Witness to Shaun's Injustice

Blind Eye has documented that two of the jurors needed out of the trial.  What the transcript does not show is Juror Labardini slept through much of the testimonies.  Juror Moore had a discussion with a family member who informed her Windeon was not found guilty of capital murder.  Juror Moore looked at her astounded and stated, "What?  We did not know that.  If we had known that we never would have given that verdict."

Blind Eye has documented the inconsistency with Waters.  What the transcript does not show is when asked by Windham what name to call Waters--Waters begins with the prosecutor by saying, "Terrence you can call me anything you want."  However as he says this--Waters lays back in the chair, crosses his left leg over his right knee, throws his left hand up, gives his left foot a few swings....   But his demeanor suggested, Terrence anything you ask me, I'll agree too.

Blind Eye has documented that Ellis rulings were questionable.  What the transcript does not show was the atmosphere he created.  He laughed through much of the testimony.  I am not saying he was slapping his knee with laughter, but he was clearly, visibly grinning, chuckling particularly near the end of the trial. 

Blind Eye has documented the numerous inconsistent statements made by Latoya.  What the transcript does not show was as she testified, particulary in regards to whether she was sitting up/laying down, she would watch Windham.  If he sat up straight in his chair she would say she was sitting up.  If he lean back in his chair then she would indicate she was laying down.  However, Easterling was able to catch her doing so and stated in the transcript, "What are you looking at him for?"

Blind Eye has documented that Moore filed papers that were erroneous and limited in content.  What the transcript does not show was Moore was informed about Easterling's Ineffective Counsel.  He stated, "I don't do that type of work."   He stated he did not want to file a motion for a new trial and would not file one against Easterling.  In fact, Moore gave motive as to why Easterling was determined NOT to defend Shaun.  Moore stated, "Isabel was on a twelve capital murder trial winning streak, when he got this case.  That was a pretty big deal around here."  Then he later tried to justify there winning their case by indicating their jury selection.  Upon realizing he was talking to much, he quickly ended the conversation.  Then refused to have any further conversation regarding the case. 

Blind Eye has documented the recorded conversations and alleges a buddy system operating in Harris County.  I agree.  It exist.   I can not say its existance is intentional or conspired.  It would be beyond my knowledge of facts.   I have never spoken to Isbel.  I can say with great sincerity and faith in a dying system that Cunningham is a fine and decent man, lawyer.
