Rendering A Person As Disbeliever, Beating, & Killing In Islam

Narrations, Fatwas, & Speeches

There is a perception or should I say that there are some (or mostly) people which they renders Shia religion as Disbeliever (or Rafideh). I will not go into the details that why they call them disbeliever (or nonbeliever) but I believe, they have less knowledge or perhaps none. The true scholars such as mentioned here always spread love and unity not hatred. Here you'll find some of the Narrations and Fatwas from well known and renowned Islamic scholars including Deoband, Hanafi, etc., with references from Sahih's, and other Hadith books (especially on cursing or slandering the Companions).


Narrated from Abu Bakr (r.a.):

Abu Barzah said: I was with AbuBakr. One person became angry at Him and uttered hot words. I said: Do you permit me, Caliph that I cut off his neck? These words of mine removed his anger; he stood and went in. He then sent for me and said: What did you say just now? I said: Permit me that I cut off his neck. He said: Would you do it if I ordered you? I said: Yes. He said: No, I swear by Allah, this is not all owed for any man after Muhammad (PBUH).

Narrated by Anas (r.a.):

It was said to the Prophet "Would that you see Abdullah bin Ubayy." So, the Prophet (PBUH) went to him, riding a donkey, and the Muslims accompanied him, walking on salty barren land. When the Prophet reached 'Abdullah bin Ubayy, the latter said, "Keep away from me! By Allah, the bad smell of your donkey has harmed me." On that Ansari man said to 'Abdullah', "By Allah! The smell of the donkey of Allah's Apostle is better than your smell." On that a man from 'Abdullah's tribe got angry for 'Abdullah's sake, and the two men abused each other which caused the friends of the two men to get angry, and the two groups started fighting with sticks, shoes and hands. We were informed that the following Divine Verse was revealed (in this concern) which is:
"And if two groups of Believers fall to fighting then, make peace between them." [Al-Kor'an 49:9]

Imam Ahmad bin Hambal narrated by Abu Huraira (r.a.):

A dispute took place between Khalid and Ammar bin Yassir and both of them abused each other. When they came to Rasool Allah (s.a.w), again both of them started abusing each other. Khalid said to Rasool Allah (s.a.w), "This slave is abusing me in front of you. By Allah, if you would not present here, he wouldn't have abused me." Rasool Allah (s.a.w) said, "O khalid, keep away (from abusing) Ammar. Anyone who shows enmity towards Ammar, Allah will show enmity to him."

Aisha (r.a.) reported:

Allah's Messenger, may Allah bless him, never beat anyone with his hand, neither a woman nor a servant, but only, in the case when he had been fighting in the cause of Allah.

Umar (r.a.) Ibne Abdul Aziz

One of his representatives from Kufa wrote him: Please advise me about a person, who abused Umar (r.a.) bin Al-Khattab. Should I kill him?
He replied him: It is not allowed to kill any person due to abusing any muslim, except in case of abusing Rasool Allah (s.a.w). Thus, if anyone abuses Nabi (s.a.w), then his blood is Mubah.

Abu Mas'ud al-Badri (r.a.) reported:

I was beating my slave with a whip when I heard a voice behind me: Understand, Abu Masud; but I did not recognize the voice due to intense anger. He (Abu Mas'ud) reported: As he came near me (I found) that he was the Messenger of Allah (PBUH) and he was saying: Bear in mind, Abu Mas'ud; bear in mind. Abu Mas'ud. He (Aba Maslad) said: threw the whip from my hand. Thereupon He (the Holy Prophet PBUH) said: Bear in mind, Abu Mas'ud; verily Allah has more dominance upon you than you have upon your slave. I (then) said: I would never beat my servant in future.

Imam Malik

"Anyone who abused Rasool Allah (s.a.w) can be killed. And anyone who abused Sahaba, he should be taught Adaab (respect)."

Imam Nawawi Al-Shafi

Imam Mohiyyuddin Al-Nawwawi Al-Shafi writes:
"There is a consensus of All Aima and Fuqha of Ahle-Sunnah that abusing Sahaba Karam is Haram, but the punishment for this is not killing."

Mulla Ali Al-Qari (Hanafi Fiqh)

"It is neither proved by Sahaba nor Tabi'een to kill a person or declare him kafir who insults Companions or Caliphs and neither Wajib-ul-Qatl."

Mufti Taqi Usmani (Deoband)

It was around the end of Rabiul Awwal 1427, Prince Ghazi bin Muhammad, the King of the Jordanian Hashimite Kingdom asked some questions regarding Takfeer (rendering a person as disbeliever). Mufti Sahab provided the answers in some details which has also published on the Internet and/or in a book.
"Whosoever is an adherent to one of the four Sunni schools (Mathahib) of Islamic jurisprudence and the Shi'a schools of Islamic jurisprudence, is a Muslim. Declaring that person an apostate is impossible and impermissible." Dated: 12/4/1427 AH

Imam Ahmad ibne Taymiyyah al-Damishqi (Hanbali Fiqh)

"And merely abusing some one other than the Prophets does not necessarily make the abuser Kafir; because some of those who were in the time of the Prophet (i.e. Companions) used to abuse one another and none of them was declared kafir because of this (practice); and (also) because it is not Wajib to have faith particularly in any of the Companions; therefore abusing any of them does not detract from the faith in Allah and His books and His messengers and the Last day."

Allama Ibn Hajar al-Makki al-Hathaimi (Shafi Fiqh)

"And I haven't found any opinion of any learned Alim that abusing a companion makes it obligatory to kill a person. And Ibne Mundhir says that I don't know even a single person who considers it to kill the one who abuses anyone except Rasool Allah (s.a.w)."

Maulana Rashid Ahmad Gangohi (Deoband)

He was asked a question if a person, who says "Mardood" and "Malaoon" to Sahaba, will go out of the pale of Ahle-Sunnah wa Al-Jammah due to this "Greater Sin" (Gunah-e-Kabira)?
His replied: "He will not go out of pale of Ahle Sunnah wa Al-Jammah due to this "Greater Sin".

Maulana Muhammad Rafique Athri

The most correct opinion is this that only that person can be killed who abuses Rasool Allah (s.a.w). A person asked Abu Bakr (r.a.) for his permission to kill another person who criticized Abu Bakr (r.a.). But Abu Bakr (r.a.) said: "No one has the right to kill anyone unjustly after Rasool Allah (s.a.w) only due to his criticism on him.

Maulana Muhammad Ibrahim Meer Sialkoti (Ahle-Hadith / Salafi)

Muhammad Ibrahim writes with Reference to "Sarim al-Maslool":
The punishment of abusing Rasool Allah (s.a.w) can be killing. But we cannot kill anyone on base of merely abusing any Amir-al-Momineen.

Malik Ghulam Ali (Jamaat-e-Islami)

"I say that the one who started cursing and abusing, and the one who started in answer to this, both of them started a very bad thing. And whoever does it today, he does a very bad thing. But neither this crime is equal to "Revolt", nor killing is it's punishment . Some of the Ulama of Salaf were convinced that punishment of abusing Rasool Allah (s.a.w) is killing, but except Rasool Allah (s.a.w) talking bad about others or abusing them never punished by killing in Islam.

Sheikh Akbar Mahmud Shaltut

Sheykh Mahmood Shaltooot was the head of al-Azhar University in Eygpt, one of the main centers of Sunni scholarship in the world announced the following on July 6, 1959:
"The Shia is a school of thought that is religiously correct to follow in worship as are other Sunni schools of thought."

Moulana Imran Nazar (Muslim)

He delivered this lecture on 19 July 2011 in Malaysia. He was asked the same question as it was asked before about the status of Shia in Islam. He said that Shia are Muslims and the fatwas (oldest or latest) coming out now that Shia are Kuffar is irrelevant. Another question was asked about his religion, he answered "I am a Muslim and I'm not the part of sectarian divide".

Molana Tariq Jameel, Pakistan (Hanafi / Deobandi)

In the audio speech, his stance is same as above: "No one becomes disbeliever or nonbeliever if a Muslim curse or slander any Companions".

Molvi Mohammad Ishaq, Pakistan (Sunni / Ahle Hadees)

He delivered this lecture on the topic of "Muslim Unity" in 2004, after his lecture (or speech) he was asked several questions, most of them relating to Shia religion, some of them were:
Is Shia are Muslims? Yes. Why their Kalma (Word Of Purity or Kalma Tayyab) is different than Sunni? There is nothing wrong in their Kalma. Why their prayers are different? They pray same as us. Why they pray 3 times a day? No, they pray 5 times a day but they combine two prayers as we combine it during Hajj (pilgrimage). See the below video for more details.

Conclusion:

If a person (especially Muslim) curse or slanders ANY Companions (Ashaab) than that person is ONLY responsible not the whole religion.

Whoever kills a believer intentionally - his recompense is Hell, wherein he will abide eternally, and Allah has become angry with him and has cursed him and has prepared for him a dreadful penalty and great punishment. [Al-Kor'an 4:93]

Whomsoever Allah desires to guide, He expands his chest to Islam (submission). Whomsoever He desires to lead astray, He makes his chest narrow, tight, as though he were climbing to heaven. As such Allah lays the scourge on the unbelievers. [Al-Kor'an 6:125]

Children of Adam (O people), when Messengers of your own come to narrate to you My verses, those who are cautious and mend their ways will have nothing to fear neither shall they be saddened but those who belie and grow proud against Our verses shall be the inhabitants of the Fire, and there they shall remain for ever. [Al-Kor'an 7:35-36]

Who made their religion an amusement and play, and who were beguiled by their worldly life.' On this Day We will forget them as they forgot the meeting of that Day; for they denied Our verses. [Al-Kor'an 7:51]

And if two factions among the believers fight, then make settlement between the two. But if one of them oppresses the other, then fight against the one that oppresses until it returns to the ordinance of Allah. And if it returns, then make settlement between them in justice and act justly. Indeed, Allah loves those who act justly. [Al-Kor'an 49:9]

Believers are indeed brothers, therefore make things right among your two brothers and fear Allah, so that you will be subject to mercy. [Al-Kor'an 49:10]

Those who came after them say, 'Forgive us our Lord, and forgive our brothers who were believers before us. Do not put in our hearts any spite towards those who believe. Lord, You are the Gentle, the Most Merciful.' [Al-Kor'an 59:10]

The Prophet (PBUH) said, "Some of my companions will come to me at my Lake Fount, and after I recognize them, they will then be taken away from me, whereupon I will say, 'My companions!' Then it will be said, 'You do not know what they innovated after you. (Sahih Muslim, part 10 & 15, page 53-54 & 64)


Note: Despite the above, still some scholars are against it (Click here to read more about mislead scholars) which they have neglected the Hadiths, the Holy Book of Islam and even these scholars. You'll not going to find any fatwa against alcoholic drinks, dances, etc., from those so-called invented scholars? They ordered Jihad (killing of another Muslim) to their followers (indeed they are brainwashed) but the scholar's loved one's are fully enjoying their lives (look around and see by yourself).

Only Allah Can Give Them Guidance As Well As Us.
