PUPPY AGREEMENT
All prices quoted are in U.S. Dollars
1) At least a $300.00 Deposit is required in order to hold a pup.
2) Deposits are NON REFUNDABLE. If you decide you don’t want the puppy, you forfeit your Deposit. If something happens to said puppy (accidental death, buyer doesn’t like it, or wants to wait on another litter) You may choose from the next AVAILABLE litter. (not the next litter due)
3) Choice of puppy is determined on a first come (deposit received) first to choose basis. Buyer will be supplied with photos via internet upon request and may visit pups at any time. Buyer will be given 48 hours to decide on the pup after deposit is given. After 48 hours, if buyer has not chosen, he/she forfeits their choice until all others with deposits have chosen. After deciding on which puppy to take the remaining balance is due one week prior to delivery/pick up of pup. After final payments have cleared, if for any reason buyer decides not to purchase a puppy, all funds will be returned with the exception of the original $300 deposit.
4) ALL shipping costs are the buyer’s responsibility. Buyer should be aware that weather and holidays may make it difficult to ship on time.
5) We guarantee the dogges/pups will be healthy and vet certified upon arrival. We however do not offer this animal as a breeding animal nor do we promise this to be a top show prospect, if you [the buyer] decide that you want to breed or show your dogge this is a decision that you have to make, we do not guarantee it to be such. *You must have your dogge/pup vet checked within 48 hours of arrival and we must receive a written notice of the health check by your veterinarian.
6) Buyer must register said dogge or pup with the Victorian Bulldogge Association within 6 months of purchase.
7) **Said dogge or pup MUST NOT be registered with ANY OTHER ORGANIZATION/REGISTRY other than the VBA [Victorian Bulldogge Association] if it is recognized as an Olde Victorian Bulldogge. Doing so is in breach of this contract and buyer acknowledges that said dogge or pup must be returned to the seller [at the buyers expense] with no moneys refunded to the buyer. **
8) Buyer agrees that the kennel prefix "Berry’s Bulldogges" will be in front of the dogges registered name and that no other kennel prefix can be in the dogges registered name other than Berry’s Bulldogges. The buyer also agrees that puppies taken back from any litters they produce and those of which that carry the Berry’s Bulldogges' line gives Berry’s Bulldogges the right to place such kennel prefix in front of said dogge/puppy's name.
9) The buyer agrees to keep the dogge/pup in a proper manner. It shall not be kept permanently in a kennel or in any way involved in dog fighting. If problems
arise concerning keeping or training, or if the dogge/pup becomes seriously ill, the buyer agrees to consult the breeder. If it should prove necessary for the dogge/pup to change hands, the breeder has prior purchase rights for a period limited to two weeks. Selling to a third party is permissible only after prior consultation with the breeder, whereby the main consideration is the assurance that the dogge/pup is passed to responsible owners. In an attempt to keep our puppies from the fate of a pound/ humane society, seller will reimburse half of deposit ($150) in exchange for said dogge if buyer is unable to provide a home. This puppy has been bred by us and has been carefully and painstakingly reared. The parent animals were mated with the aim of breeding good and healthy puppies.
10) Buyer will also be responsible for any legal fees and travel expenses that are incurred by the seller if the buyer is in default of this contract.

Both BUYER and SELLER acknowledge that no representations verbal or implied, have been made with regard to said bulldogge future abilities. If Devon or John Berry cannot reach the purchaser by the above stated contact methods, the purchaser will be removed from the list and the deposit kept by the kennel. We highly recommend that purchaser notify Devon or John Berry with any change in contact information and remain in contact with us on a regular basis.

This is a binding agreement, and if the purchaser breaches this contract the deposit is retained by Devon and John Berry. The purchaser understands by signing this contract that the deposit is non-refundable. The purchaser also understands and agrees that the final payment is due when the puppy is 3 to 4 weeks old. By signing this deposit agreement, you agree to all of the above.
