Thousands of people join an MLM business every
month, believing that this system is the way to wealth.
But is it as easy to earn money in MLM as many
MLM dealers promote it to be?
HERE ARE STATISTICS FROM RESEARCHERS:
* According to the annual reports of many MLM companies,
along with research done by numerous tax preparation services,
only 1- 2% of network marketers earn substantial incomes.
* Similar studies indicate that 97% of network marketers fail.
To be more specific, 97% of network marketers never reach a
positive cashflow in their business. Seeing as how that's kind of
the whole point, I would consider that failing.
* 70% of network marketers end up dropping out within 3 months
of joining an opportunity (some put the number as high as 80-90%).
WHAT IS LEGAL ? --
LAWS AND REGULATIONS SAY THAT BUSINESSES NEED A REAL PRODUCT, PUBLICATION, GADGET, OR SERVICE ...
....it is lawful if the company has a product or service to offer. It is legal and OK for a company to pay commissions, bonuses, awards, and to give promotions TO SALESPEOPLE (distributors) for their sales of products or services. Business should deliver what they advertise in good faith. There should be good value return for dollar spent. There must be a fair exchange of goods, services and materials for the dollar.
Plans or schemes which involve only the distribution of money---without the sales or exchange of products & services-----are illegal. Generally, these types of schemes are called "pyramids" because the money flows up to the top...and the only people profiting are the ones at the top (the owners or founders) of the program or company.
If a company promotes or advertises "potential income" for its distributors, participants, or members, it is lawful only to give a general account of actual average incomes. Unless the company can show concrete proof of people earning high incomes...and that others can do the same...the claims of the potential to earn should be very low key and based upon actual cases.
MULTI-LEVEL MARKETING:
The main income in an MLM should come from sales of the GOODS ... products and/or services. It is legal and OK for members or distributors to build a "sales group" and for the company to pay 'over-ride commissions' on that group's sales volume. It is OK for the company to offer bonuses on sales volume.

and is the main reason that Multi-Level Marketing can and has created millionaires.
WHAT IS ILLEGAL:
However, if any "networking" or MLM (sales) company extends their activities to such things as--- requiring extensive recruiting of new participants, charging hundreds (or thousands) of dollars for salespeople or members to attend "training workshops" ....charging distributors high sign-up fees, --- or pressuring (requiring) members/participants to PAY high fees for extra services (such as renting an office) , ....or to anything costly that is over and above the call of duty of the marketing the product....it will fall in the category of QUESTIONABLE...and perhaps illegal.
FOR EXAMPLE: If the promoters tell the distributors something like: "We require all distributors to attend a workshop--to "learn to be happier" --- which costs only $1500.--- NOTE: Such a requirement would be illegal...regardless of the topic of the workshop.
It is illegal for a company to claim that its members or distributors are "getting rich"---or to make promises to potential new recruits that they will "get rich."
THERE ARE SOME ' MLM ' Laws that govern these types of companies, however many promoters or "dealers" of these schemes do not obey or follow the law. The more you know about these regulations, the less vulnerable you will be.
The FEDERAL TRADE COMMISSION established the earliest MLM guidelines, in cases such as "FTC vs. Amway"--- which regulate illegal pyramids and other unlawful entrepreneurial chains. In that case and in Koscot Interplanetary Inc., (1975), the FTC was highly critical of ---

Millions
of Americans have lost money participating in pyramid schemes which are
also known as "endless chains" . While there are legitimate multi-level
or network marketing companies, many of them are illegal pyramids or
gifting clubs. They are often portrayed as business opportunities, and
victims who thought they were paying start up costs to buy a small
business of their own eventually find they have lost money or are
responsible for others losing money.
SCAM-ARTISTS are very savvy in using language that will –“create hope for achieving financial independence”--- and to “butter up” the potential new recruit, make them feel important, and get them to spend outrageous amounts of money on “hopes of getting rich…”
One of the MOST COMMON SCAMS is the letter from a needy party....
HERE IS AN EXAMPLE OF THE TYPE OF SCAM LETTER THAT IS SENT VIA EMAIL...
--- Begin Scam Email ---
I am [Name deleted], a sergeant in the American army, presently
in Iraq among peace keeping force (sic).
During the raid of the Saddam Hussein hide out, which was also
where he kept funds and valuables, I successfully smuggled out
a box containing $15.5 million, which I have moved out of Iraq
through a diplomatic channel.
The funds is (sic) presently in the custody of a securities and
finance company in Europe. I want to move finally to safe bank
account through a reliable person (sic).
If you are willing to assist me in the deal, urgently contact
me through this address for further details.

This letter scam started as the "Nigerian Scam"--- because
most of these letters came from Nigeria---at first. Now, the same
form is used with little alterations. This form of letter may
have variations as to where it comes from, who claims to be the
sender, or whatever. But it is just a new variant of the Nigerian
scam. Now they are coming from England, Zimbabwe, Hong Kong,
Afghanistan, and other countries.
Remember, it doesn't matter
what country they are supposedly from -- or who or why someone wants to
give you millions of dollars, or transfer money from a dead person's
account to your account -- it's a scam. The fact that it is
supposedly from someone in the US Army makes it no less of a
scam. The person who answers them will end up spending
money and sending money to the person who sent the letter.

THIS SCAM LETTER might also be expressed in another way--- e.g.-- in a meeting where the promoters are trying to convince people to invest in their "exciting ground floor opportunity." Whether written or verbal these types of scams consist of some 'schmoozing' (buttering the ego) of the potential new recruits--- telling people that they " ....are special, dependable, referred by the Government ...trustworthy, classy, higher class...etc.--and that is why they were selected to participate." They may say things such as: "If you get in right away...we will assure that you are at the top and you profit more than others who come in later...."
ANOTHER RIP-OFF comes in the form of "CONTESTS" --
Letters and emails are sent out to potential victims informing them that they have won THOUSANDS or MILLIONS of dollars in some contest or lottery.
THE CATCH ? -- They ask that you first pay them lots of money in order to collect your winnings. In most cases, the victim has never entered any such contest, or purchased a lottery ticket from them. They may say you have to pay: processing fees, services charges, international taxes, or similar. YOU PAY and they will go away ! They will disappear with your money.
THIS IS NOTHING BUT A SCAM AND RIP-OFF.
Again-- the presenter, situation, claims, promises, product, or service may be different, but nevertheless it is a scam. There is no real BUSINESS PLAN. The only "plan" is a GAME PLAN...to scam you out of your money !
Even if they offer a product, it is probably nothing unique. In some of these "schemes"--the company will offer a product and want you to help sell it. Generally, if it is a scam--- they will pay small commissions and work your butt off, while the owners (managers, founders---or whatever title they have given themselves) reap MOST of the MONEY that comes in via "sign up fees" or other income. CHECK THE MATH...who is getting most of the money the soonest ??? That will tell you a lot about the deal.
One way or another --- IF IT IS A SCAM ---they are going to take your money, put you to work, and give you the short end of the stick-- using emotional appeal to your own need, greed, or vanity.
HOME BASED BUSINESSES:
Put your wallet on lock-down ---and
WATCH OUT....
...* If the cost to 'sign up' or join is high and does not include products. Some of these scams earn money by simply charging high fees for distributors (or participants) to join. If the distributor is "unsuccessful"-- that is too bad for the participant---BUT the company already made tons of money via sign up fees.
...* If distributors are REQUIRED or PRESSURED to pay for 'expensive training sessions' or to travel to attend workshops, rent offices or desks in an office, ---sign LONG TERM CONTRACTS for monthly payments, --- or buy piles of tapes, videos, marketing materials, websites...or anything that seems unreasonably costly.
...* If the company is selling products that are also sold at major stores--products that are not unique or exclusive to your company..... (e.g.--Sears, Wal-Mart, Home Depot, Staples, etc.)
...* If there are too many 'pie-n-the-sky' (one day we will surely get rich) claims or HYPE--that their 'product is in demand all over the place...'---or promises of 'getting rich' or 'easy money'...... or claims of 'curing all sickness'--- or too much 'ego buttering' of distributors.
...* If you are required to recruit large numbers of new participants ( members, distributors, etc.) and get paid for bringing them into the company--- in order to earn a good income. (Most people do well to recruit 2 or 3 people into a business).
...* The company offers various 'positions' that are ranked by the cost to join....and that fee does not include products to re-sell. Some of these companies charge high fees to participate as --' V.I.P.'... "Founder"... or Diamond Member -- ...or similar jargon.
...* If the company cannot show examples where most of the distributors are successful.
...* If the company claims to be a 'ground-floor' opportunity, but cannot show any evidence that the products are in demand, that the management has experience in that arena, or "marketing studies" that indicate such a business will be successful.
IN A NUTSHELL:
Before you make that big payment to join...
ASK YOURSELF--- "What are they asking me to pay for?
... Is it reasonable?
...Can I expect to earn a good income ? Based upon what information...?
"How much do I have to sell in order to recover my first out-put of fees & payments ?"

If the company is an MLM (network marketing) deal (or 'work from home' business) --- and they ask for hundreds or thousands of dollars--to just join -- BEWARE !! Any company charging high fees to sign up or for other "extras" is very suspect. There are plenty of good MLM companies and other direct selling plans that cost less than $150.00 to start your own business. In fact, there are some that only charge $10 to $25 to get started.
If the company offers a "start up kit" that contains a supply of products, brochures, a website and other business goodies ...depending upon what they are offering-- a fair cost might be as much as $350.00 + (or so... depending upon what they are including for the price). Use GOOD SENSE...what are you getting for your money?
But the most serious problem is -- if they are charging hundreds of dollars to sign up as a Rep (member, distributor, or affiliate---etc.) --- not including supplies, website, brochures, products, or much else--- RUN ! This problem usually occurs with "ground floor opportunities."
If they "require" or "pressure" you to recruit lots of new people in order to make a decent income--- WATCH OUT ! Most people do well to recruit 3 new people. It could be a camouflaged pyramid scheme. You should be able to sell product or services and earn decent money on your own. If you choose to build a sales-group or downline, it is only legal to earn over-ride commissions on your group's SALES VOLUME.
MLM is suppose to be a plan where the upline helps the downline to be successful. If the Plan does not include some type of "recruiting assistance" from the upline...FORGET IT.
If the company Reps are hyping up their deal based upon general (wild) assertions such as: "people get rich doing this...." or making "pie-n-the-sky" promises that " these types of products are hot-sellers"--- or.... " this company is going to go big one day" - or similar wild, unproven statements such as -- "...you will get rich.... doing this program or selling these products "---
Ask for some PROOF or EVIDENCE of these income claims. A legitimate company will probably have a magazine or newsletter that expresses accomplishments, news, pay plans, concerns and income potential for the all distributors or members.
If you can't get any good facts, forget it.
BEWARE !!! It is illegal to make claims about potential income that is not supported by true facts and paychecks. It is legal only for a company to mention the "average income" that their distributors earn, or to give data.

WORK FROM HOME JOBS:
There are companies that promote their "income opportunity" as "work from home" or "home-based business."
You should treat working at home just like you would treat working for an employer at their place of business. If you were going for a job interview in the 'real world,' how would you react if the interviewer asked you to pay upfront to land the job, for starter materials, or for a 'good faith' payment to make sure you were serious about the business?
If you are doing "commission sales" for a major company, they would not charge extremely high prices for you to have brochures, sales aids, or to attend their training meetings. If the company offers a limited line of products, BEWARE...because your income will be limited to the sales of the one or 2 products that they offer.
There are many good MLM (network marketing companies) that are very inexpensive to join --- less than $100. (which includes brochures and sample products) --- and some do not charge any fees to sign to be a distributor. If you encounter one that is charging high fees ($300 and up) --- examine what they are offering.
Is it worth the amount money that they are charging to participate ?
Because most of the promoters are very slick and polished with their presentations of the schemes, many innocent people fall prey to these vultures. Many of these deals promise that you will "get-rich"--but IN REALITY....the only people who really get rich are the people who own the business or who are positioned at the top. Some promoters are so 'slick' in their presentations that is difficult to determine if it is a real business or not.
INVESTMENTS: Ponzi scams generally involve solicitation of large investments. BY LAW, companies asking for investments must provide certain info and documents. If corporations want to offer their stock shares for sale prior to going on the Stock Market, a good business plan and a PRIVATE PLACEMENT MEMORANDUM are required. REGULATIONS MUST BE FOLLOWED.

Systems or schemes that operate solely from the exchange of money put in by new participants are NOT legal. The commissions must be paid on sales volume of the products, books or services--- NOT for bringing in 'new blood to suck.'
Further, it is illegal to set up an operation which is a disguised sales of a product--- and to actually be operating a system that is nothing but a 'pyramid' where the real exchange is only of money. Some--if not most-- of these "money-schemes" are just illegal pyramids or ponzi scams.
