These are the terms for entering into a noncomercial commission with the artist Ishaway Friestad (the Artist). Please thoroughly read and review these before entering into an agreement with the Artist.
The Terms of Service are subject to alteration, additions, and editing without notice.
1) Displayed base prices are subject to change according to the complexity, difficulty, size and medium of each individual piece.
2) Clear and concise visual references and/or description no more than three (3) paragraphs of a commission idea must be provided by the Client. After which the Artist will provide a preliminary quote.
3) Payments $100 and under must be made up front in full before preliminary work begins. Payment plans are available for commissions above $100.
4) If the artwork is finished before final payment(s) are made, the Client will not receive the original paint/drawing or un-watermarked preview image of the commission until final payments are made.
5) Clients will have the opportunity to direct alterations of their commissions in the sketch stage. No more than two full sketch revisions (or equal in terms of small alterations) will be made unless the Client wishes to pay for extra sketch revisions (at $15 per full sketch)
6) If the Client wishes to cancel their commission during the sketch stage they will be refunded 20% of what the total image would have been.
7) If the Client wishes to cancel their commission during or after the coloring stage they will not be issued a refund.
8) In the event of a cancelation after inking/coloring has begun the Artist has the right to reused, edit, alter the image to recoup losses.
9) If the commissioner is unable to or refuses to pay the full payment when the art work is completed, if the total amount had not already been paid, the Artist may try to sell the original work to recoup losses. The Commissioner retains rights to characters depicted, but can take no legal action against the Artist for this.
10) The Artist will not discuss a commission with a client via public forum, or instant messenger. Communications about commissions between Client and Artist will be made only through (ishawayproductionstudios[at]yahoo.com) to ensure all information and communications are consolidated in one location.
11) The Artist reserves the right to cancel a commission due to poor communication, rude or inappropriate behavior, inability to communicate in effective English. In the event is no refund is issued due to time spent.
12) The Artist ensures the Client will receive email updates on commission when necessary. Clients are encouraged to check in when they feel it's necessary for updates, assurance or reminders. Public updates will also be made via Deviantart.com journal (Ishaway) and furaffinity.net journal (Ishaway).
13) The artist will not handle depiction of illegal activities and hateful images. Non-explicit fetish, violence, gore, and humorously offensive work will be considered on a case-by-case basis. The Artist reserves the right to reject any commission for any reason.
14) The Artist retains the right to display all commissioned work on any personal website, gallery, or journal. If the commissioned work is a time-sensitive gift the Artist may delay public showcase at the request of the Client.
15) The Artist retains ALL the rights to the commissioned artwork, including the right to make prints and merchandise. Rights can be negotiated for an added fee.
16) The Client may not make prints of the artwork, or profit from the artwork beyond the resale of a physical original painting or drawing (traditional media, not digital). The Client may resize or crop the artwork to create icons, wallpapers, or other graphics to be used in non-commercial digital format, but the Client cannot alter the artwork itself. The Client may also upload the artwork to their personal website or gallery, but credit is required.
17) The Artist may recycle sketches and preparatory works that were rejected by the Commissioner for other commissions or personal works.
18) The Client must read, understand and agree to all the above terms before entering into an agreement with the Artist.
By sending payment to the Artist, the Client agrees to the above terms.
