TITLE 18 UNITED STATES CODE  SECTION 1001 - FEDERAL LAW BUSH & 9-11 COMMISSION VIOLATED IN THE COVERUP

(a) Except as otherwise provided in this section, whoever, in any matter within the jurisdiction of the executive, legislative, or judicial branch of the Government of the United States, knowingly and willfully—
(1) falsifies, conceals, or covers up by any trick, scheme, or device a material fact;
(2) makes any materially false, fictitious, or fraudulent statement or representation; or
(3) makes or uses any false writing or document knowing the same to contain any materially false, fictitious, or fraudulent statement or entry;
shall be fined under this title or imprisoned not more than 5 years, or both.
(b) Subsection (a) does not apply to a party to a judicial proceeding, or that party’s counsel, for statements, representations, writings or documents submitted by such party or counsel to a judge or magistrate in that proceeding.
(c) With respect to any matter within the jurisdiction of the legislative branch, subsection (a) shall apply only to—
(1) administrative matters, including a claim for payment, a matter related to the procurement of property or services, personnel or employment practices, or support services, or a document required by law, rule, or regulation to be submitted to the Congress or any office or officer within the legislative branch; or
(2) any investigation or review, conducted pursuant to the authority of any committee, subcommittee, commission or office of the Congress, consistent with applicable rules of the House or Senate.

  • Bogdan Dzakovic was a special agent and senior team leader on the Federal Aviation Administration's (FAA) Red Team, which checked airport security through covert tests. For years, the Red Team had been breaching airport security with alarming ease, at over a 90% rate. Dzakovic and others warned that a disastrous hijacking was inevitable without a fundamental overhaul. In response, the FAA ordered the Red Team to not write up its findings or retest airports that flunked. After 9/11, Dzakovic, like many other concerned whistleblowers, felt compelled to bring these weaknesses to light. The government reacted to national debate on Dzakovic's charges by stripping him of his professional duties. An Inspector General report confirmed the crux of Dzakovic's allegations of gross mismanagement creating a substantial and specific danger to public safety,3 leading a top government official in charge to say that "the days of the old FAA Red Team are gone." The government official, Admiral James M. Loy, further stated that he "insisted that we completely discard" the "failed system."4 Dzakovic has a wealth of knowledge to offer about how to make our nation's airports safer. Yet, in a classic retaliatory move, Dzakovic has been relegated to tasks far below his capacity. He performs menial tasks such as punching holes in training manuals, updating the old FAA telephone book, and working graveyard shifts for his new employer, the Transportation Security Agency (TSA). In March 2003, the U.S. Office of Special Counsel censured TSA for failing to hold Dzakovic's superiors accountable, adding "it was unclear why a valued senior member of the FAA Red Team, like Mr. Dzakovic, was not given a role in the creation or operation of TSA's new covert testing program." Dzakovic testified before the National Commission on Terrorist Attacks Upon the United States in 2003 about how abuses of secrecy pose a clear and present danger to homeland security.5
