Brief Report: 

Remembrance of Deceased Residents - A minute's silence was held to commemorate all past residents of Mallerstang and, in particular Giles Thompson (formerly of Hanging Lunds) who died since our last March Meeting

Broadband

As residents will be all too aware, broadband provision in the dale is patchy, unreliable, and more like "non-so-narrow" than "broad".  Our Mallerstang representatives to relevant Broadband bodies( Ian Murray and Dave White) reported on some ideas and possibilities that have been discussed at local meetings on Rural Broadband Provision at the November 2011 Parish Meeting.

Archaeological Walk around Watter Yat,    Sunday, July 25th 2010

Annie Hamilton-Gibney led a hardy group of 30 people (plus 5 dogs) up hill and down dale, around Watter Yat - and through at least 5000 years of the history of Mallerstang. This was a fund-raising event for Upper Eden First Responders....    See below

LEAD MINE

An Extraordinary Meeting was held on Thursday 11th February 2010 

To discuss the proposed extension of the National Park to include Mallerstang.

After vigorous discussion, a range of opinions, of those attending the meeting, was gathered on various aspects of the proposal to extend the National Park - including its name, at present the Yorkshire Dales National Park, which would not recognise or respect the strong sense of identity of areas like Mallerstang (and the other proposed new areas which are in Cumbria or Lancashire). Opinions were divided on most of these matters, including the general principle: "Do you agree with the proposal to include Mallerstang in the National Park?" Of the 40 people present at the meeting, those entitled to vote agreed to differ. The result was:

WINDFARM PROPOSAL

A planning survey/investigation has been carried out for the building of a windfarm on the north-western flanks of Wild Boar Fell. The proposal is for building 14 turbines on land that is within Ravenstonedale parish but close to the border with Mallerstang. The turbines would be prominently obtrusive as viewed from Mallerstang, from Tommy Road and from Ravenstonedale. It is said that no further action is being taken (at present).

RAILWAY MASTS in MALLERSTANG

 

 

You may have seen reports in the summer of 2008 in various local and national papers about these visually intrusive masts and their accompanying ground equipment. You may also have had the misfortune to see the one at Aisgill (see photo below) - where Network Rail seems to have had no regard for its impact on the beautiful surroundings, the location of many iconic photographs.

 

Unfortunately our Local Authority, Eden District Council, was not as vigilant as the Yorkshire Dales National Park, which has been negotiating with Network Rail since 2002 in order to modify the design of the communications masts and the associated base units that will be constructed on the section of the Settle-Carlisle line that passes through the National Park. They are seeking to ensure that the masts are sighted sensitively, and that modifications are carried out to ensure that they blend into the surroundings as far as possible. But while these discussions were still in progress for the National Park area, Network Rail seemed to have rushed to build two masts in Mallerstang. The first of these is less than a mile beyond the present Yorkshire Dales National Park boundary - although if the proposed extension goes ahead, the whole of our dale will be included within the National Park in the fairly near future.

 

Neither Eden District Council nor Network Rail thought it necessary to inform - let alone to consult - local residents before this work commenced. We had no idea that these intrusive structures were going to be built until the first was completed at Aisgill in June 2008. Its impact on the scenery can be judged from the photograph. Note also the very conspicuous white base unit beside the mast - the size of a small barn.

Network Rail were intending to move on and start work in August 2008 on a second mast just above Shoregill. Their contractors did not, however, check whether the track to Ings End was a public right of way and that the house was derelict (as they claimed to think). In fact the house is certainly not derelict! The access track which they had intended to use is on private property - and the land owner of both refused them permission to move their equipment over this track. This gave a breathing space and an opportunity to engage in discussions before any further work was started. Since than the position and appearance of the second mast, and possible modifications of the mast and base unit at Aisgill, have been the subject of much correspondence and several meetings. 

We thank our Member of Parliament, the Rt Hon David Maclean MP, for his interest and assistance. We also thank Network Rail for attending several meetings with representatives of the Parish Meeting, to discuss these masts and other railway matters that impinge upon our dale.

 

We have stressed throughout that we fully recognise the need for upgrading of the railway communications system. (We had direct experience of this need when there was a fatal accident on this stretch of the line near Aisgill in January 1995).  We ask no more than that our dale should be treated in the same way as the neighbouring areas which happen to be within the present boundary of the National Park - countryside on that side of the boundary is no more beautiful, and has no greater need for protection, than Mallerstang. 

 

At the time of writing (September 2011) - two years later - discussions between Mallerstang Parish Meeting and Network Rail are still on-going, and we are still hoping for a satisfactory outcome.

The need for funding to keep things moving was discussed at the June Parish Meeting. It was agreed, in principle, that we would match the contributions being made by other parishes in the area.

About Mallerstang Parish Meeting

For postal purposes we are part of Kirkby Stephen, but we do not come within the area administered by Kirkby Stephen Town Council. Our Local Authority is Eden District Council, within Cumbria County Council.

"Parish Meetings" are the lowest tier of local government in communities which, like Mallerstang, have a separate identity but are too small to have a Town or Parish Council - we have an electorate of about 87.  (Parish Meetings are not connected with the church, which has its own system of Parochial Councils).

Eden District Council gives the following brief general information about Parish Meetings and Councils:

Parishes are the smallest areas of civil administration in England. Eden District is divided into 71 Parishes. They are administered by either parish councils or parish meetings.

Parish Councils
Parish Councils are required to hold at least four meetings each year which are open to the public, one of which must be an Annual Meeting of the full Council. Parish Councils have certain powers and responsibilities under statute including, for example, the maintenance of community buildings. They usually employ a Parish Clerk and/or other staff to carry out these duties.
They also have power to raise money (a 'precept') through the local Council Tax and have a duty to provide accounts.

Parish Meetings
Parish Meetings must assemble annually on some day between 1 March and 1 June and on one other occasion during the year. Their meetings are open to the public but only the registered electors for the Parish are permitted to speak and vote on any proposal. A Parish Meeting is not a corporate body and is therefore unable to own property or sue or be sued. Generally speaking it is not a local authority and its powers are not as wide as those of a Parish Council. 18 of the areas have Parish Meetings which consist of the local government electors for the Parish themselves.

Our Parish Meetings are held three times a year: in Spring, Summer and Autumn. All residents of the (civil) parish are eligible to attend, and can bring up any matters of local concern or interest for discussion Our powers are limited but we can - and do - make a difference. 

The Parish Officers are elected annually at the Spring meeting, (the Annual General Meeting). This is usually held in the last week of March (the Thursday as close as possible to the 25th).

At the November Meeting the annual budget and the Precept (the amount added to Council Tax specifically for Mallerstang purposes) are decided. 

The Consolidated Charities Committee* and other Charities reports are given at the June Meeting - and the Parish Accounts are also presented for approval at this meeting.   

* Mallerstang Consolidated Charities is a separate body. Its members are elected by the Parish Meeting for a fixed term (or co-opted by the Committee), and the Chairman of the Charities Committee reports in general terms to the Parish Meeting from time to time. But the Charities Committee is not directly answerable to the Parish Meeting, and its deliberations are confidential - particularly where individual awards are concerned. 

We also have shared representation with Nateby, on the Kirkby Stephen Charities committee. (Our current representative is Cllr Mrs Glenys Lumley, of Nateby Parish Meeting.)
