivor', 'Bolero', and 'Share the World' have received the Gold Ranking (100K or more) and 'The Secret Code' has received the Platinum Ranking (250K or more).

Even when China, Thailand and Hong Kong is not considered, TVXQ has sold more than 5 million copies in Korea and Japan alone. Oricon Magazine, the official album chart for Japan, stated that in the first half of this year, TVXQ took eighth place in total album sales that earned them a total of 2.5 billion Yen (approximately 33 billion Won).

TVXQ's concerts also boast the best ticketing power and the income their live concerts bring in is probably a massive amount. Around 390K people attended TVXQ's Asia Tours, 530K attended their Japanese Tours and 120K attended their showcases. In their concerts alone, they attracted over 1 million fans around the world.

One fan wrote on their blog, "The most recent concert was their Japan Tour that ended at the Tokyo Dome which attracted 300K people. Even when using the average seat cost of 8000 yen (1 yen=1300 Won), that is still 2.4 billion Yen, in Won that would be 31.2 billion Won."

They also stated, "This is only taking the ticket fee into consideration. When you add up all the souvenirs sold during the concert and add this to the ticket cost, they must have earned at least 50 billion won."

After the Tokyo Dome concert, many Japanese news agencies estimated that, "If you add up all the money TVXQ earns in China, Southern Eastern countries, Korea, etc, TVXQ must earn around 100 billion Won every year."

There are other sources of income such as musical income sources of streaming, background music for homepages, downloads and ringtones, and commercials, performances, DVDs and photobooks, as well as a cartoon character venture, the amount that TVXQ has earned till now is almost out of this world. That is why SM's statement regarding money has become an issue.

In reference to SM's statement that "From their debut till now, we have paid TVXQ 11 billion Won," many fans are saying that, "It's not about the actual amount of money given to them, but the percentage of total income given to them," and "SM is putting forth a large number of 11 billion Won to make it look like they have been giving the members proper treatment pay-wise."

Fans also stated, "If the agency is so convinced that they are being fair and just, why is it that they aren't revealing the exact income of TVXQ? There are too many unclear parts in this contract that even the members did not know the contents of." They also criticized SM Entertainment by stating, "Because of SM's poor attempts at making TVXQ the scapegoat, more questions are arising and they are causing confusion."

-[news] TVXQ's Fanclub Speaks up! "The group's continued existence is more important than SM"

Folks, STAY STRONG, STAY TOGETHER, STAY LOYAL TO TVXQ AND LET'S PUSH THIS THROUGH!

As TVXQ, the group with the largest fan club in Korea, got into a legal dispute with SM Entertainment, the fans could be heard voicing their opinions that, "The group's continued existence is more important than SM."

TVXQ's fan club Cassiopeia, who hold the Guiness World Record for the largest fan club with around 800K members, began an 'Against TVXQ's Disbandment' petition on an Internet portal site. This petition that aims to collect 200K signatures has already collected 20K in the past four days.

The majority of the fans are on the side of 'TVXQ's three members' rather than the side of 'SM.'

Xiah Junsu, YoungWoong Jaejoong and Micky Yoochun stated that an 'unlawful exclusive contract' was the main reason behind their lawsuit and said they wanted to fix their 13-year contract, dubbed a 'for life contract'. The fans are completely behind this statement and say that if the contract is fixed, TVXQ will be able to overcome this disbandment crisis.

On various forums on portal sites and petitions, the fans have written, "SM must fix the slave contract they have imposed on TVXQ," and have been trying as hard as they can to make sure that the worst-case scenario will not happen.

The well-formed international fan base is also behind TVXQ. On one Chinese portal site, a survey revealed that around 52.1% (around 4000 people) of fans were behind TVXQ. The group's Japanese fan club 'Bigeast' members have been having a comment relay in which they all state that a disbandment cannot happen.

On the other hand, as time passes by, the rift between the statements of SM and TVXQ seems to grow deeper and deeper.

TVXQ stated on the 3rd that, "Our 13-year contract really means a 'for life contract' and because of the compensation we would have to pay, it is impossible for us to cancel the contract," and ""We are not trying to disband TVXQ with this lawsuit."

SM, on the other hand, stated, "This lawsuit occurred because of the cosmetic company the three members are investing in. And TVXQ has till now earned 11 billion Won in cash."

-[trans] BSK Shock: 'Insiders vs. Fans'- Two different views

Youngwoong Jaejoong, Micky YooChun, and Xiah Junsu, members of popular group DBSK has filed a provisional disposition to free themselves from their contract with SM. This case has many insiders and fans curious to what will happen.
DBSK is an idol group popular not only in Korea but in all of Asia. DBSK has continued to show their outstanding relationship with SM. The three members have thanked Lee Soo Man, the president of SM, multiple times when they received awards.
There are two very different opinions looking onto this situation, ‘The DBSK affairs.’ The 2 opinions are from producers and from fans.

On July 31st, the three members filed a provisional disposition to stop the effects of their contract with SM. DBSK fans immediately responded that this was SM’s fault. These assertions became stronger when the three members revealed official reports. The 3 members used expressions such as ’13 years contract,’ ‘album sales 0.4%-1% earnings division,’ ‘SM’s tools for profit’ in order to express their wishes to get away from SM’s restraint. In response, the complaints by the fans increased. Some fans even posted the situation when HOT disbanded in 2001 to criticize SM.

However, most of the staffs in the music industry are presenting very different opinions.
A high-ranking staff in an entertainment company refuted the assertions made by the 3 members, stating that these actions were too haste and is an act of betrayal to SM.
This staff stated on the 4th, opened with his opinion about the 13 years contract. “For people who are not in the entertainment industry, they will say that a 13 years contract is a slave contract. But it is because they don’t know the realities of the entertainment business.”

He stated, “the group DBSK that made its debut in 2004 is in this position because they were extremely successful for their 5 years after debut. If they were not able to attract the attentions of the fans, they would have been thankful that SM would be in charge of them for 13 years. The 3 members of DBSK must have not been 100% sure about their future success, so they probably agreed to sign for 13 years as a way of insurance.”
He also stated, “SM stated on the 3rd that DBSK was paid 11 billion won for the last 5 years in addition to foreign cars as bonus. Following this, DBSK were not ill-treated. There is probably not one SM staff who gets paid 100 million won every year for taking part into making DBSK a great success.

On the other hand in the midst of all this, DBSK fans and the majority of the music industry agree that they are against DBSK disbandment. DBSK is a big influence to not only Korean teenagers but is an important part of the Korean Wave.

Therefore, it is important that the 3 members of DBSK and SM settle their differences. Because SM holds some rights for DBSK as a team, continuation of DBSK will be difficult unless the 3 members reconcile their differences with SM. In addition to this problem, the two other members of DBSK, have not participated in the current lawsuit, and have expressed that they would stay with SM.
This situation requires SM and DBSK’s 3 members to make wise decisions in order to have a ‘win-win’ situation, considering many aspects.

-[trans] "The DBSK Situation, the truth and distortion. (Interview of acquaintance)"

The future of idol group DBSK is uncertain. DBSK's 3 members (Micky YooChun, Xiah Junsu, Youngwoong Jaejoong) and SM's trouble is too deep. Although they state that there will be no disbandment, in reality, disbandment is more than likely. Even if they avoid the worst case scenario, disbandment, it feels like their departure of SM is set.

On the third, a acquaintance of the 3 members said, "settlement with SM has been tried multiple times. But their differences couldn't be settled. The reason this went to court is because they couldn't find a point to settle." Thus, they concluded that more attempts for negotiations was useless.

The acquaintance that the reporter met is someone who has watched over DBSK very closely. He has experienced all ups and downs since debut until now. According to him, DBSK advocated for only one thing. They wanted conditions of the contract to be eased. However, it has gotten to a point where the conversations between the two parties have gone nowhere.

He stated, "they asked for the contract term and earnings distribution to be revised because everyone could tell it was irrational. They attempted to negotiate until the end but they felt that SM was avoiding them. Therefore, things got emotional for both parties and the 3 members are even more angry with SM's response."

"The truth about the 3 things that SM distorted."

After the initial reports about this incident, SM sent documents on the 1st and the 3rd. On the first, they reported that this problem was due to the makeup company investment and they will work it out. After the contract conditions were reported, they responded that members were paid 11 billion Won and were given foreign cars as presents.

In response to this, he stated, "the nature of this instance is the unfair contract, not the make up company. However, SM has not mentioned the contract conditions and have continued to use make up company issues to play with the media."

Additionally, he discussed about the 11 billion Won. He said, "let's say SM is right and that they were paid 11 billion won for the 6 years of work. This is the pre-tax profit. After taxes were paid, and this amount is divided by 6 years, and 5 members, this is less than 200 million won per member. For the first half of this year, the profits from album sales in Japan is 2.5 billion Yen (33 billion won). However, DBSK doesn't even receive 200 million won per year."

The total number of albums released in and outside of Korea is 48. Out of these, including singles and full albums, 1.96 million copies were sold in Korea. In Japan for 4 full albums and 27 singles, 8 of those sold over 100,000 copies, and one sold over 250,000 copies. Including south-east Asia, at least 4 million albums were sold.

He also criticized abnormal methods of calculating methods. According to him, "SM requested money for back dancers and food. Basically, almost all of the expenses were paid for by DBSK." He added, "besides this, SM created a local subsidiary and divided the earnings of DBSK into pieces. For example, SM Japan and Avex divided earnings, and this was also divided with Korean SM. With complex divisions, the money for the members were reduced.

Also, he stated that the foreign cars were given to them under the company's name. "They received cars from SM after an award ceremony. However, the cars were registered in SM's name and is not owned by DBSK."

"The three members are as tired as they can get."

According to this acquaintance, the three members of DBSK are tired of SM's play with the press. They have no intention to solve this with mere words, and are extremely upset that SM is exaggerating only one side of the story, distorting the truth. He said, "they expected SM to twist words with the press but didn't realize it would be to this extent. If SM continues this method, I think it would be nearly impossible to work together with SM again. I suspect that they will part with SM and try to find a different solution to settle this.

Their departure from SM does not bean the disbandment of DBSK. He asserts that there is no problems in relationships between all the members. They are still like family and agree that in any situations, they must work together. He said, "Truthfully, all five had the same intentions. But in the process of negotiations, there was differences between the members. That is why only 3 members decided to fight with their company. They all agree that the contract conditions are irrational, it is just that their way of handling it is different."

"DBSK will continue even after departure with SM"

Micky YooChun, Xiah Junsu, Youngwoong Jaejoong's will is stronger than ever. The acquittance reported that, "the 3 members are showing stronger wills than before debut. The three members are determined to stick together no matter what hardships come their way."

They are also determined to get back together as 5 members under the name DBSK. He revealed, "even if the 3 members leave SM through lawsuit, this only means departure from SM. This does NOT mean the disbandment of DBSK. It may be after the 2 remaining members leave, or if they perform from 2 different companies; the 5 want to continue with DBSK."

Well then, if 3 members leave SM, would they still be able to use the name 'DBSK.' Upon researching in the Industrial Property Office, the group name 'DBSK' is not registered. SM registered for DBSK trademark in 2004 but was denied. In other words, SM does NOT have the right to the name 'DBSK.'

According to a 'Mansung' Patent Law Firm Office, the patent attorney Hwang Sung Pil said, "Dong Bang means East and one cannot assert exclusive right to use it. Most likely, this was probably the reason why the application was denied 2004. SM cannot assert any trademark rights to the name. If the 5 members are together even away from SM, they will have no problems using the name."

More than anything, DBSK feels extremely sorry to their fans. This is why they want to go through with performances that were already scheduled. The acquaintance reported, "if they lose the lawsuit, they may have to pay an extreme amount of money for penalty. More than that, they are going through hard times thinking that they will have to be away from their fans while the lawsuit is in process."

-[trans] Another SM Official Statement

TVXQ's agency SM Entertainment has put forth another official statement to refute the one given by YoungWoong Jaejoong, Micky Yoochun and Xiah Junsu's side today.

SM sent their statement to various reporters at 8 o'clock on August 3rd and the content was full of points that refuted what Sejong had stated.

SM began off by responding to Sejong's statement that there was a clause in the contract that stated that unless TVXQ sold 500K copies, they would not receive a single Won from the album sales. SME stated, "TVXQ has received, from when they debuted till now, a total of 11 billion Won (9.2 billion won given during the time + 1.77 billion won given beforehand) , luxury foreign cars (bonuses with no relevance to the contract). In contrast, SM Entertainment was in a deficit for four years after TVXQ's debut. The opposition (Sejong) has disregarded the fact that income divisions from CFs, events, and other income sources differs depending on the overall economic situation. They are only focusing on one bad side of this contract instead of looking at it as a whole."

On Sejong's statements about the 13-year 'lifetime contracts,' SM stated that, "The Fair Trade Committee's seven year contract urge does not apply to singers. Also, it states that for singers who are working overseas, there is no limit to how long the contract can be. "

SM stated that, "We have been through five changes already in the contract with the members of TVXQ. And of those two, the clause regarding compensation if TVXQ were to cancel the contract was revised by the Fair Trade Committee," and "The other three times concerned the divisions of income and the first revision was January 2004 when they debuted. The next two times were in February of 2007 and 2009."

Also, in regard to Sejong's statement that, "We (Sejong) have tried numerous times to talk with SME about a compromise," SME stated, "They have only started asking for a suspension of their exclusive contract after the three members sent us a certification of contents through the firm Sejong in June 2009."

In reference to the members' statements that they were only sleeping 3~4 hours per day which resulted in bad health, SM said, "We have always compromised schedules for their health." And in regards to the cosmetic company, which Sejong stated was not the main cause of this lawsuit, SM stated, "This (the cosmetic company) is the real reason why they filed this lawsuit. This statement can be solidified by the fact that only the three members who have ties to the cosmetic company are filing the lawsuit."

Regarding TVXQ's future, SM said, "We would like to solve this problem quickly with the three members who filed this lawsuit."

-[news] TVXQ to Stick Together Despite Legal Dispute

The Korea Times has released an English article describing the legal stance on the current battle between TVXQ! members Jaejoong, Micky, and Junsu and the SM Company:

"Three members of the pop group TVXQ ― Micky, Xiah and Hero ― said Monday that their recent legal action against their agency did not signal the disbanding of the group and they, along with members Max and U-Know, will keep their promise to fans to stick together.

In a legal document released through the law firm Kim & Shin, the three stated that their 13 year exclusive contract with SM Entertainment was no different from a binding lifelong contract. They also said that they were not treated fairly by the agency in terms of profit distribution.

The press release explained that they have been carrying out a vigorous schedule ever since their debut in 2004, flying between Japan, China and Korea with only three to four hours to sleep everyday.

``(They) have had health problems and finally reached their physical limits, but SM Entertainment continued to send them abroad and plan excessive activities. Thus, the three members have started to hope they will be able to continue their careers as they wish, instead of being used as tools for the agency's profits,'' the statement read.

It also said that the provisional disposition had nothing to do with the members' private business endeavors in the makeup industry, and was focused on the unfair contract.

``The contract period spans 13 years, and including military services, this can add up to almost 15 years. This is basically until we retire from the entertainment business. The contract also states that if we cancel the contract, even under agreement, we will have to pay several trillion won in penalties,'' the statement said.

The members were given 0.4 to 1 percent of total album sales following a revision of the contract in February. The initial contract stated that the members would be awarded 10 million won each if the previous album sold more than 500,000. If the albums were sold fewer than 500,000, the members would not receive anything.

The statement added that the three members tried to communicate with SM Entertainment, but the agency continually brought up the issue of their makeup business and avoided further settlements.

``SM Entertainment's attitude made them realize there was no hope in solving the situation through communication, and the members finally decided to take legal action to further settle the case.''

The members concluded the statement with a comment to their fans, saying that they ``were sorry for surprising and disappointing their fans.''

Micky, Xiah and Hero stirred fans and the industry by submitting the application for provisional disposition to terminate the validity of their contract to the Seoul Central District Court Friday.

SM Entertainment did not release a follow-up statement, but said that the band would continue performing and that it believed their career would continue."

As an author here, and an avid TVXQ! fan, I think that we need to stand strong for our boys! Fight the evil slave contracts that SM Entertainment has been enforcing on them for the past five years! Getting less than 1% of their own album sales is wrong, and only giving them 3-4 hours of sleep daily is inhumane! If TVXQ!, one of their highest-grossing acts is treated like this, imagine how much abuse the smaller groups like Super Junior and SHINee must take!
We need to support our artists, not the record labels and demand that they are treated fairly!
