Sex offender off registry

By Sarah Ovaska, Staff Writer
A Wake County judge granted one convicted sex offender’s request to be removed from North Carolina’s sex offender registry during a hearing this morning.
The offender, Michael Anthony Gathings, 43, was convicted of indecency with a child in 1992 after admitting that he had sex with a 7-year-old girl he was babysitting.
Gathings now lives in Raleigh and is married with a 5-year-old daughter, he told Wake Superior Court Judge Paul Gessner.
He spent four years in a Texas prison for his crime, before moving to North Carolina in 1997. At the prison, he underwent intensive therapy to rehabilitate himself, he said.
“What I did is disgusting to me,” Gathings testified in court. “It’s hard for me to even talk about.”
Only two other people in the state, from Wake and Mecklenburg counties, have successfully petitioned judges for removal since December, according to the N.C. Attorney General’s Office, which maintains the registry. That’s when a new law went into effect requiring certain convicted sex offenders to ask a judge if they can be taken of the registry after 10 years. Beforehand, they were automatically removed if they hadn’t committed other sex crimes.
Gathings was one of four men who asked Gessner to be taken off the list. The others are Lemuel A. Banks, a 38-year-old convicted of trying to rape a neighbor; Purvis Michael Dunn Jr., 40, who touched the breasts of a 13-year-old relative; and Shimel K. Draughon, a now-31-year-old man who was 20 when he had consensual sex with a 13-year-old girl, according to police accounts of the crimes.
I bet it's even harder for his victim to talk about it. I wonder, does the judge have a daughter. Maybe he'd like to have Mr. Gathings as his next door neighbor!

U.S. MARSHALS ADD CONVICTED KILLER AND SEXUAL PREDATOR TO “15 MOST WANTED” LIST Reward of up to $25,000 being offered for arrest of Paul Clouston
WASHINGTON, D.C. - The United States Marshals Service announced today that it has added convicted cop killer and child molester Paul Clouston, 70, to its list of 15 most wanted fugitives.
Clouston, a Pennsylvania native who was last seen in the Williamsburg, VA area, is wanted by the U.S. Marshals for unlawful flight to avoid prosecution. He also is wanted by the Virginia State Police for failing to register as a sex offender, and by the Virginia Division of Probation and Parole for alleged violations of his parole on a conviction for the armed sexual assault of a child.
The Marshals Service is now employing its comprehensive nationwide network of regional and district fugitive task forces, as well as its Technical Operations Group, to find Clouston. A reward of up to $25,000 is being offered for information leading to his capture.
“Paul Clouston is a dangerous felon and needs to be taken off the streets,” said United States Marshals Service Director John Clark. “By placing this predator on our 15 Most Wanted list, I have directed our investigators to utilize all our resources to catch him and bring him to justice. He has proven himself to be a danger to our children and he needs to be captured.”
In 1973, Clouston was convicted on second degree murder charges for murdering a police detective in Buena Park, CA a year earlier. He was released from prison in 1982. In 1991, Clouston was indicted on 17 counts of sexually abusing children in the Williamsburg, VA area. He later pled guilty to seven of the 17 charges he faced and was sent to prison again. He was released on parole in 2005. He was last seen living in a motel in the Williamsburg, VA area and has failed to register as a sex offender with the Commonwealth of Virginia.
Clouston, who is six feet tall and weighs 170 pounds, is considered armed and dangerous. Anyone with information as to his location is asked to contact their nearest United States Marshals Service office, or the Marshals Service Headquarters at (800) 336-0102.
Last year, marshals apprehended more than 35,500 federal fugitives, and cleared 38,500 federal felony warrants, more than all other federal law enforcement agencies combined. Working with authorities at federal, state and local levels, Marshals Service-led fugitive task forces arrested an additional 44,000 state and local fugitives, clearing 51,200 state and local felony warrants. ACCUSED MURDERER AND CHILD MOLESTER ADDED TO U.S. MARSHALS 15 MOST WANTED FUGITIVES LIST |
|

Washington, DC - Daniel William Hiers, Jr. seemed to be a good cop, a faithful public servant for the city of Charleston, South Carolina. But, he betrayed his badge in the worst way, using it to gain the trust of a single mother with a young daughter, then allegedly molesting the 10-year-old child over a period of months. On November 24, 2004, Hiers, 32, was arrested by the North Charleston Police Department for committing lewd acts on a child under the age of 16 and was released on bond. He was promptly suspended from the police force.
|
| The Dorchester County, SC Sheriff’s Department subsequently filed additional charges against Hiers for first-degree criminal sexual conduct with a minor. Hiers was scheduled to surrender on those charges on March 15, 2005, but failed to meet his lawyer at the sheriff’s department. When Hiers’ mother looked for him at his house, he was nowhere to be found. What was found in Hiers’ bedroom was the body of his 24-year-old wife, Ludimila, killed with a gunshot to the head. Neighbors observed Hiers leaving the house several hours before the gruesome discovery was made. On March 31, 2005, the Goose Creek, SC Police Department obtained an arrest warrant for Hiers, alleging that he murdered his wife.
Despite an intensive manhunt, South Carolina authorities have been unable to locate Hiers, and requested the assistance of “Operation Intercept”, a U.S. Marshals-led fugitive task force. The U.S. Marshals Service has obtained a federal warrant for Hiers for unlawful flight to avoid prosecution. Hiers is described as a white male, age 32, 6’03”, 210 pounds with blues eyes and blond hair. He has eleven years of police experience, is trained in the martial arts, and maintains a high level of fitness. He is believed to be armed with a .40 caliber Glock pistol and may possess a bullet-resistant vest. The U.S. Marshals Service is offering a reward for information directly leading to Hiers’ arrest.
“It is especially abhorrent when individuals sworn to uphold the law commit such crimes. We will remain focused on seeing that this fugitive is brought to justice,” said Marshals Service Director Benigno Reyna.
U.S. Marshals are the nation’s primary fugitive hunting organization and capture more federal fugitives each year than all other national law enforcement agencies combined. For more information about the United States Marshals Service, please visit the web site at www.usmarshals.gov/.
