We are still awaiting Judge Collyer’s ruling on our Emergency Motion. Recent newspaper articles claiming that a ruling has been issued are not correct. Rumors pertaining to a “deal” having been struck between the government and ASD are also not correct.
Our volunteer staff has been busy with re-engineering our business and laying the groundwork for ASD to be ready to move forward when the Judge renders a positive decision. Much has been accomplished “behind the scenes” in this effort.
We are also still reviewing the suggestions that were submitted for the Improvement Contest. Many good suggestions were submitted and some ideas were implemented just prior to the government shutdown. We hope to implement many others in the near future.
Thanks again to everyone who continues to show support for ASD, our Staff, and Andy & Faye personally.

Our Data Base Has Not Been Sold

There have been rumors that suggest that our database has been sold. These rumors are unequivocally not true. In fact the ASD corporate office has not had access to the database since the government seizure occurred on August 5th, when the government shut down our offices. The government itself is in possession of our database.
If you suspect that your information has been sold to a third party, please send an email to the address below with the approximate date that you joined ASD. We will use the dates to approximate the time periods involved. This will help us pinpoint who might have had access to the data at the time and this will help us determine who might be responsible for the inappropriate use.

Here is a brief status report about the emergency evidentiary hearing we had on September 30 and Oct. 1 in Washington D.C. federal court. In case you want to forward this to members, who are not my clients, I am writing this in a purely objective, factual way -- without offering opinions or comments or advice (or any confidential communications of any type). In other words, this summary outlines what any person watching this public evidentiary hearing would have seen and heard.
We put on several witnesses: Bob Grayson (a member), Gerry Nehra (our expert witness in multi-level marketing), Chuck Osmin (your accounting/customer service supervisor) and Phil Schwartz (one of my law firm partners in our corporate-securities division; Phil is the primary architect of the compliance plan).
The government did not put on any witnesses, though it did introduce some exhibits. Its "case" consisted primarily of cross-examining our witnesses.
At the end of the hearing yesterday afternoon, the judge instructed each side to submit proposed findings of fact and conclusions of law. Both the government and ASD will file their submission within a week (i.e., by Wednesday, Oct. 8). The judge said that she expected to rule within two weeks.

Update on Resolution of Golden Panda Case:
Golden Panda Ad Builder has ceased operation. (We agree).
Prior to receiving notice of the Department of Justice's lawsuit against funds seized from Ad Surf Daily/ASD Cash Generator and Golden Panda Ad Builder bank accounts, Golden Panda commenced operations in reliance on representations made by ASD officials (He commenced operations on his own willfulness) and its attorney which indicated that the ASD's autosurf program operated legally and with the approval of SEC attorneys. (ASD did not approach the SEC because we did not need the SEC’s approval since we are not a securities company).
Before the seizure of its funds, Golden Panda hired independent counsel and asked him to assess every aspect of Golden Panda's business to determine how best to ensure legal compliance. (We applaud this since Golden Panda hereinafter referred to as (GP) changed the business model and included features, i.e., guaranteed 3% daily rebate for the first 30 days).
In fact, shortly after the company was incorporated in July of 2008 and long before the government's seizure of Golden Panda's funds, (30 days is not long before) Golden Panda hired independent counsel to evaluate Golden Panda's entire business model and recommend any changes that would ensure legal compliance. (So his lawyers were incompetent or they waited too late and did this include the 3% guarantee rebate? ASD broke away from GP because of changes that the GP executives wanted to make to the business model that were not consistent with ASD’s business model).
The day before the government's seizure, that independent counsel was in Golden Panda's offices reviewing its operations and preparing recommendations for going forward. (They should have not started operations without having this done before the launch).
Through the government's complaint, received a few days after the funds were seized, Golden Panda discovered, among other things, that ASD's operation had not been approved by the SEC. (ASD did not need to have SEC approval since it was not offering guaranteed 3% rebates and was not a securities firm).
Following discussions among Golden Panda's principals, Golden Panda's own counsel, and the Department of Justice, Golden Panda principals determined to cease operations and to assist the government in restoring funds to individuals who sent funds to Golden Panda. (Since the Owner has a prior SEC conviction and was prohibited from operating a security company he was forced to surrender the funds and comply with the Department of Justice hereinafter referred to as DOJ).
In particular, Golden Panda has taken the following steps, effective immediately, September 22, 2008:
(1) Golden Panda has agreed to withdraw its claim to funds seized by the United States and to aid the United States in acquiring possession of Golden Panda's remaining funds, as well as to information concerning its former membership; (GP was forced to surrender its operation due to the fact that he could and would have been arrested for violation of the restrictions from the prior conviction).
(2) Golden Panda is also sending all uncashed checks in its possession to the United States government (False; ASD has it on good authority that GP hand delivered many of their uncashed checks directly to members, a list can be provided by cross examining Clarence or from calling members) along with information about the accounts from which checks were drawn, and has consented to the government's (Clarence returned some himself) return of those checks;
(3) Having previously ceased operations, Golden Panda has ceased doing business; and (Agreed)
(4) Golden Panda has authorized its attorneys to dissolve Golden Panda Corporation, thereby causing Golden Panda to cease its existence as a legal entity.
Individuals interested in pursuing a portion of funds sent to Golden Panda that the government may now forfeit should provide pertinent contact and other information to the Department of Justice using the information submission form available on the website of the United States Attorney's Office for the District of Columbia, at:

(Why did they include ASD in this web address? We suppect an attempt trick members into thinking that they are filling out a GP form, but all along they are filling out a form that the government plans to use against ASD. They might look like the GP complaint form, but we suppect that the complaints will go against ASD rather than GP. There should be a specific GP web site and GP complaint form and not one that could be used against ASD).
Contact the government and request a new GP website address.
Please do not fill out the current form, but rather wait on a GP specific form.

The United States Attorney General's office has agreed to release ASD’s computers and electronic equipment today. Representatives from ASD are on their way to Orlando to take possession of the items and should be back in Quincy sometime later tonight.
We see this as a positive first step in returning to the business of providing an advertising vehicle for all our members. We also look forward to the return of all our other assets and being exonerated of all accusations of business impropriety.

ASD is charged with being a ponzi scheme and the article portrays us as already being tried and convicted. When in fact we have not even been to court (all that has happened is that paper work has been filed). Tim Jansen's video clip was obviously taken out of context because of a quote later in the article. “It appears to me the motion is well founded," adds Jansen.” Attorney General McCollum calls it a pyramid scheme then goes on to describe a ponzi. The fact is ASD does NOT need any new members to continue its business, of course that would seriously slow or stop our growth, but it would not put us out of business. If in 1995 Wal-Mart never got a new customer that would have stopped their growth too.
ASD Attorneys Have Filed Their Petition

One Monday August 18th the ASD attorneys filed our petition requesting that the government unfreeze our bank accounts and to return all of our property. The government is expected to respond on Monday August 25th and submit their petition to the U.S. District Court in the District of Columbia. At that time the judge will have the information to evaluate our case. She could make a quick decision; or request more information from either side, call for a hearing, or simply take more time to review the information. One thing is for sure, that the case is now in the hands of the judge and it is our hope that the evidence will be evaluated and that ASD is exonerated and allowed to continue to operate.
We know that many of our members rely on the legitimate advertising of their ASD Website to grow their individual businesses. For this business interruption we are truly sorry. Rest assured that the lawyers and the management team are working diligently for your business advertising to continue.

The ASD Member Back Office is viewable, but not yet operational. Surfing is also not operational at the moment. We also know that the Global Credits have not yet been posted to each member's accounts for the time the site has been down. Rest assured that Global Credits will be issued as soon as the site is completely operational.

Due to the success of the ASD Cash Generator System, we have experienced unprecedented growth over the past several months.
As a result of this growth, the ASD computer department is working with a web development firm who is assisting us in retrofitting our existing ASD Web application along with a new application that will better handle the increasing member traffic. We are all excited about Version 2 that will have Indy 500 processing speed.
Please be patient while this is in progress. During our testing and implementation phases, you could experience times when the system is online and then offline. There is no need to send in support tickets at this time. And as always, members will receive Global Credits for surfing while this evolution is underway.

ASD is now accepting Visa Cards for purchasing of Ad Packages at Rallys only. If attending a future rally any member can use his or her Visa card (Visa Only) to purchase Ad Packages. A member cannot bring another members Visa card for purchasing of Ad Packages due to the terms and conditions of each sale.
Our Visa processing company is an international company (not domestic) and thus you should call your credit card company in advance and alert them of your intentions of using your card on a specific date, and for a specific amount, so the transactions will be cleared without delay.

This message is designed to prompt you to add a W-9 to your profile. A link is provided to download the W-9 form. Once the form is downloaded and completed you will then be able to mail it back to the corporate office.

Due to the lack of information ASD receives when processing Alert Pay and Direct Deposit transactions, we are discontinuing their use as a means of purchasing Ad Packages effective July 31st 2008. We have notified Bank of America not to accept cash or personal checks for deposit into our accounts - English or Spanish. If you have experienced a problem when purchasing Ad Packages as a result of using Alert Pay or Direct Deposit, contact customer service. All Cashouts must be requested through your backoffice using the proper procedures. This is due to the fact that we are processing hundreds of Cashouts on a weekly basis. At this time, we will no longer be able to process Cashouts for people who come by the office and request them in person. Once a Cash Out has been submitted, on either your ASD Cash Generator or La Fuente Dinero Site, you cannot change the method of payment for that particular Cash Out transaction.

If you are sending funds to ASD Cash Generator or La Fuente Dinero, for any reason, including, but not limited to, purchasing Ad Packages, you must convert any foreign currency to US Dollars / Currency. This must take place prior to sending the funds to the Corporate Office in Quincy, Florida or to any Ad Surf Daily bank accounts.
At this time, we will only accept US Currency. If you send anything other that US Currency, it will be sent back to you and will not be processed.

We are aware that you are unable to use ACH Payment Methods at this time to received Cash Outs. We are currently working with the bank to correct the issue with Direct Deposit. We should have it functioning again, as soon as possible. Again, this is for Cash Outs Only.
At this time, we are issuing checks for Cash Outs on both the ASD Cash Generator Site and the La Fuente Dinero Site.

There has been some confusion on whether or not to move your Cash Balance up yourself, in order to get the 50% match. The answer is "NO"... Do Not upgrade the promotional amount that is in your Cash Balance.
This is what we want you to do: For the amount, in your Cash Balance, that you want to get the 50% match on (this would be the amount specified on your form, do not upgrade that amount yourself from your Cash Balance. For example: If you specified that you want to upgrade a $1000 in your Cash Balance, in order to get a 50% match, do not upgrade that $500 in your Cash Balance to your Ad Packages...that will be upgraded by the office.
You may however, upgrade any amount in your cash balance, above what you specified for the 50% promotion.

Starting today, June 16, 2008, you are no longer able to change from your current sponsor to another sponsor, except for the following four reasons: 1. You accidentally signed up under the default "5" Sponsor I.D., then you will need to send a ticket and let us know your correct sponsor's member number, 2. Your sponsor is deceased and their account has been closed due to this occurrence, then your new sponsor will be the next person in your upline, 3. Your sponsor is deceased and has willed his/her account to an heir, then the new heir who has been willed the member account will be your sponsor. 4. Your sponsor decides that he or she no longer wants to participate in the program and they close their Member account, then you would move under your upline sponsor.

We have received a large number of personal checks that were written with insufficient funds to cover them; therefore, ASD Cash Generator and La Fuente Dinero will no longer be accepting personal checks as of June 9, 2008. Any personal checks, sent to the office after June 9th, will be returned.
You may use Direct Deposit, one of our processors, a Cashier's Check or a Money Order to purchase Ad Packages. Cashier's Checks and Money Orders must be US certified.
If you send a personal check, prior to June 9, 2008, those checks will be processed.

Starting immediately, you may only purchase up to $50,000 per Month in Ad Packages, on each site. Example: You may purchase up to $50,000 on the ASD Cash Generator Site and also, up to $50,000 on the La Fuente Dinero Site, in one month. This is for new, external money only. The $50,000 maximum amount is cumulative, starting the 1st of each month through the last day of that same month.
If you are upgrading Ad Packages from your Cash Balance, there is not a limit as to how much you are able to upgrade.

We regret to announce that the promotion for Non-Profit organizations will be ending on Friday, June 6, 2008. If you purchased Ad Packages with a check, at one of the previous Rallies, and that check bounces due to insufficient funds, then you may send another check to the Corporate Office for that amount; however, the amount of the replacement check will be applied to the general company promotion going on at that time. It will not be eligible for the promotion given at the Rally.

SEE CHART BELOW FOR A SUMMARY OF THE FOLLOWING:
Due to the fact that ASD Cash Generator and La Fuente Dinero are separate companies, you are not able to transfer Cash Balances between the two Sites or purchase Ad Packages, with your Cash Balance, from one site to the other. (See Chart Below)
Here are some examples to help explain:
Example 1: You cannot move $100 from your ASD Cash Generator Cash Balance to a La Fuente Dinero Cash Balance or vice versa.
Example 2: You cannot purchase 100 Ad Packages on the La Fuente Dinero Site by using $100 from your Cash Balance in your ASD Cash Generator account, neither can you purchase 100 Ad Packages on the ASD Cash Generator Site by using $100 from your Cash Balance in your La Fuente Dinero account.
You are able to move your Cash Balance between accounts on the same site.
Also, Ad Packages cannot be transferred between accounts. You are only able to transfer your Cash Balance between accounts on the same site.

Since Cash Outs are not processed on the weekend, you will notice that the "Request Cash Out" Button, in your back office, is removed on Saturdays and Sundays. It is brought back up each Monday through Friday.

If you are wiring funds to the Ad Surf Daily Account as detailed on the General Information page, there is a $12 Bank Processing fee that is charged to complete wire transfers. This is a charge from the bank for processing the wire. Please include this $12 fee to the amount you are wiring to purchase Ad Packages.
If you do not include this $12 Bank Processing Fee when wiring your funds to purchase Ad Packages, then you will see a $12 deduction from the amount you are sending for the purchase of the Ad Packages.
