ALL BHUTAN ARTIST ASSOCIATION(ABAA)

 

Adopted on 1st July 2001 Informal inauguration of the Association.

Entry into force: From 8th Dec 2001 the formal inauguration of ABAA.

 

PREAMBLE

            All Bhutan Artist Association is proclaimed with careful reference to the Article 20 of UDHR and ILO conventions. The preamble is regarded as a paramount   guideline of the constitution. Recalling the backwardness of musicians, singers, dancers, writers and actors; simultaneously the increase of antisocial activities castism, communalism, poverty, social injustice and   unemployment; as a medium to prohibit through artistic means ABAA is established.

 

Viewing to preserve, protect and uplift the cultural and traditional values, promote modern technologies and to introduce Bhutanese artist worldwide.   Subordinate social justice, equality, liberty, fraternity peace and security  without any discrimination on the basis of cast, colour, creed, sex, religion and place of birth .

Protects social, legal and economic interests of musicians, singers, dancers, actors, lyricists and scriptwriters.

ABAA is concerned at the lack of human rights in Bhutan and the growing abuse of musicians and actors rights by the Bhutanese regime.


CHAPTER - I

 

PRELIMINARY

Rule-1 

           NANME AND OFFICE :

The name of the association shall be All Bhutan Artist Association.In short it is written as ABBA. The head – office shall be in Thimpu (Bhutan). The exile office shall be in Kathmandu (Nepal) and in Birtamode/Damak Jhapa. All changes in the location of the offices shall-lie with the decision of the central executive committee and shall be duly notified to all concerned.

 

 

Rule –2 

          ASSOCIATIONS IDEOLOGICAL DEFINATION:

Artist in wider sense can be comprehended in various senses. Like: musical artist, actor, literary artist, drawer, sporting artist, painters etc. A person who produces the work of art like any of the above mentioned areas is called an artist. However our ideological definition mainly comprehends musicians, singers, dancers, actors, lyricist and scriptwriters. The reason for giving priority to these faculties is that: Its functions are unlimited .

 

Rule-3

          COVERGE :

The association covers musical artist , culture and tradition , music education , social values, social security , social justice , social assistance to widow, widower children and disable women professionals , reservation for women and dignity and honour of the citizen . We believe in secularism and deeply respect ILO conventions and UDHR.

 

Rule – 4

           PROHIBITION :

There are certain elements that are to eliminated by the association. The foremost priority is given to castism and communalism. There are anti- social activities increasing in the society which gradually builds the formidable future of our country. For artist association seems to be a paramount and significant medium to prohibit through artistic means.

            ABBA does no activity un-artistic.

 

Rule – 5

          PROCLAMATION:

With a view to maintain regional, national and international integration, in the collaboration of all the Bhutanese artist  ‘All Bhutan Artist Association ‘ is proclaimed on 8th December 2001.

 

Rule-6

          WORD MEANING

1.      Association means ‘All Bhutan Artist Association (ABAA).

2.      Constitution means the constitution of ABAA.

3.      Artist Association means the association of musicians, singers, dancers actors,lyricists and scriptwriters.

4.      Member means a person who for the time being is a member of the Association.

5.      Financial year means the year beginning from January and ending in December for which accounts of the association are audited.

6.      ‘Artist’ means any person who produces works of art defined by rule-2 of the constitution.

7.      Congress means the representatives of formal meeting of ABAA who meet once a year.

8.      General congress means all the member of all the district committees which meet once in four years.

9.      Central Executive Committee means all the executive members of ABAA as determined by rule-24 of the constitution.

  1. Central member means the person who for the time being is a central executive member of the ABAA.
  2. Office bearers means President, Vice-President, General Secretary and Finance Secretary of ABAA.
  3. President means the person who for the time being is a executive head of the association.
  4. General Secretary means the person who for the time being is a administrative head of the Association.
  5. Age of majority means six years of age.
  6. Units means the three wings (Acting, dance and instrumental /vocal) of ABAA.
  7. Branch committee means the committee prevailing in the camps.
  8. Bhutan Music Academy is the music school established by ABAA in order to impart musical education
  9. IAC stands for international advisory council.

 

 

CHAPTER II

 

BASIC AIMS AND OBJECTIVES.

 

Rule-7

            PROMOTE CULTURE AND TRADITION

1.      Through presentation in the stage.

2.      Through folk and modern albums.

3.      Through mass- media like: Radio, Television, F.M., Newspaper, etc.

4.      Through documentary means (serial and tele-films, plays, big-screen films)

5.      Organizing international level cultural exchange programme.

 

Rule-8

A. ESTABLISHMENT OF “BHUTAN MUSIC ACADEMY”

1.      The academy will be registered with Musical universities .

2.      All the faculties will be introduced under Bhutan Music Academy .

3.      This “Academy” shall be under ABAA and major decisions will be taken by CEC of ABAA,

4.      A committee of ABAA unit chief coordinators and k/bari chief co-odinator shall run the academy as per the instructions given by the ABAA central committee.

5.      The central office of Bhutan Music Academy shall be in khudunabari. Any changes in the location of central office shall be duly notified to all concerned.

6.      Chairman of the 'BMA' will be appointed by ABAA CEC.

 

B. “ABAA” shall establish recording hall, casseettee center and film industry.

 

Rule-9

Maintain close relationship with Bhutanese organisations unions and help each other. and settle issues through collective bargaining and negotiations.

 

Rule-10

Maintain working relation with international guilds and affiliate with  federations of common objectives worldwide.

 

Rule-11

            Liberate to present the art without any discrimination worldwide.

 

Rule-12

         a . Promote professional women in art.

         b .Promote professional dancers, musicians,  singers, actors, lyricists and script

 writetrs.

 

Rule-13

To make the artists conscious of their rights and duties. 

 

Rule-14

To liberate artists from suppressed, exploited and unhealthy environment

 

Rule-15

Provide entertainment facilities for improvement and promotion of mental as well as physical health.

 

Rule-16

      To subordinate victims of calamities.

 

Rule-17

Maintain peace and security within the country and subordinate international

 peace and security.

 

Rule-18

The association will firmly condemn the injustice verdict of any jury or  judicial         proceedings in the violation of the rights prevailing under ‘Artist Association’.

 

Rule-19

To unite artists for the establishment of human right in Bhutan and work for repatriation.

 

 

 

CHAPTER -III

Rule-20

             MEMBERSHIP

All Bhutan artists association grants two types of membership viz. Individual  membership and club/ Band registration.

      (1) Individual membership is granted to an individual in the spirit of association to the scattered artists from different parts of the country upon fulfillment of the fowling guidelines.

(a)   He/she must be a Bhutanese citizen.

(b)  He/she must have attained the age of six.

(c)  He/she shouldn’t be invalid under the law.

(d)  He/she is entitled to become ordinary member on his signing a pledge to the effect that he will be abided by the rules and bylaws of the ABAA and on payment of minimum subscription of RS 25/100/200/300/as entrance fee decided by from time to time .

(e)  Any member found to be working against the interest of the ABAA or action in contravention of the spirit of rules inforced shall be expelled by an order of the central executive committee and shall forfeit all claims to the privileges and benefits assured by these rules.

Note: The central executive committee shall be the final authority to determine, if the member’s action is against the interest of the association or in contravention of the spirit of any of the rules., as the CEC alone has the authority in absence of the congress to formulate and guide the policy of the association .Such member shall however retain his right of appeal to the congress within five months of the action being taken.

(f)   Subject to the decision of the CEC, the members of the association may be called upon by the CEC to contribute towards any special fund which when raised will be utilized exclusively for the purpose it was separated and shall be open for inspection for all members on proper notice. Contribution to such funds shall, however voluntary and shall not be contribution for admission as members.

    (2)  Club/Band Registration:

Club or Band registration is granted to any club or band upon fulfillment of pre-requisites mentioned here under:

(a)   An application for registration is to be submitted to the president in writing.

(b)  The Club/Band concern subscribes to and observes the objects and policy of the ABAA as defined in the rules.

(c)  The Club/Band objectives assure the first priority to musicians,singers, dancers actors,lyricist and scriptwriters.

(d)  Pay registration fee as determined by ABAA’s CEC from time to time

(e)  Propagate and carryout the decisions of the ABAA  in their own Club/Band, and keep its executive bodies fully informed of the activities and progress off the ABAA.

 

Rule-21

    PROCEDURES FOR ELECTION AT THE GENERAL CONGRESS.

a)      Only ABAA members of at- least one year standing and being up to date their levy payments will be entitled for election to the CEC.

b)     On the first day of General congress, the president will ask General congress to elect .

                                  I.      The president .

                               II.      The Vice-President .

                             III.      General Secretary

                            IV.      Finance Secretary

                               V.      The Executive committee .  

C) Election shall be conducted by  the Election commission composed of representatives from some independent organizations.

CHAPTER -IV

ORGANS OF ABAA

                                     1. The Congress

                                     2. The Central Executive Committee.

                                     3. International Advisory Council

                                     4. General Congress

                                     5. The Secretariat .                                    

Rule-22

           THE CONGRESS

1.      The congress shall be composed of all the office bearers and the president of ABAA.

2.      Members of the CEC of ABAA.

3.      3.Observers from any associations/Organisations who have been invited to attend with the right to address the congress at the invitation of the president but without the right to comment on any decisions taken by the congress.

4.      .It shall meet once a year at a place determined in advance by the CEC.

5.      Notice of the congress must be given at-least fifteen days before the actual day.

6.      The delegates will be allowed to speak in English , Nepali and Dzongkha and congress will engage interpreters if required.

7.      The following matters shall come under the jurisdiction of the congress:             

a)      To review the  activities of the ABAA.

b)     To plan the future activities of ABAA.

c)     To finalise and approve annual expenditure incurred during the previous year and prepare expected budget for the future activities of ABAA.

d)     Decision on the policy to be followed to accomplish the object of the ABAA.

 

Rule-23

             THE CENTRAL EXECUTIVE COMMITTEE.

1.      The central executive committee is composed of secretariat ,President nominated members and chief coordinators.

2.      The meeting of the CEC shall be convened by the General Secreatry with prior consultation with the president or secretariat.

3.      Special meetings of the CEC may be convened to deal with urgent matters.

4.      The CEC shall have the power to take decision only when more than one-half of its members are present.

5.      Each member of CEC will be allowed one vote with exception of the president who shall bot vote and a motion shall be considered adopted when more than one-half of the members represented vote in favour of it.

6.      The CEC shall :

a)      Have the authority to act on behalf of the ABAA  being responsible for the activites of the ABAA and giving effect to the decisions and recommendations of the congress/General congress.

b)     Receive the General Secretary’s activity report, reviews of the important events incase of acuteness depending upon the availability of resources.

c)     Discuss the reports of members of the CEC about important events and development.

d)     Establish the annual budget and adopt the annual financial report of the ABAA .

e)     Admit Clubs/Bands into registration with the ABAA.

f)      Suspend or expel registered clubs/bands when necessary.

g)     Take any other decisions for the furtherance of the objects and aims of the ABAA.

h)     Select the dates and venue of General congress, congress and CEC meetings.

7.      The president of the ABAA shall preside  at all meetings of the CEC should the president be unable to do so the V.P. shall take his place.

8.      The CEC shall be empowered to take  decisions concerning expenses for meeting  and  sessions .of  the  ABAA.

9.      The ABAA and its registered club/band shall maintain a relationship of  collaboration and consultation.

10. Financial / material assistance may be granted  by CEC to any of  its registered clubs /  bands incase of acute  need  depending   upon  the  availability  of  resources   if  all  the members  of  concerned clubs/  bands  are members   of ABAA

11. The  powers of the  CEC  with regars to  the  general  management  of the  affairs  of   ABAA   shall  include  the  right of  suspending or removing from  ABAA   any  office- bearers or   members there of    provided  that:

a.       The matter has been specially included in the agenda for the meeting and,

b.      The decision for suspension or removal is arrived at by a three- fourth majority of those present at the meeting. So suspended or removed shall have the right of appeal to the congress whose decision shall be final.

12. lt will have the power to nominate any person in keeping with the provision of rules and to carry on the work of any office – bearers suspended under rule until a fresh election is made by a similar action, it will fill up other vacancies.

13. The constitution of ABAA shall be amended when three-fourth majority of the CEC condemn any particular article or sub-article.

 

Rule- 24

             INTERNATIONAL ADVISORY COUNCIL.

1)     International Advisory council is composed of eleven members from different parts of the world. Two members will be from ABAA.

2)     Advisory council shall carfully study the drawbacks and shortcomings in the association and give effective advice and suggestions where necessary.

 

Rule- 25

             THE GENERAL CONGRESS :

1)     The supreme authority of the ABAA shall be vested in the General congress.

2)     The general congress shall be composed of :

a.       Chief coordinator.

b.      ABAA president and general secretary with the right to speak .

c.      Members of the central executive committee of ABAA.

d.      Members of IAC.

e.      Branch executive committees including advisors.

f.       Observers from other Organisations who have been invited to attain with the right to address the general congress at the invitation of the president, but without the right of vote.

g.      All the members of the ABAA.

3)     Aspecial General Gongress shall be convened by central executive committee when two-third of the central executive committee demand it.

4)     Notice of an ordinary general congress must be given at least one month before, and notice of a special general congress at least 20 days before the meeting of the General congress.

5)     The delegates will be allowed to speak in English, Nepali and Dzongkha. Hindi is considerable and the secretariat will engage interpreters if required.

6)     The following matters shall come under the jurisdiction of the general congress.

a.       Electon of the president vice-president, central executiv ecommittee and adcvisors.

b.      Decision on the policy to be followed to accomplish the objects of the ABAA.

c.      Selection of the Headquaters.

d.      Revision of the rules : Proposed amendments to the rule of the ABAA must be submitted to the secretariat at least three months before congress. These proposed amendments shall be distributed to all delegates at least eight weeks before congress.

7)     The member of the General Congress shall have single no-transferable vote.

8)     The General congress shall be convended by the central executiv committee and shall meet once every four  years.

 

Rule- 26

          THE SECRETARIAT :

1)     The secretatial of ABAA shall be composed of the president, Vice-president, General Secretary,Press & publicity and the financial secretary of ABAA.

2)     The new officers shall take office immediately after convention / congress and shall hold office until the conclusion of the next General congress.

3)     They shall be eligible for re-election.

4)     The President shall preside at all meetings of the ABAA and should be unable to do so, the vice-president will take this place.

5)     Each member of the secretariat shall have one vote with the exception of the president who shall note vote.

6)     The secretariat shall have the authority to take decision concerning the administration of the affairs of ABAA.

7)     The secretariat shall determine the duties of the General secretary and receive reports at regular intervals on the activities of ABAA.

8)     Vacancies in the secretariat shall be filled by CEC at its next meeting.

9)     The secretariat shall fix the salary and conditions of employment of the office bearers and it shall also establish general guidelines and procedures for the terms and conditions of service of staff members.

 

 

 

CHAPTER -V

Rule- 27

          POWERS AND DUTIES OF OFFICE BEARERS:

A.     PRESIDENT:

1)     President shall function as the chief executive officer of the Association.

2)     He shall preside over all the meetings of the association.

3)     He shall operate jointly with the treasurer the bank accounts and others financial matters withrespect to the ABAA.

4)     He shall devote full time to the activities of ABAA.

5)     He shall apply his discretionary powers in certain cases for the furtherance of the interest of ABAA.

6)     The work of the president will be performed in accordance with the instructions of the General Congress, Congress, CEC and secretariat to whom he shall be responsible.

7)     He shall represent the ABAA with outside institutions and shall maintain contact with all the free and democratic Organisation.

8)     He shall cast deciding vote in case of tie.

9)     He shall accept the resignation of the CEC members and issue termination in accordance with  CEC”s majority.

10)He shall have the power to make expenses of maximum Rs10,000 incase of emergencies and later submit it to the secretariat and CEC for approval.

11)He shall appoint the elected candidates and proclaim his/her rights and duties.

12)He shall be responsible for the over all direction co-ordination monitoring and evaluation of plans and programs of the association.

13)He shall develop regional, national and international integration with related association and Organization.

14)All sorts of bill must be assent by the president .

15)He shall struggle against the unfavorable situation prevailing in the association, either by the internal and external factors.

16)He shall protect the right of any members of the association and direct them towards their duties .

17)He shall recommend resignation and termination.

B.     Criteria For The Post Of President.

1.      The  candidate should have experience in social service at least for three years.

2.      Qualification must be graduation or equivalent.

3.      Age of the candidate should be twenty and above.

4.      The candidate should not be holding membership (any post ) in political parties or its sister Organizations.

5.      The candidate must be the member of central executive committee.

C.     Election Procedure:

Elected President must acquire majority vote of the members. Election is done under secret ballot system.

D.    Appointment Of The President :

Chief of the election committee shall appoint the elected president.

E.     Service tenure of the president is four years till the next election is conducted.

F.      Condition For the Dismissal Of President :

1.      In case of forwarding resignation by the president, the submission of resignation letter must be given before a month of leaving the post.

2.      In case of impeachment forwarded by three-four of the majority of the central committee. He has become invalid under the law in force for the time being.

 

Rule- 28

A.     VICE PRESIDENT  :

1.      Vice presidents should be empowered all the rights and duties.

2.      He/she shall perform all the duties of the president in the absence of president.

3.      He/she shall be the chief organisor of any short of programme organized by the association.

4.      Vice president shall carryout any other work for the furtherance of the interest of the ABAA.

B.     CRITERIA FOR THE POST OF VICE PRESIDENT :

Same as president.

C.     ELECTION PROCEDURE :

Same as president.

D.    APPOINTMENT OF THE VICE PRESIDENT :

President shall appoint the elected vice president.

E.     SERVICE TENURE OF VICE PRESIDENT

Service tenure of vice president is four years.

F.      CONDITION FOR DISMISSAL OF VICE PRESIDENT :

Same as president.

 

Rule- 29

A.     GENERAL SECRETARY :
