Terms & Conditions of Business.

 

The following terms in conjunction with the description of works detailed in the estimate comprise our contract should you accept the estimate. On acceptance, this estimate will represent an agreement between the client and Clays Tiles. Any changes in specification may result in extra charges being made.  Please note:  Failure to notify cancellation of appointment before 7 days of the designated start date for any reason, or any poor quality workmanship carried out by other tradesmen that prevents Clays Tiles from carrying out the desired task, will result in either, a charge for lost work of £130.00 for that day, or a charge for the extra works needed to carry on with the job provided that I am able to undertake the works required. For works due to start within the 7 day period mentioned above, then a charge of half the total cost will be payable as lost work compensation. All work undertaken by Clays Tiles is dependent on site and materials being available on the agreed date, if this cannot be met please advise Clay Tiles accordingly or the above charges may apply. It is the responsibility of the Client to supply Parking Permits where required. Any fines / charges incurred by Clays Tiles due to non compliance by the Client will be chargeable.

 

Your safety / inconvenience / Items of Value / Possessions.

 

The safety and well being of children, adults and pets are not the responsibility of Clays Tiles. A work area will be set up and will be out of bounds (within reason) whilst the job is in progress. This will be kept to a minimum and in the case of "in use" or single bathrooms all tools will be put away at the end of each day and the work area left tidy. There is always a small amount of dust but this will be kept to a minimum. Although every reasonable effort is made to protect your property you must take responsibility to ensure that all fragile goods and items of particular monetary or emotional value are safely stored before work commences. This includes the removal of white goods when undertaking kitchen floor areas. Any items not removed before work commences will incur a removal and refitting charge of £25.00 due to the extra work involved (with no liability accepted to damage to any property to be moved or the fabric of the building). Installation of fixtures and fittings (i.e. toilet roll holder, towel rail etc.) can be arranged for an extra charge on completion of tiling works.

 

Hazards / Protection / Noise / Cleaning / Removal of rubbish.

 

There are few hazards involved with tiling as long as the work area is respected. Any and all hazards will be pointed out "on site" as every job is different. All surfaces being worked on will be covered with heavy duty dust sheets. There will be some noise especially when using electric tile cutters. This however is intermittent and should not cause too much inconvenience. It is the responsibility of the Client to provide electrical and water supply during the works. All areas will be left as found. As a result of grouting there may be some small deposits and a film powder left on tiled surfaces, these are easily removed with a soft dry cloth the following day. Cleaning up details for this will be explained at the end of the work period. Tiled areas will be left 95%+ clean. Clays Tiles will remove any rubbish in suitable containers which is a by-product of the works involved for a small charge, currently £25.00; otherwise it remains the responsibility of the householder to dispose of any waste. Sanitary ware and old timber will need to be uplifted at costs to yourself due to there size and weight. This can be arranged through your local council offices.

 

Repairs to the Fabric of the Building.

On some occasions such as Underfloor heating installation, it may be necessary to chase walls or cut holes in plasterboard etc for the fitting of electrical cables. Chased walls etc will be filled just below the surface using appropriate materials and are not restored to a decorative standard. These can be filled and made good by a decorator. NOTE: No wiring is connected at any time by Clays Tiles. This should be done by a Part P qualified Electrician. One can be recommended for you and any agreement is made between the Client and the Electrician alone.

 

Do you supply the tiles, adhesives, grouts, etc?

Many clients prefer to supply their own tiles and adhesives etc as these are usually sold when purchasing your tiles. However, they may not purchase the correct amount or type as different adhesives are used for different types of tiles and flooring substrates etc, therefore Clays Tiles can supply quality adhesives, tiles, grouts and adhesives at competitive prices, or you can go to the shop and advise me of the tiles required, stating name and colour and price per m2 and I will advise of the discount I get and upon payment for the tiles in cash, (I cannot hand over a cheque in someone else’s name) I will supply these using my trade discount, please allow at least 14 days as tiles may have to be ordered. This is to ensure the correct products are used for a professional finish that lasts. Unfortunately Clays Tiles will be unable to guarantee any work unless the correct products are used; if you do unfortunately purchase unsuitable materials, Clays Tiles can still complete the work at your direction but with no guarantee.

 

 

What method of payment do you accept and when do I have to pay or for non payment.

 

Clays Tiles accepts cash and cheques only. Sorry no credit cards. Cheques should be made payable to Mr. Darren Clay. All cheques must have a valid cheque guarantee number on the reverse; amounts over your card limit will require multiple cheque issues up to the value of your card. Unfortunately if a cheque or cheques do not clear, Clays Tiles reserve the right to add any charges my bank may add to my account, currently £38.00 per unpaid cheque to the outstanding balance and Clays Tiles reserves the right to charge interest at 3% above the Bank of England base rate for each 7 day period the amount remains unpaid. For small jobs, payment is required on the last day of the job. For larger jobs including the purchase of tiles, payment for the tile purchase is requested upfront. In all occasions the client must either provide materials which Clays Tiles will list, or Clays Tiles can provide the materials required providing payment for these materials is paid upfront. All estimates exceeding £500 excluding materials require a deposit of 30% at time of booking. Clients are provided with a receipt upon completion of the work in all occasions.

 

If for any reason payment cannot be made upon completion of works then Clays Tiles reserves the right to charge interest at 5% above the Bank of England base rate for each 7 day period the amount remains unpaid. If the amount is still outstanding after 28 days, then this debt will be passed to Sheriff Officers for collection and interest will still be payable until cleared, this may also affect your credit rating and your ability to obtain credit in the future For commercial clients unless otherwise agreed, payment must be within 20 working days of completion, Clays Tiles reserves the right to charge interest at 5% above the Bank of England base rate for each 5 working day period the amount remains unpaid. If the amount is still outstanding after another 20 working days, then this debt will be passed to Sheriff Officers for collection and interest will still be payable until cleared, this may also affect your credit rating and your ability to obtain credit in the future.

 

Refunds and complaints procedure.

 

For all refunds and complaints, LIMITATION OF LIABILITY, Clays Tiles cannot be held responsible for any problem incurred or service defined as inadequate after the payment has been made. And will make any offers as a matter of goodwill. This must be sent by email or in writing to Clays Tiles within 14 days of completion of works. Clays Tiles will come to your property to examine and discuss your complaint and if appropriate Clays Tiles will offer to redo the work involved or replace at costs to Clays Tiles, if this involves replacing tiles and materials then this will be at cost to Clays Tiles, tiles and materials will be supplied within a reasonable time. If a replacement is given then any tiles removed remain the property of the householder and it is then up to them to dispose of at their leisure. If a cash refund is requested Clays Tiles reserves the right to make payment under the terms of the supply and sale of goods act which is within 30 days, but this is usually within 14 days of the date of your receipt. If another worker is brought in to do the work without my express permission when Clays Tiles has offered the above then I will accept no liability for any other costs.
