Things to keep in mind when purchasing a dog/puppy.

Before purchasing a puppy of any breed there are some things that you should look for in a quality breeder. Here is a brief summery of things to keep in mind when looking for a puppy.

The best kind of breeder
Choosing a reputable breeder is very important. Since it would be almost impossible for you to know what the puppy you are buying will grow up to be physically and emotionally, you must rely on your faith in the person from whom you are purchasing your puppy. There are three options open to you in choosing this person:

  1. PET SHOP or DEALER. The worst possible choice. The puppies are poorly bred and raised. They are thought of as merchandise to be sold for a high profit. The high profit results because little has been put into the breeding or the care of the puppies. Many are sickly. Pet shops rely heavily on impulse buying, which is no way to choose an addition to the family. These are the puppies that come from the dreaded "Puppy Mills" and should be avoided at ALL COSTS!
  2. BACKYARD BREEDER. Also a poor choice. This is the person who owns a pet Boston and thinks it would be "fun" to have puppies, that it would be a great experience for the children, or that the bitch "should be bred once before she is spayed." Even worse, perhaps it's being done just to make money. Usually this breeder knows little about the standard or history of the breed, and still less about proper care. The backyard breeder is not aware of breed problems, and doesn't care. This person's only goal is to produce puppies, and when the "fun" is over, to sell them quickly. Sometimes they just want to "show the kids" the facts of life. Well if that's the case then have another child YOURSELF! Don't breed your dog!

3.   SERIOUS HOBBY/SHOW BREEDER. The very best choice. The serious and dedicated hobby/show breeder regards his/her dogs as even more than a hobby, although the true fancier does not expect to make a profit. When someone is involved in dogs for the enjoyment of each individual animal, for participating in any of the many aspects of "dog sport," and for producing the finest animals possible, the results are SUPERIOR. The best breeders acknowledge responsibility for each and every puppy produced, and stand behind every dog they have bred. They do all the health testing which in the case of Bostons is BAER, CERF and Patella's at the LEAST, there are also other testing that can now be done, but the least is the 3 listed above.

Unequivocally, your choice should be from the ranks of the SERIOUS HOBBY/SHOW BREEDER. It is an interesting fact that poor quality puppies from pet shops and backyard breeders are often sold for the same price and sometimes even more than those purchased from the experienced hobby breeder.

So, how does one recognize the responsible breeder? Presented below is a list of requirements the breeder should meet before you consider purchasing a puppy. Don't be afraid to confront the breeder with these requirements. It is your right, and you can rest assured that the dedicated breeder will respond positively and with pride. They should not be put off by your questions and there ARE NO STUPID questions when it comes to your potential new family member. You wouldnt adopt a child without finding out what you could about its medical history and background so dont adopt a dog without it.

Memberships
The breeder should belong to the Boston Terrier Club of America, a local Boston Terrier club, or an all-breed club. Ideally he/she should belong to all three; however, sometimes this is not possible. The reason for this requirement is that this sort of participation indicates depth of involvement. This breeder is exposed to other points of view, learns more about the breed and modern breeding practices, and is kept up to date on AKC Rules and Regulations.

Showing
The breeder should be involved in showing his/her dogs in the breed ring, the obedience ring, agility or any other number dog sports. The reason for this requirement is that it means that the breeder is not working in a vacuum. The breeder who does not participate has no idea how good his/her dogs really are, and is deprived of the opportunity to share information and ideas with others. Showing provides the competition which encourages breeders to produce better dogs. The breeder who competes wants to prove how good his/her dogs are and is putting his/her breeding program on the line. This breeder is not relying on just a pedigree to indicate quality. Even if you do not want a competition animal, you deserve a companion that is the end result of a carefully planned litter; a puppy which received the same care as a potential champion. The breeder who competes in organized activities is known by others and has a reputation to uphold. This breeder will be as careful and honest in selling you your pet puppy as in selling show prospect.

Breeding environment
The breeder should be able to show you a clean environment; healthy, well-socialized puppies; and a dam with a good temperament.

You should avoid:

A) shy, whimpering, fearful puppies;

B) puppies with dull coats, crusty or running eyes, signs of diarrhea, rashes or sores on their abdomens;

C) signs of neglect, such as lack of water, pans of uneaten food, and dirty conditions;

D) a breeder who will sell a puppy under seven weeks of age, as early separation from the dam and litter mates can be very detrimental both psychologically and physically.  

Vet exams
The breeder should give you a period of time in which to allow you to have the puppy examined by a veterinarian to determine its state of health, so that both of you are assured as to the condition of the puppy at the time of sale. If a problem should arise, it can then be quickly resolved. This should all be written into the contract that you should get from the breeder when purchasing a quality puppy.

Contract
The breeder should provide some sort of written contract and/or conditions of sale. Any warranty of quality or health of the dog, and any warranty against development of hereditary problems or show-ring disqualifications in an animal intended for showing or breeding, should be in writing. The warranty should be absolutely explicit and a signed copy should be provided to each party. 

Health record
The breeder should provide you with a record of the dates and types of vaccinations and de-worming done, feeding instructions, a 3-to 5-generation pedigree, and a "blue slip" to apply for registration of the puppy in your own name with the American Kennel Club (AKC). Sometimes the "blue slips" are not available at the time you take your puppy home. If this is the case, have the breeder state on a dated, signed receipt of payment that the application will be sent to you as soon as possible. The registered names and AKC numbers of both parents, date of birth of the litter, and puppy's color and sex should be indicated. You can then contact AKC with complete information should there later be a problem with the papers. 

Dog care
The breeder should give you written instructions on feeding, training and care. 

Health history
The breeder should be able to show you proof that both the sire and dam of the litter have passed their BAER (hearing) test, and had their eyes examined (CERF tested)by a board-certified veterinary ophthalmologist within the last 12-18 months. In an ideal world the puppies will have already had these tests done as well but sometimes that is not possible. The breeder should also be willing to answer your questions about any other possible hereditary problems, including but not limited to seizures, hypothyroidism, luxating patellas and skin problems or allergies.   

Your interview
The breeder should ask you what kind of dogs you have had in the past, and what happened to them; whether or not you have a fenced yard; and whether or not the dog will be allowed to be a member of the family. Sincere breeders will be a bit hesitant to sell you a puppy until they know more about you, what you are looking for in a dog, and what "lifestyle" you have in mind for your dog. Having the best interest of the puppy at heart, reputable breeders will take great pains to place puppies properly the first time around. A returned puppy is a traumatic experience for all concerned, so the breeder who is always willing to accept a puppy back will try to make certain that a Boston is the breed for you.   

References
The breeder should be able to give you references: the names of people who have purchased puppies in the past, the names of other breeders, and the veterinarian who provides care for the breeder's dogs. You should also expect to provide the breeder with references for at least 2 people as well as the vet that you have been using for your pets.

Papers
Both pedigree and registration papers are provided by reputable breeders at NO extra charge. The practice of charging extra for "papers" is forbidden by the AKC, and should be reported. This should not be confused with withholding papers until the dog has been spayed or neutered, which is how puppies not purchased for showing/breeding are sold by many reputable breeders. 

Staying involved
The breeder should make it clear that his/her responsibility continues long after you have taken your puppy home, in fact as long as the dog is alive. Many dedicated breeders will ask that the dog be returned to them, or placed with new owners who meet their approval, if ever for any reason you are unable to keep the dog. They'll cheerfully be available for advice whenever needed, and can ease your way over many rough spots.

If your breeder meets all of these requirements you are in good hands. If you find yourself with a negative response to more than one or two of these requirements, think twice and discuss the situation with someone else.

Winter 09/10 litter

We are VERY excited to announce that Kali has finally came into season the second week in Dec. She will be bred soon with Matt. Pups should be due around Valentines Day.

2010 planned breedings

We have 2 breedings planned for 2010. Birdie will be bred to Matt and Hannah will be bred to a double Matt grandson. We are very excited about these upcoming breedings and look forward to some LOVELY additions!

There are 2 young male Bostons available in Southern Oregon. These 2 boys belong to a friend of mine name Dona Powers. She and her mother Evelyn Brand have Evidobee Boston Terriers. They are the breeders of Skye and Co-Breeders of Kali. They also own Hannah's father. This is male #1. A VERY lovely boy who can go to a pet or show potential home.

This male while having the nicer head, and flashier markings has a VERY soft temperment and would do best in a pet home. He is a bit on the shy side and would probably be better in a home with older kids or an adult home.

1.        This contract shall be deemed legally binding, and is under the jurisdiction of the state of Oregon.

 

2.       I, Lorene Jones, aka: Ta-Koda Boston Terriers (hereinafter designated as BREEDER guarantees this Boston Terrier puppy/dog to be healthy and free of disease upon receipt by BUYER.

 

3.       I, __________________________________________________  (hereinafter designated as BUYER agree to have the animal examined by a licensed veterinarian within five (5) days of receipt. If any health problems are found at this time, the dog may be returned to the BREEDER for a full refund, assuming the dog is in the same or better physical health than at time of transfer.

 

4.       GUARANTEE: If any genetic defect is discovered within the first year after birth of the dog, the BUYER has the option to either have one-third of purchase price refunded, or replace the dog with equal or better bloodlines at the BREEDERS discretion.  Replacement of the dog is based solely on return of this dog to the BREEDER.  Should the BUYER choose to keep said dog, then one-third purchase price refund, will be honored upon written proof of spay/neuter completion, and stipulations named on item #5. BREEDER is not responsible for: 1) contagious diseases, 2) any condition that is minor or easily corrected , or 3) any condition that it will outgrow. Patella's will be addressed on a case by case basis due to possibility of injury.


 

5.       To honor line item four (4), The BUYER must provide written documentation by two (2) licensed veterinarian's explaining in detail the specific evidence for the diagnosed genetic defect.  Any costs incurred as a result of physical examinations or testing is solely the responsibility of the BUYER.

 

6.       BUYER is purchasing a pet quality NON-BREEDING DOG.  As such, dog is to be spayed/neutered PRIOR to 6 months of age, and under no circumstances is to be bred.  BREEDER reserves the right to withhold AKC registration papers from BUYER until such time as proof of spay/neuter has been submitted to BREEDER. This dog is sold on a LIMITED REGISTRATION, and though it can participate in AKC agility events and other non-conformation events, any puppies produced by this dog will not be eligible for AKC registration.

 

7.       All veterinary costs incurred while dog is in possession of BUYER are the responsibility of BUYER.

 

8.      If the dog covered in this contract has been bred, produced/sired a litter either by choice or by “accident”, the resulting litter WILL NOT be eligible for AKC registration.  Any breeding of this dog either accidental or intentional shall require the BUYER to pay the breeder a fine of no less than $1000.00 per puppy. BUYER also acknowledges that breeding this dog is in direct violation of this contract, and accepts full responsibility for any legal fees or legal action that may arise from a breeding, up to and including surrendering the dog and all registration documents to BREEDER. 

 

9.       If the BUYER is unable to keep this dog for ANY REASON, AT ANYTIME, BUYER agrees to return it to BREEDER including all registration documents, and forgoes all rights to said dog, at which point BREEDER is not obligated to refund any or all of the purchase price. Buyer may be entitled to a partial refund based on dogs current value, to be determined by dogs age/sex/adaptability.

 

10.    The dog may not be sold, given away, placed in an Animal Shelter, or euthanize without notarized, written permission of BREEDER.  The exception to euthanasia would be in the case of severe injury or suffering on the part of the animal. The BREEDER must be contacted prior to placing, selling or giving away this dog. BREEDER has right to first refusal in all situations. Dog can only be placed with someone other then the BREEDER if SELLER has written and notarized permission from the breeder to do so.

 

11.    BUYER agrees to provide adequate fencing adjacent to and accessible from the BUYER'S home to ensure this dog's safety, and to provide adequate protection from excessive heat and cold, and refrain from chaining or tying the dog outdoors and/or leaving the dog outside for excessive periods of time.

 

12.    BUYER agrees to provide basic obedience training, socialization and adequate veterinary care.  Including annual checkups for heartworm/thyroid preventative and vaccines.  BUYER agrees to keep all immunizations current according to American Veterinary Medical Association guidelines; to properly administer heart worm & flea preventative (Breeder recommends Sentinel and Capstar); and to provide necessary medical treatment in the event of accident/injury to the dog. Buyer also agrees to provide the dog with a high quality dog food (Breeder recommends Eukanuba or Iams) and clean water at all times.

 

13.    BUYER agrees to pay Nine hundred fifty DOLLARS and puppy is to be picked up by BUYER at an agreed upon time and date.  Payment must be received in full by Lorene Jones  aka Ta-Koda Boston Terrier’s before dog is delivered unless other payment arrangements are agreed upon and noted in writing within this contract.   

 

-            Further contractual agreements:

-             - - a.  The "Ta-Koda" Kennel name will precede the name chosen by the BUYER.  BUYER may append his/her kennel name if sufficient spaces are left within AKC guidelines.   Call name may be chosen exclusively by the BUYER.

-            - - b.  All transportation expenses are the responsibility of the BUYER.

-            - - c.  BUYER is REQUIRED to forward the chosen AKC registered name of dog to BREEDER for proper record keeping.

14.  Adjustment Period: The puppy will need approximately 2 weeks to adjust to its new home, people, change of food, etc. It is not abnormal for the puppy to experience some mild vomiting and diarrhea, as a general rule this can be treated with a small dose of Pepto Bismal.


 

15. Buyer agrees to keep in touch with the BREEDER and send periodic updates as to the health and well being of the dog.

 

16.    If any of the specific above listed provisions for this dog are not met, the BREEDER has the responsibility to require relinquishment of the dog, and the BUYER has the responsibility to surrender it in a timely manner.

Here in after referred to as "Puppy" has been sold to Buyer by Seller as "Breed/Show prospect" for the amount of $1500. Breed/show prospect shall be understood to mean that no disqualifying faults as defined in the standard are evident at time of sale and further that no genetic disorders are immediately apparent. Puppy is being sold as a show prospect, but Buyer offers no guarantee that puppy will finish his Championship, only that the above is true in that the Puppy has no disqualifying faults at the time of sale. Buyer agrees to make a true effort to get the puppy his championship and show him in at least ___ number of shows per year.

 

1. Should Puppy develop any disqualifying faults as defined in the Standard, or be diagnosed with any genetically derived medical disorder which is confirmed by two unassociated veterinarians, thereby causing Buyer and Seller to agree that Puppy cannot ethically be bred, Seller will, upon provision of veterinary reports and, where applicable, Orthopedic Foundation for Animals  (OFA) report, or Canine Eye Registration Foundation (CERF) certification, provide Buyer with one of the following options.

 

a)         Should Buyer choose to keep Puppy and accept refund, Seller will refund 50% of purchase price ($750). Puppy must be spayed or neutered before refund check will be issued, and Buyer's veterinarian of choice must provide spay/neuter certificate to Seller.


b)         Should Buyer choose to relinquish ownership of Puppy to Seller, Seller will refund purchase price less any shipping or miscellaneous charges necessary for transportation of Puppy to Seller.


c)         Should Buyer choose to keep Puppy and accept a replacement breed quality puppy, Buyer must pay a reduced pet price ($750) and any shipping or miscellaneous charges associated with transport of replacement puppy. Upon receipt of spay/neuter certificate and Seller will provide a replacement breed quality
puppy as soon as such a puppy is available to Seller.

 

 

2.       Seller shall not be held responsible for the development of disqualifying faults, diseases, or disorders, which are due to Buyers abuse or negligence. Any transportation cost to get puppy from Seller to Buyer shall be the responsibility of the Buyer unless other wise agreed upon by both parties.

 

 

3.   Buyer agrees that Puppy shall not be used for breeding purposes until the following certifications have been passed:

 

a. BAER hearing test is reported with hearing in both ears.

 

b. The Canine Eye Registration Foundation (CERF) within 12 months of planned breeding.

 

c. That Patella’s are not rated higher than a Grade 2.

 

d. Puppy is guaranteed to be free from any discernible heart defects at the time of sale.

 

4.      Puppy will not be bred indiscriminately and will only be bred with dogs/bitches of a quality as such to improve the breed. No dog/bitch having more than 2 faults shall be bred with this puppy at any time.

 

HEALTH GUARANTEE

 

1.     Seller guarantees that Puppy is in good health and has received appropriate medical inoculations, worming and care. Seller will provide Buyer with a medical chart detailing treatment Puppy has received under Seller's care. Buyer agrees to continue to provide proper veterinary care including annual health exams and any immunizations the Buyers veterinarian deems necessary.

 

2.     Seller guarantees that Puppy is free of life threatening diseases or disabilities for 72 hours after delivery to Buyer. Should life threatening diseases or disabilities be discovered by Buyer within 72 hours after receipt of Puppy, and attested to in writing to Seller by Buyer's veterinarian, Seller will provide Buyer with a replacement breed quality puppy as soon as such a puppy is available to Seller, or refund 100% of purchase price ($1500).

 

3.    Buyer will have 72 hours to have the puppy seen by a veterinarian of their choice at their expense.

 

GENERAL

 

1.       Buyer agrees to allow Seller the right of first refusal should Buyer decide to place the puppy. Puppy shall not be placed in a new home or euthanize without notarized written consent from the Seller. The exception to the above would be severe suffering on the part of the dog.

 

            2. Seller will stay on the registration papers as Co-Owner of the puppy till such time as it receives its AKC championship or it reaches 3 years of age, which ever comes first.

 

            5. Buyer agrees to make the puppy (if male) available to Seller for Stud service at no charge, however transportation of bitches and/or collection of semen is totally the responsibility of the Seller.

 

4.  Should Buyer choose to break any of the above portions of this agreement, the remainder of the agreement will be considered null and void, and Seller will have the right to repossess Puppy, and/or to monitory damages in an amount not to exceed $5000.

 

             5. Should Seller break any of their portion of this agreement Buyer has the right to collect monitory damages in an amount not to exceed $5000, or the value of the Puppy.

 

6. Buyer and Seller agree that this Agreement will be governed by the laws of the State of Oregon as well as the State of __________ and may not be altered, modified or rescinded unless agreed to in writing by Buyer and Seller.
