*(IMPORTANT: Those owners with a Life Long dedication to the protection and safety of their dog and the APBT as a breed(s) and sound ethics,need have no concern or fear of this contract.)
*(IMPORTANT: This is however a very serious contract designed to protect primarly the puppy/dog, but also the breeder. We are placing our puppy/dog and our kennel name in the hands of you the proud new owners & the breed.(Our beloved breed is in danger from uncaring owners & unethical breeders)You want a puppy/dog to be of the best temperament, health, and conformation.)
1. The buy is to pay a minimum of a 300.00 NON-REFUNDABLE deposit on the puppy/dog. Should the buyer decide not to purchase the puppy the deposit can be rolled to another littter..
2. The puppy must be paid in full by the age of 7 weeks. The puppy must be picked up, unless being shipped at which they can not leave till they are of 8 weeks of age.. At 8 weeks of age, if you have not paid in full, you loose your deposit and the puppy is for sale again. For some reason if you have paid in full by 8 weeks of age and you have not picked up your puppy or made arragements to pick or have shipped, a 10.00 per day boarding fee will be charged. When pup has reached 12 weeks of age and you still have not picked up your pup, the puppy will be placed back up for sale.(Only money above the minimum deposit and the boarding fee will be returned. COMMUNICATION is IMPORTANT)
3. The Johnson's Kennel(or JK) name will stay on the puppy’s permanent registration(For life of said puppy). (Meaning we will give the puppy it’s permanent name)but the new owner(s) may give the puppy any call they desire.
4. This APBT is NOT to be used for or bred for any fighting purposes or any other Illegal activities. If Johnson’s Kennel suspects abuse, the puppy /dog will be confiscated and NO MONIES will be refunded and the proper authorities will be notified and charges filed..
5. Under NO Circumstances is the above puppy/dog to be SOLD or GIVEN to anyone without first contacting Johnson’s Kennel.(If Pup/Dog is sold or given away without consent from Johnson's Kennel their is a penalty of 5000.00 for said action). The first person offered the AST/APBT is to be Johnson’s Kennel. If interest in the APBT is denied by us Johnson’s Kennel, then the original buyer must inform the new buyer that they are bound by this same contract and their information given to breeder and another contract must be filled in by new buyer.(Shipping is the sole responsibility of the buyer. NO Exceptions)
6. Breeding of this APBT to a non registered dog will NOT be tolerated in any way. Any breeding to a non registered will be a VIOLATION of this contract, and will give Johnson’s Kennel the right to confiscate the dog and NO MONIES refunded to buyer.
7. Any males sold by Johnson’s Kennel, we reserve the right to use for stud services if we so choose. (NO stud fee will be charged to us, and the litter app must be signed). Males are to be at least 18 months of age and of a Champion title before studding out(only to UKC registered females is permitted )
8. Any females sold by Johnson’s Kennel may NOT be bred before their 3rd heat cycle, and for no reason will be bred more than 4 times. Must have at least a Champion title before being breed. If the buyer chooses to breed the female she MUST be SPAYED after 4 litters.. All females MUST/ WILL be given at least 1 heat cycle between litters to recover.(If any female sold by Johnson's Kennel is bred before her 3rd heat there will be a penalty of 3,000.00 per pup and a their is a 5,000.00 penalty for the breeding itself)
9. Buyer agrees to treat the dog humanely, give proper and prompt veterinary care, adequate food and water, proper shelter from the elements and plenty of exercise and love.. Johnson’s Kennel reserves the right to inspect the living conditions of the puppy/dog at any time. If upon inspection, the conditions are unsatisfactory, the breeder shall notify the owner of changes to be made IMMEDIATELY. If the condition goes on, the puppy/dog will be confiscated by JK and NO MONIES will be refunded to the buyer. At that time all rights to the dog will be relinquished back to the breeder.
10. At the time of delivery the described APBT above is free from any communicable disease and is in good health. It is the buyers responsibility to have the puppy/dog examined by a licensed vet within 7 days of receipt. If the puppy/dog is considered ill by 2 or more vets in WRITING, then a replacement pup/dog will be given at the breeders discretion. After 7 days, the communicable disease guarantee is void.
11. As the breeder of the above described APBT it is guarantied to be free of any life threatening genetic defects. If a life threatening hereditary health problem (which must be proven hereditary by a licensed vet) appears in like, JK shall be notified and the dog shall be returned to JK and replaced by a puppy from a different breeding when suitable by the breeder JK. Breeder is not responsible for health problems from negligence in regards to proper vaccines and proper vet care.
12. Buyer agrees to notify the seller JK of any address, phone number, and or email changes:
13. Buyer also agrees to provide pictures and updates to breeder at least once a month till said puppy turns 1 year of age, then yearly after....
14. *If this is a co-owner agreement, the party described as the buyer is responsible for a portion of the show entry fees, (amount of buyer responsibility will be decided on a individual basis)
Show Contract terms in applicable:
1. Buyer shall notify Johnson’s Kennel when the dog will begin showing.
2. The dog shall be shown at least 4 SHOW WEEKENDS a year till the dog achieves the Champion title in conformation(at least).
3. If the dog achieves said Champion title, showing will become the buyers discretion.
****If there is a breech of this contract at any time and court action results, all court costs and lawyer fees will be paid by the party described as the buyer*****
