10 May 2004 & 20 May 2004: Plaintiff's Motion for Reconsideration and to Give Effect to Quo Warranto - Scheduled for Monday morning, 31 May 2004 in Montreal Federal Courthouse at 30 McGill Street, below Victoria Square Metro.
Mr. Justice Rouleau pre-empted my Constitutional right to a "fair and public hearing" by ruling ex-parte, in Ottawa, on my Motion for Reconsideration: I had scheduled it for Monday morning in open court in Montreal at 9:30 a.m. This effectively shuts down the Motion for a Writ of Quo Warranto against the Quebec "National Assembly" at Federal Court of Canada. But, just before this latest ruling came down, I learned that according to section 2 of the Federal Courts Act, the Federal Court never had JURISDICTION to rule on this Quo Warranto, in the first place. As Plaintiff, I should have expected the Court's courtesy in replying to my motion for Quo Warranto by DECLINING COMPETENCY (jurisdiction) for this matter. Instead, the Court (Mr. Justice Rouleau) has tried twice now to force me to litigate the matter in this irrelevant forum, using mal-formed procedures under wrong rules as dictated by their Registry Officer. Obviously, this would be a waste of my time, as nothing useful can come of it at Federal Court. I am therefore taking the appropriate legal measures to transfer the Quo Warranto to the proper jurisdiction.
