Council of Europe votes to decriminalise abortion

Maltese delegation disgusted

Tough lobbying by a four-member Maltese parliamentary delegation failed to stop a pro-abortion resolution from being approved in the Council of Europe in Strasbourg yesterday.

The endorsement, which has no legal bearing on Malta or any other member state of the CoE, calls on member countries which, like Malta, still ban abortion to decriminalise it and make it available to all women who choose to terminate a pregnancy.

A total of 185 of the 318-member assembly cast their vote at the end of yesterday's three-and-a-half-hour-long debate, considered to be one of the longest in the assembly's history.

The resolution was adopted with 102 votes in favour, 69 against and 14 abstentions.

The three Maltese members with voting rights, Nationalist MPs Jeffrey Pullicino Orlando and Robert Arrigo and Labour MP Leo Brincat, voted against the resolution. The Maltese delegation also included Labour representative Joe Debono Grech.

Malta has three votes in the CoE parliamentary assembly, two for government MPs and one for an opposition MP.

Visibly disappointed, the members of the Maltese delegation told The Times immediately after the vote that the resolution does not do any good to the image of the assembly.

"I am totally disgusted, not only by the way the vote went but also by the poor level of the debate," the leader of the Maltese delegation, Dr Pullicino Orlando, said.

"Over the past days we all lobbied hard with members of our different political groups to try to convince everyone that abortion is also about the rights of the unborn child and not only those of women.

"We tried our best but, evidently, this was not enough as we are a small delegation. The vote shows that the pro-choice lobby was more organised than the pro-life one," he said.

The majority of member states of the CoE already allow some form of abortion, and this was evidently reflected in the debate and the final vote.

From the 47 member states of the CoE, only Malta, Andorra, Poland and Ireland still completely ban abortion. A number of other member states have restrictive rules but still allow some form of abortion.

"The prevailing situation in Europe was reflected in the vote," Mr Brincat said.

"Personally, I thought that the vote in favour of abortion would be even larger when you consider the number of pro-abortion speeches made during the debate. However, we still managed to make our point clear that Malta will not in any way legalise abortion. We are in favour of the family and the rights of the unborn child," he insisted. If this resolution was to be taken seriously, we would not have been here today were it not for our parents' pro-life choice," Mr Arrigo pointed out.

"Today, the CoE tried to play God. We obviously can't do this as we are so small next to God. Who are we to decide to terminate a life?" he asked.

"We are pro-women, men and the unborn child. All three are in the equation, not only the mother," he said.

The resolution was moved by the assembly's Committee for Equal Opportunities for Women and Men following its preliminary adoption last month when Malta was in full electoral mode.

According to the resolution drafter, Austrian Socialist MP Gisela Wurm, the resolution aims to give women their rights.

In the opening of the debate, the Socialist rapporteur said that a ban on abortions does not result in fewer abortions but leads to clandestine abortions that are more traumatic and more dangerous. She called for all CoE member states to give this right to women.

The majority of the 28 speakers who took part in the debate spoke in favour of the resolution.

Swedish MP Carina Hagg described the situation where abortion is illegal as disrespect to women. She invited Maltese and Polish women to go to Sweden and have "a safe abortion" there.

The only MPs who spoke against the resolution were the Maltese, the Italian, the Irish and the Polish representatives.

In his address, Dr Pullicino Orlando called the resolution misleading and criticised the rapporteur for suggesting that abortion is a right.

"There is no European or international document speaking on the right of abortion," he stressed.

He also criticised the way in which the draft resolution was pushed through the CoE committee thanks to speakers and experts who had "a clear pro-choice approach".

"A society that destroys its young is condemning itself to oblivion," Dr Pullicino Orlando concluded.

Mr Brincat said Malta is unanimously against abortion. "The issue never featured and will never feature on our agenda.

"Our position is unequivocal and this is solely the result of our deep commitment in favour of the rights of the unborn child rather than the outcome of sheer political opportunism," he said.

This is the first time that the CoE called for the decriminalisation of abortion since Malta became a member of the assembly in the mid-1960s.

Malta has always vehemently opposed any imposition of abortion on its territory in all international fora including the CoE, the United Nations and the European Union, as it believes that this is something for an individual country to decide.

During its negotiations for EU accession, Malta also insisted on a special protocol inserted in the Treaty of Accession to make sure abortion in Malta remains illegal.

Gift of Life yesterday called on the government and the opposition to react to the vote taken to decriminalise abortion.

"In a shameful attack on our island as well as other European pro-life countries, the Council of Europe has voted to uphold this appalling resolution against human life.

"This is an attempt at imposing values that are incompatible with higher Maltese family values," Gift of Life said.

The NGO said it was deeply concerned at the long-term repercussions as the pressure now placed upon Malta in favour of abortion is now greater than it has ever been.

It expected Malta to respond with the same determination and absolute resolve in favour of human life as the movements in favour of abortion have done against life at the Council of Europe.

NOTE: It is not true what the Maltese politicians said, because in Malta there are thousands of Maltese persons, especially women that support abortion rights. The problem is that publicity is only given to those who are against abortion and so the Maltese media is biased and does not report fairly the news of what is happening in Malta. All those who are in favour of decriminalising abortion like Dr. Emmy Bezzina and Dr. John Zammit are totally boycotted. We saw the debate directly by internet and we thank all the Parliamentarians of the Council of Europe who spoke and voted in favour of the resolution. Perhaps the Council of Europe should send a delegation to investigate what we are saying and interview at least the two persons mentioned and also members of the Malta Abortion Rights Movement. It is not fair to critisize ZIMBABWE and CHINA about TIBET when in Catholic Malta we have a dictatorship under the regime of the Catholic Church.

Asciak throws in the towel

Former MP Michael Asciak said he has no intention of contesting the Nationalist Party's by-elections since he feels he has no chance of being elected on the 11th district.

In a short statement, Dr Asciak said he would have only had a chance of election if either of two seats on the eighth district were vacated.Dr. Asciak from the Nationalist Party, is one of the most staunchiest anti-abortion politician in Malta and he with others from the Malta Labour Party lost their seat.The anti-abortion lobby had a big blow since last March 8 election and now it is more difficult for Paul Vincenti and his phantom 'Gift of Life' to strangulate Malta's Constitution.

Dr Asciak had obtained 564 first count votes on the eighth district and just 82 votes on the 11th.

Dr Gomperts' talk

I was walking down Republic Street the day after Rebecca Gomperts gave a talk about abortion at a Valletta hotel.

As many people (mostly women) know that I am connected to her visit to Malta, they approached me and told me that they would have like to attend the talk but decided against because they saw the hotel's main door blocked by several nuns, old men and women. Several of them were in employment with the government and did not wish to be exposed.

Rebecca Gomperts' speech

I refer to a letter by Tony Mifsud, coordinator of the Malta Unborn Child Movement, titled Incitement To Kill (April 16). Contrary to what Mr Mifsud alleged, the police were very proactive and even sought the advice of the Attorney General on the Rebecca Gomperts issue. Dr Gomperts did not commit any criminal offence in her speech while in Malta, last October.

Abortion should be legal and available – Council of Europe

The Council of Europe is calling on member states to decriminalise abortion, guarantee women’s effective exercise of their right to abortion, lift restrictions which hinder access to safe abortion, as well as adopt appropriate sexual and reproductive health strategies.
The Council of Europe’s Committee on Equal Opportunities published a draft resolution for the Parliamentary Assembly on Monday, wherein direct reference to Andorra and Malta is made with regard to the absence of abortion rights, arguing that such should be made legal due to the consideration “that a ban on abortion does not result in fewer abortions, but mainly leads to clandestine abortions, which are more traumatic and more dangerous.”
The report also points out that “in many of the states where abortion is legal, numerous conditions are imposed which restrict the effective access to safe abortions.”
The committee’s Socialist group representative Gisela Gurm, who penned the report, stated that: “the Assembly has never adopted a resolution or a recommendation on abortion as such… The Assembly’s position on abortion, as adopted so far, can be summarised as follows: In no case should abortion be promoted as a method of family planning. But in circumstances where abortion is not against the law, such abortion should be safe and accessible. When the pregnancy results from rape, women should be given the choice of having an abortion.”
The report mentions that abortion is legal in the vast majority of the Council of Europe member states. “Except in Andorra and Malta, the law permits abortion in order to save women’s life. Abortion on request is – in theory – available in all Council of Europe member states, except in Andorra, Malta, Ireland and Poland.”
In conclusion, the report said: “The lawfulness of abortion does not have an effect on a woman’s need for an abortion, but only on her access to a safe abortion.”
“The Parliamentary Assembly should also note that, in member states where abortion is legal, conditions are not always such to guarantee women effective access to this right: the lack of local health care facilities, the lack of doctors willing to carry out abortions, the repeated medical consultations required, the time allowed for changing one’s mind and the waiting time for the operation all have the potential to make access to abortion more difficult, or even impossible in practice.”
 

Informing the abortion debate

After the report of the Council of Europe to de-criminalise abortion, our local noble knights have re-emerged from their slumber to shut the doors and windows to any serious and objective discussion on the issue of abortion.

They are even telling us that 93 per cent of the population is against abortion. I do not know from where they got this percentage.

I was not asked whether I agree or not. I asked around, and it seems that no one else was asked whether he or she agreed (or not agreed) with abortion. They probably did a survey based on 100 individuals 93 of whom said "I do not agree".

Indeed if the survey's question was: "Do you agree that abortion should be legalised?" then I am not surprised with the high percentage.

I would rephrase the question into something like: "Do you think it is right to introduce the morning-after pill on the island?"; "Do you think that a woman who got raped should have the right to abortion?"; "Do you think that in a life and death situation for the woman, the pregnancy should be aborted?"; "Should it be intrinsically the woman's choice whether or not to have the baby?"

This question should be accompanied by: "How much are you informed on the issue of abortion?" and "Can you define an embryo?"

I believe that if these questions were to be asked, then the percentage would be different.

Gift of Life should realise that Malta is a European democracy and people have a right to voice their opinion. Gift of Life has repeatedly regaled the Maltese citizens with its own opinion countless times, it is now time to appreciate that GoL's opinion is not necessarily that of everybody, or even of the majority. We should also make sure that this abortion issue never ends up in the constitution, as that would surely set a very dangerous precedent of imposing the OPINION of a small group of people on the whole of Maltese society. There has never been any survey, referendum or whatever that proves overwhelming support for an anti-abortion law in the constitution.

These issues such as abortion, euthanasia and divorce, whether pro or anti, have no place in a document which defines the very essence of our country and of its people. We already have a non-secular constitution where our religion is defined.. this is already wrong, but granted that we are a Catholic nation and our culture is shaped by Catholicism. But it should stop there and we need to recognize the times we are living in now.

So please, Gift of Life, give us a break and stop pestering our politicians to amend the constitution for your own agenda. We already have strict (too strict) anti-abortion laws, isn't that enough? Couple that with the fact that is no serious pro-choice movement in this country.

We are discriminating against the women of our country if we do not allow them to at the very least to travel to other EU countries and undergo an abortion.

All EU citizens are free to avail themselves of any services legally offered in any member state. It is against the law to prevent a citizen from accessing legally offered services. Therefore since EU accession any Maltese woman has had the right to travel to any other member state where abortion is legal and have the procedure carried out. That is the law.

Woman tries to abort then rushes to hospital saving baby

In a fit of despair, a pregnant woman tried to abort the baby she was carrying but immediately realised the mistake, rushed to St Luke's Hospital and the child was saved.

The woman is now raising the baby as a single mother, assisted by her brother, Magistrate Saviour Demicoli heard.

The woman, who cannot be named by court order, pleaded guilty to charges of trying to cause an abortion on herself. She again pleaded guilty when warned by the court about the consequences of her admission.

Given her admission and the circumstances of the case, the court discharged the woman on condition she does not commit another crime within three years.

Police Inspector Louise Calleja, prosecuting, said this was a very unfortunate case. She said the woman, who had cooperated fully with the police and had a clean criminal record, was driven to despair by "domestic and personal" problems.

Lawyer Josè Herrera was defence counsel.

Malta became part of the Schengen Treaty now and this can bring more rights to the Maltese citizens.

The challenge was made by Dr. John Zammit personally to Mr. Paul Vincenti on Monday 26th February 2007 at the Centru Hidma Socjali, St. Venera during a meeting of NGOs in connection with the Malta Family Commission. Dr. John Zammit made a very progressive speech amongst most of the Diocesan NGOs like the Cana Movement, the Diocesan Commission and many Catholic fundamentalist organizations. Mr. Paul Vincenti was so afraid that he did not utter a word and since then he did not attend the other three conferences organized by the Malta Family Commission. 
 
On that occation Paul Vincenti admitted that what he said on Smash TV about John Zammit was with reference to John Zammit and not to the Spanish Doctor Josep Carbonell which was libelous and Dr. John Zammit who does not believe on Libels said that he was not going to take Paul Vincenti to Court. He also said that he believes in ways to find things that are good amongst us not that bring misunderstanding or hatred.

As the daughter of a Maltese citizen raised in Britain, I have to say I find the attitudes towards abortion in Malta absolutely insupportable.
 
I fully comprehend the religious principles that forbid abortion, however, to assert that women must be forced to give birth regardless of their own wishes, health risks, age, incidence of rape, poverty, and knowledge that the child will suffer a poor quality of life, is utterly barbaric.
 
I do not in any way condone abortion as a contraceptive device. I take it very seriously indeed and strongly believe that it is a difficult and unpleasant decision for anyone to make - but in certain circumstances it must certainly be acknowledged as a necessary decision.

I would like to draw your attention to the recent legal events in Ireland, in which a 17 girl was refused an abortion despite having a baby so severely disabled it would certainly not survive for more than three days after birth. To force this young girl to carry her baby to term would mean prolonged and unnecessary suffering for both mother and child, but thankfully, after taking her case to the High Court she was permitted to travel to England to terminate the pregnancy.

I would like to know how Malta can possibly justify its anti abortion stance on a medical level, when this is an issue clearly muddied by religious beliefs. And to what extent are the abortion laws supported by Malta's women, whose right to a decent standard of healthcare, not to mention welfare, is seriously compromised as a result?

The sorcerer’s apprentice witch hunting

Having encountered Tonio Borg face to face on Int X’Tahseb on the abortion issue, I have come to the conclusion that he really had no idea what he was about when he endorsed the proposal to amend the Constitution. He certainly appears completely surprised by the reaction of the liberal-minded, both pro-life and pro-choice, to his method of garnering consensus.
Evidently cut off from liberal thinking for many years, if ever he has been exposed to it at all, it comes as a shock to him that anybody should object to anything he may suggest which is anti-abortion. For him it just had to be a walkover. Nobody would dare point out that not a single abortion would be prevented, that it is a see-through political gimmick.
He is simply in another world from me. When my corner grocer slipped a petition form for me to sign apparently in favour of the entrenchment of the prohibition of abortion in the Constitution, he had no idea that I would refuse. He was shocked. I was infuriated and immensely frustrated that I was presented with such a thing when unable to explain my objection. I smiled and declined. I am anti-abortion but also anti-hypocrisy.
Many local councillors have been given similar options. Without debate or consideration of any kind they have been asked to come over to the Local Council offices to sign up. Their refusal would be seen to be a vote in favour of abortion. Sometimes a vote was taken in council. Nobody was allowed space for explanations or reservations. There had been no clear information campaign. Nobody explained how it came within the remit of local councils to pronounce themselves on such matters.
Had we been informed that our local councillors would be asked to decide in our name whether to support Dr Borg’s proposal or not we may have taken greater care in choosing them. Most of us were under the impression that they would be seeing to the proper administration of our localities and not amending the Constitution on a matter of such importance. Nor did we imagine that band club committees and the bocci club would ever get so far.
It is not hard to read into the whole concoction an attempt to garner a vast majority and also to pressure a small minority which Dr Michael Asciak suspects of diabolical hidden agendas. It is a witch-hunt for political purposes.
It is also an open attempt to bind the future. The proponents, in a remarkably patronising manner, assume that they have a right to impose their beliefs on a distant future which will no longer share them. It is an astonishing declaration of defeat of any hope of passing on the values of our society to the one we hope to generate.
The next question is why bother? In practice abortion has been with us a long time. We all know that those who opt for it travel abroad to obtain the service. Although the law provides no effective immunity to doctors, therapeutic abortion is freely available when doctors determine that it is necessary. The morning after pill is not available over the counter but it is obtainable. Making it illegal conveniently hides all possible statistics regarding its use. The amendment of the constitution was proposed by do-gooders and endorsed by political opportunists who know that it will make not the least bit of difference on the ground. Why expose our national hypocrisy in this way? Why clothe it in ersatz democracy by seeming to consult everybody and his dog without explaining the issue and without inviting anyone to vote on it in secret?
If Tonio Borg was as sanctimonious as he sounds about abortion he had the very simple option of amending Article 5 of the Criminal Code to make abortion a crime also when committed abroad. When I challenged him on this he had the cheek to reply by challenging me to make the proposal. He clearly admitted that he was well aware that there was a practical way of closing the door on abortions procured abroad. He could have Article 5 amended by simple majority just as it has been amended 5 times since 1990.
He will not for the very simple reason that it would make him go beyond the vacuity of pious declarations and drop him up to his armpits into a politico-religious morass. He prefers entrenching our hypocrisy in the constitution and carrying on regardless with our double standard. It is a perfect solution for a Nationalist politician: it sounds good but nothing difficult happens at all.
What Tonio Borg did not calculate in his rush to have the constitution amended was that he is likely to become the politician to have introduced abortion into our legislation. Nowhere in the world is abortion freely allowed. It exists in a very large number of countries as an exception or series of exceptions to the general principle of protection of the unborn.
So far Malta makes no exception at all and is listed in UN websites along with just Chile and El Salvador as a country where even the interruption of an ectopic pregnancy is technically an illegal abortion. With his proposal to entrench the criminal law provisions Dr Borg is likely to raise a hornets’ nest within the medical profession which may now seek legal advice and find that there is no legal safeguard for doctors who perform abortions needed to save the would-be mother’s life. Their code of practice is not a law. There is no such thing as the excuse of self-defence as Dr Borg claimed on television. Self-defence from a foetus? He must be joking.
Ironically it is Dr Borg who has broken the taboo on abortion and engaged the thin end of the wedge which is likely to have a completely contrary effect to what he claims he intended. The doctors will want their necessary exceptions legally enshrined before any entrenchment in the constitution. The debate on abortion has started on school and university benches.
The public is beginning to discuss the issue of a woman who is raped and becomes pregnant. Far away from television screens the question of whether it is a woman’s right to decide whether to bear a child or not is being debated. Until Dr Borg raised the issue it attracted very little attention.
Wherever abortion was legalised it was as an exception to the rule protecting the unborn. His proposal to freeze the present situation is likely to provoke a reaction in the contrary direction. One cannot set the present situation in stone because it is a very bad case of law conveniently ignored. Once it is to be entrenched in the constitution it will have to be spelt out. Dr Borg will have to begin to explain the exceptions to the general rule in detail. Far from preventing the introduction of abortion, he will have introduced it himself. Much to Dr Borg’s surprise he may get ticked off by the Archbishop before too long.
Shameless hypocrisy combined with mindless opportunism is a dangerous combination. Its bizarre effects are altogether unpredictable, perhaps the very opposite of what was said to be intended. One thing is sure: the exercise has exasperated thousands who see through the charade. The issue is not whether or not to entrench the crime of abortion but whether we can ever hope to have serious politics in this country. Medieval witch hunting cannot be stomached in the third millennium, not even in Malta. Ironically Tonio Borg has bound together a liberal alliance right across the abortion issue. It certainly was not what he had in mind when he set off on his crusade.

Fr Peter, you devil

Three weeks ago, this space challenged the Gift of Life (GoL) foundation to stop its insinuations or name and shame any politician it thinks might collude with the introduction of abortion in the next legislature. Instead of coming clean, GoL's CEO, Paul Vincenti, got dirty.

In this newspaper (April 23), he accused Fr Peter Serracino Inglott and myself of being "prepared to use just about any argument, no matter how incredulous (sic; he means incredible) this may be, to prevent the unborn child being given the right to life".

Mr Vincenti did not name anyone but he referred to "some self-styled intellectuals" who have recently argued that one (although only one) reason why there is no immediate need for the constitutional entrenchment of an explicit right to life for unborn human beings is that there is no serious political party or politician with abortion on the agenda for the next legislature. Mr Vincenti only produced a crude caricature of that summary but the two people who have recently articulated an argument that can be caricatured that way are Fr Peter and myself.

Fr Peter's intervention was the more prominent. His interview with Steve Mallia drew a dissenting reaction from Chief Justice Emeritus Giuseppe Mifsud Bonnici, and Fr Peter's letter in reply was cited in my own column. While Prof. Mifsud Bonnici expressed his strong disagreement with Fr Peter in the most civil terms (referring to him as a dear friend), Mr Vincenti wrote of a "mad scramble to derail" the entrenchment proposal, "to prevent the unborn child from being given the right to life".

That's right, folks: For Mr Vincenti, the former rector of the University of Malta is a self-styled intellectual, and the philosopher-priest who advises the conference of European bishops is in a frenzy to pave the way for the legalisation of abortion.

As for me, I have argued that entrenching now means we will write a bad law since we do not currently have the science to write a good one. Since abortion is not going to be legalised immediately, waiting may be better for "the aim of keeping Malta's anti-abortion laws and environment as strong as possible".

Lies, all lies - for Mr Vincenti. If I do not agree with his entrenchment proposal, I must secretly support abortion rights.

Why do I give any space to such nonsense? Aimed at Fr Peter, the smear is ridiculous. As for me, some of you will no doubt agree with my best friends that a spot of demonisation could finally make me seem interesting.

But such demonisation says something, first, about GoL's judgment. The urgency with which GoL is pushing the entrenchment is based on a sense of danger. But once its CEO can say, with a straight face, that Fr Peter is in a mad scramble to strip the unborn of the right to life, one needs to question anything GoL says about danger.

Second, the demonisation is part of a pattern. Last year, when Alfred Sant did not snap to attention as soon as GoL called for an immediate entrenchment, Mr Vincenti said that he found Dr Sant's stance worrying; then he back-pedalled, but the seed of doubt had been planted.

Then a shadow of darkness was cast over Parliament: Entrenchment is urgent, we were until recently told, because in a future legislature a small minority in Parliament might make the legalisation of abortion a condition for supporting the government (implying there might be a Prime Minister in waiting ready to give in to such a demand). I have shown why this is most improbable in the next legislature. Mr Vincenti now says it is irrelevant. So why did GoL raise the issue?

Having tried to cast doubt about the next legislature, Mr Vincenti now sees danger in the judiciary. He says we need urgently to remove any space for judicial interpretation of what the right to life means. The only time the Maltese courts have had to decide on the matter, the judge ruled that the Constitution does protect the unborn, but that is not enough for Mr Vincenti:

"The point, however, is that, as the law stands today, there is much room for interpretation, and when it comes to matters dealing with life, one cannot rely on interpretation."

Mr Vincenti claims entrenchment now "will ensure that this element of doubt is finally removed..." He is mistaken. There still will be room for interpretation - as attested by Prof. Mifsud Bonnici.

Remember that the former Chief Justice supports the entrenchment proposal. In a letter to this newspaper (April 16), he proposed the wording that could go into the Constitution to explicate the protection of life before birth:

"I agree that the proposed constitutional amendment should be formulated in such language as would determine precisely and concisely what is intended to protect. In my opinion the inclusion of the phrase 'from conception to natural death', inserted after the word 'life' in article 33 (1) of the Constitution would be enough. The phrase would qualify what is meant by 'life'."

Mr Vincenti supports the wording proposed by Prof. Mifsud Bonnici. However, Prof. Mifsud Bonnici recognises what Mr Vincenti does not:

"This (his proposed wording) would leave the interpretation as to when conception (or hominisation) begins in the hands of judges and scientists and this is all the judicial precision we can prudently require for an adequate protection of the right to life."

So room for interpretation is not, after all, removed. Unlike Mr Vincenti, Prof. Mifsud Bonnici appears to be happy that interpretation should be in the hands of the judges, in dialogue with scientists, should scientific discovery show "conception" to be ambiguous.

How much room for interpretation would that leave? For the earliest stages of human life, as much as there is now.

Such interpretation would be a more rigorous and formal version of the dialogue, on a recent edition of Xarabank, between Prof. Mifsud Bonnici himself and the Maltese doctor who performed the separation of the Gozitan Siamese "twins". Although the doctor believes that the "twins" were two persons, Prof. Mifsud Bonnici disagrees, on philosophical grounds; he agrees with Fr Peter (also present on the programme) that the "twins" were actually one person with several extra limbs. Prof. Mifsud Bonnici strongly disagrees with the British court that pronounced otherwise.

The very possibility for such radically differing interpretations horrifies Mr Vincenti. Can we imagine that, should the entrenchment proposal go through now, it would be enough for Mr Vincenti and friends? At that point, however, the law would be much more difficult to tighten even if scientific discovery makes it possible, since the law would need two-thirds of Parliament to change it, not a simple majority.

Once it dawns on GoL that interpretation is still possible, the politicisation of the judiciary will begin. Every member of, and every likely candidate for the Bench will be scrutinised for his or her credentials on abortion. Any affirmation (or silence) by a judge or candidate that is not completely to GoL's liking will be a warrant to attack the individual, as it has done with Fr Peter and myself.

Probably, liberals will reply in kind. If so, the American-style polarisation of Maltese public culture between fundamentalists and liberals will get into full swing, and the moderate centre will find it difficult to hold. Experience suggests it is an environment much more favourable to a liberal attitude to abortion. Do we really want to go down that path?

VALLETTA, Malta (di-ve news) -- May 31 2005 --1910 CEST -- In a press statement, the Malta Abortion Rights Support threatened that if the Government continues to insist in entrenching an anti-abortion Law in the Constitution of Malta, the group will begin a campaign around the world to boycott Malta both in tourism and trade.

"This is a warning to Dr. Tonio Borg and the Nationalist Government. We mean it and we are sorry if we will be pushed in doing it," the Malta Abortion Rights Support said.

The group said that instead, the Government should see that all the people living in Malta, including foreigners, are given their rights and freedom of choice and all co-operate and unite together to get out of the economic crisis the country is facing.

Furthermore, the Abortion Rights group feels that although the government said that it had signed a Protocol with the European Commission and the European Union for not interfering in Maltese Law by ordering the Malta Government to introduce Abortion in Malta, "the same Nationalist Government is trying to entrench an anti-Abortion Law in the Malta Constitution. So here they are admitting that the Protocol signed between them and the European Union is only a piece of paper that can go strait in the waste paper basket."

"We have always worked to help Malta both under Nationalist or Labour Governments, but and this is a warning again, if the Nationalist Government thinks that those in minority are nothing and be ignored we will take steps to show them what effect we can have by the international boycott," the Malta Abortion Rights Support warned.

Well Mazzola75, the outsiders might be right to say that the Government should not impose its agenda on the people without even consulting or let the women of Malta have a say in the whole thing.

As I have said in another post, the state should stay out of the bedrooms of Malta. A woman's body is hers only and she has every right to do with it as a free citizen in a democracy!:D

Unbearable afternoon July heat. A room in Valletta’s former red light district – Strait Street. A Spanish doctor, director of a clinic with a 100,000 abortion track record reveals the news of the day – he will offer free abortions in Spain to Maltese women who cannot afford to go abroad and pay for one. And for the poorest of them, he will even provide free flights.

Right opposite him, journalists lash out at him – “but do you care for the rights of the unborn?” Amongst them a representative of a pro-life organisation that is trying to make World history – entrench an anti-abortion clause in Malta’s Constitution.
 
The whole scene is almost surreal.

The Spanish doctor argues that he will never deny a woman the right to an honorable and safe abortion. “I know that by promoting abortion in Malta I am risking going to jail. But I am even ready to go to jail to give Maltese women this right”. His little kid, not more than 4 years old - is standing next to him hugging his knee. “You see, I love children too” the father and abortion surgeon smiles.

Threatened by EU
 
An infuriated anti abortion campaigner – member of the ‘Gift of Life’ organisation asks the Spanish doctor whether he knows that 91% of Maltese are against abortion. She insists that he is an atheist “and we should pray for him”. A few minutes later she tells maltastar.com “we still have a sight chance of avoiding the legalisation of abortion in Malta”. Why a “slight chance”, if you yourself claim that 91% of the public and the two main political parties are against abortion?” Because the EU will do its utmost to force it on us, the passionate woman exclaims. This is why she is campaigning to include the Maltese anti-abortion laws within our constitution.

The pro-life campaigner, Mary Hilda Camilleri, explains that Maltese European MPs are telling her that it is becoming every day more difficult to vote against abortion in Brussels and Strasbourg – “other countries laugh at us” the MEPs told her.

On holiday

But why is the Spanish doctor, Dr Josep Carbonell, in Malta? Doesn’t he have enough business in his “Mediterrania Medica” clinic authorised to perform abortions even on women in their fifth month of pregnancy? He explains that he is actually in Malta on holiday – at the same time he is doing an English course too. His press conference on Friday is part of campaign he is doing in European countries that have not yet legalised abortion – Portugal, Ireland, Poland and Malta. Rebecca Gomperts, the woman behind the controversial mobile abortion clinic aboard a ship – Women on Waves – could not join him for the press conference – maltastar.com learns that the woman is currently unavailable – she’s pregnant!
 
Dr Carbonell holds a copy of local newspaper ‘l-orizzont’’s front page of the same day. It reveals that 56 Maltese women sought abortion in the UK during 2005. His offer of free abortions, in a country where advertising abortion is a criminal offence, seems outrageous. But some of his arguments raise interesting questions.

5,000 illegal abortions yearly
 
Drawing upon Spanish statistics when abortion was still illegal, he estimates that in Malta there must be around 5,000 women who seek illegal and unsafe abortions every year. These self-induced abortions, performed with the most unlikely objects such as sharp instruments, are not only dangerous to the woman’s health, but can also lead to killing the woman. He claims that around the world, around 70,000 women die due to unsafe and illegal abortions.
 
“I am not in favour of abortion. I have my own kids. But if a woman asks me to stop her pregnancy, I will not deny it to her and let her seek dangerous alternatives that will put her in the risk of losing her life”.

The ‘Gift of Life’ spokesperson calls for an explanation – “from where did you get the 5,000 unsafe abortions figure?” He does not easily answer, as he does to most of the journalists’ questions – he barely understands the questions – “I excuse myself for my bad English. I am still learning.” he tells journalists after the conference.

But one question was never asked – does anyone know how many illegal and unsafe abortions are attempted by Maltese women in the secrecy of their homes? How can we prove Dr Carbonell’s 5,000 figure wrong?

Ms Camilleri asks him “don’t you appreciate the fact that your mother chose not to abort you?” The abortion practitioner replies “my mother had two abortions. It was she who chose not to abort me”. 

Abortions at 5 months pregnancy

maltastar.com asks Dr Carbonell about his clinic in Spain. There, abortion is allowed even when the fetus is five months old. He claims that most Spanish women today resort to abortion when they learn that their offspring will be born with a disability. Almost all women who know that their children will be born with Trisomy 21 – more commonly known as down syndrome – are aborting their pregnancy, he reveals. But most people with this condition still manage to lead a normal life, we react. “Yes, I know. But Spanish women do not want kids with that condition anymore”.

The ‘Gift of Life’ representative, Ms Camilleri, backs her argument using examples from her own family. “Two of my grandchildren were born with mental difficulties. We still accepted them and love them like all our kids. Today I took one of them to an art lesson – her skill is very promising. We all have defects – you and I have to wear glasses. If we start resorting to abortion, none of us would be permitted to live.” That is why the Spanish doctor’s press conference today worries her. Moreover, this doctor is not only offering abortion in cases of disabilities. That is already deplorable and violates the rights of the unborn child. He is offering abortion for all cases, and that is even worse, she insists.

 “Who am I to tell a baby ‘no, you will not be born now’? Who are we to determine who is born and who is not?”  

25% free abortions

But how is Dr Carbonell planning to materialise his free abortions offer? It is clear that his Friday announcement is still very far from becoming reality.

It all depends on whether I will find enough persons ready to work for me in Malta, he replies. In his clinic in Valencia, 25% of the abortions are made free of charge to persons who cannot afford to pay for it. And how will you fund the free abortions of Maltese women? “The abortion operations are not a problem. I will do that myself. If I do 10 abortions a day, it would cost me nothing to spend a few more hours at work and conduct another four or five without payment.” And what about the free flights? “We are still working on that. We would be ready to pay the flights of women who are in a really difficult financial situation. We cannot afford free flights to Spain for all women who seek abortion, but we can spare some of our funds for that…I do not know the exact number of free flights yet”.

And does he think that the Maltese women will respond to his offer? “At first it would be difficult due to the social and religious pressures. But the beginning is always difficult. “As time goes by, women will find it less difficult to seek their right to an abortion.”

Hell and Amsterdam

“You will all end in hell” the pro-life campaigner commented as she walks out at the end of the press conference. The local host of the press conference, John Zammit from Malta’s Alpha Liberal Party, was quick with a reply. “You are all cloistered people. All priests are getting old. Malta will soon end without clergy. And the younger generation will make Malta look like Amsterdam” he said as he put his hands in the air and boogied. 

All journalists slowly walked away, and Strait Street was in peace once again…   

 

The Malta Abortion Rights Group is uniting together to fight for democracy and free choice in the supposed free and democratic country of Malta a small island in the middle of the Mediterranean. At the moment the Nationalist Government after bringing a catastrophic financial situation to our country is trying to hide the terrible situation that we Maltese are in by alienating the people by pretending to be holier than the Pope and bringing in the Malta Constitution a Law that forbids Abortion.

others are afraid to talk publicly and we only saw BILLBOARDS and all news and Government propaganda for entrenchment but the against entrechment lobby was suppressed from the MEDIA. The Government spent thousands of Maltese Liri to send letters to NGOs and others to support him to entrench an anti abortion law but only a mere 4,300 supported Dr. Tonio Borg from the nearly 400,000 Maltese Citizens! So we can say that Tonio Borg's bomb burst in his hands. 

Fr. Dr. Mark Montebello 

(as published in the newspapers) is against that an anti-Abortion Law should be entrenched in the Malta Constitution. An e-mail received by us on Friday 20th May from Fr. Mark Montebello reads: "I would like to keep posted. I may not be in full agreement with abortion, but I certainly am in favour of a just and free society, with or without abortion, or anything else for the matter." signed: Mark.

We have received several e-mails even from other priests who said that they agree, not necessary with abortion but surely the law must not be entrenched in the Malta Constitution. They also said because they are in the priesthood they cannot speak out in the public and have to keep their mouth shut.

Meanwhile other persons are sending e-mails or phoning in support for this web site, especially progressive women, and single parents, people who suffered deaths of their children who committed suicide because they got pregnant and others.

Those who are against the entrenchment of an anti-abortion law in the Malta Constitution can e-mail to us. We know that many are afraid to show their name because they will be discriminated or vendicated (Catholic Malta is famous for this) but it is important to send your support at the e-mail addresses below. Also one can send his message by writing at GH.D.R. P.O. Box 129, Valletta CMR 01. (which is one of the associations of the group). All information will be kept confidentially under lock.

We appeal to Minister Dr. Tonio Borg not to persist in his endeavour to entrench an anti-abortion law in the Malta Constitution because he will  be responsible to victims of such family problems. The Government must help more those who find themselves in such situations not by sending them to prison but in trying to persuade them not to do abortion. If such people will be incriminated the consiquensies may be more grave and bring unexpected situations much worse like a women committing suicide while pregnant and so both the baby and mother will die. This by the way has happened in Malta for instance two years ago a fifteen year old girl who became pregnant committed suicide from Dingli Cliffs (and the authorities know about the case). So leave the people to think free according to their conscience not to what the Catholic Church says. Catholics are not obliged to commit abortion and those who are not Catholics are not obliging the Catholics to abort. Every one should be a true European citizen with all the rights other EU member countries have.

EU HOLDS SUCCESSFUL ABORTION HEARING

Event Heralded as a Triumph

A number of Members of the European Parliament (MEPs) heard about the state of abortion in various parts of Europe at a recent hearing at the European Parliament.

Participants included Dr Emmanuel D Bezzina, from Malta, who spoke about the social environment and the legal aspects relating to abortion in the republic of Malta. He will subsequently participate in radio and television broadcasts to talk about this pioneering event at the EU parliament complex and will provide articles about the event for an English language Maltese newspaper.

Delegates then heard witnesses` statements from Poland and Portugal, where five women spoke about their abortion experiences. The statements helped highlight the fundamental plight of women of child bearing age and the question of whether or not the European Union (EU) provided enough protection for the right of women to control their own bodies.

Observers felt the day was a triumph for organizations such as the International Planned Parenthood Federation.
